AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE REAL ESTATE
SALES CONTRACT WITH ROY SMITH FOR ACQUISITION OF AN
EXISTING PIT OF APPROXIMATELY 4.0 ACRES OUT OF THE
SOUTHEAST ONE -HALF OF THE SOUTHEAST ONE -HALF OF LOT
NO. 2, BYRON WILLIS SUBDIVISION AS SHOWN BY MAP OR
PLAT OF RECORD THEREOF IN VOLUME A, PAGE 48, MAP
RECORDS OF NUECES COUNTY, TEXAS, FOR USE AS BRUSH AND
DEBRIS DISPOSAL SITE AND FOR OTHER PUBLIC PURPOSES;
APPROPRIATING OUT OF THE NO. 102 GENERAL FUND,.
ACTIVITY 3554, CODE 501, THE SUM OF $$87.50, OF WHICH
$1.00 IS FOR ACQUISITION AND $86.50 IS FOR CLOSING
COSTS AND OTHER INCIDENTAL EXPENSES; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED,
TO EXECUTE REAL ESTATE SALES CONTRACT WITH ROY SMITH FOR ACQUISITION OF AN
EXISTING PIT OF APPROXIMATELY 4.0 ACRES, SAID PIT TO BE USED FOR BRUSH AND
DEBRIS DISPOSAL SITE, MORE FULLY DESCRIBED AS FOLLOWS:
THE SN1TII PIT
Being a part of the Southeast (L) one -half of the Southeast (z) one -half of
Lot No. 2, Byron Millis Subdivision as shown by the map or plat of record thereof
in Volume A, page 48, Map Records of Nucces County, Texas, to which reference is
here made for all pertinent purposes; being also a part-of thbse two certain tracts
of land described in Partition Deed covering the Willie McBride 17.10 acre tract
by and between Margorie E. McBride, femme sole, and Willie McBride, dated
January 8, 1952, recorded in Volume 538, page 19, Deed Records of Nueces County,
Texas; said tract being more particularly described-by metes and bounds as
follows; to wit;
Being at the Southeast corner of said Lot 2, the Southeast. corner of the Willie
McBride 17.10 acre tract and also the Southeast corner of the tract of land
conveyed to Margorie E. McBride in the aforementioned Partition Deed for the
Southeast corner of this tract;
Thence N. 610 021 West, along the Southwest boundary line of said Lot No. 2,
the Southwest boundary line of said Willie McBride 17.10 acre tract,' at 242.67
feet the Southwest corner of the tract of land conveyed to Margorie E. McBride
in the aforementioned Partition Deed, in all a distance of 655.46 feet to the
Southwest corner of said Willie McBride 17.10 acre tract, the Southwest corner
of the tract of land conveyed to idillie McBride in the aforementioned Partition
Deed, for the Southwest corner of this tract;
Thence IT. 290 00' E., along the northwest boundary line of said Willie McBride
17.10 acre tract, the northwest boundary line of the tract of land conveyed to
Willie McBride in the aforementioned Partition Deed, a distance of 370.0 feet
to a point for the northwest corner of this tract;
Thence S. 610 02' E., along a line parallel to the Southwest boundary line of
said Lot No. 2, the Southwrest boundary line of said Lot 2, the southwest boundary
line of said Willie McBride 17.10 acre tract, at 412.79 feet intersect the north-
west boundary line of the tract of land common to Margoric McBride in the afore-
mentioned Partition Deed in all a distance of 655.46 feet to a point in the
Southeast boundary line of said Lot No. 2, the Southeast boundary line of said
Willie McBride 17.10 acre tract for the Northeast corner of this tract;

Thence S 290 00' W., along the Southeast boundary line of said Lot No. 2, the
Southeast boundary line of the said Willie McBride 17.10 acre tract, a distance
of 370.0 feet to the place of beginning.
Together with the free and uninterrupted use, liberty privilege and easement of
passing in and along a certain way across 2 certain tracts of land situated in
Nueces County, Texas adjacent to the hereinabove described and hereby conveyed
tract of land and now owned by us and being the same two tracts of land, except
the portion thereof hereby conveyed, described in the Partition Deed between
Grantors herein dated January 8, 1952, recorded in Volume 538, page 19, Nueces
County, Texas Deed Records, said way being 144 feet in width and extending between
parallel lines from the Northeast boundary line of the hereinabove described and
t hereby.conveyed tract of land to the Southwest boundary of the right of way for'
Lexington Blvd (South Padre Island Drive), as same now exists and having for its
centerline the common boundary line between said two tracts along such course
together with free ingress and egress and regress to and for the said Roy Smith,
his heirs and assigns and their tenants in connection with their use and
occupancy of said hereby conveyed tract of land by foot, cart, wagon, horse, mule,
cattle and other lawful means as by him or them shall be for such purposes
necessary or convenient at all times'and seasons forever in along, upon and out of
said way in common with us the said 1.4illie McBride or Margorie E. McBride, our
respective heirs and assigns and our and their-tenants.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF THE N0. 102 GENERAL
FUND, ACTIVITY 35544, CODE 501, THE SUM OF $87.50, OF WHICH $1.00 IS FOR
ACQUISITION AND $86.50 IS FOR CLOSING COSTS AND OTHER INCIDENTAL EXPENSES.
SECTION 3. THE NECESSITY TO AUTHORIZE THE ACQUISITION OF THE
AFORESAID PARCEL OR TRACT OF LAND IN ORDER TO PROVIDE ADDITIONAL BRUSH AND
DEBRIS DISPOSAL SITE CREATES A PUBLIC EMERGENCY AND. IMPERATIVE PUBLIC NECES-
SITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESO-
LUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY
COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST,
AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDI-
NANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND
BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
SO ORDAINED, THIS THE 31ST DAY OF MARCH, 1971.

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
