THE ORDINANCE WAS READ BY THE CITY SECRETARY. THE MAYOR PRO TEM PRESENTED TO THE COUNCIL A COMMUNICATION IN WRITING PERTAINING TO SAID PROPOSED ORDINANCE, AS FOLLOWS: "CORPUS CHRISTI, TEXAS APRIL 7, 1971 "TO THE CITY COUNCIL CORPUS CHRISTI, TEXAS, GENTLEMEN: THE PUBLIC IMPORTANCE AND PRESSING NEED FOR THE PERMANENT IMPROVE- MENTS TO BE CONSTRUCTED BY USE OF THE PROCEEDS OF BONDS CONTEMPLATED TO BE VOTED PURSUANT TO AN ORDINANCE CREATE AN EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF RULES AND CHARTER PROVISIONS REQUIRING ORDINANCES TO BE VOTED UPON AT THREE REGULAR MEETINGS. THE ORDINANCE IS AS FOLLOWS: - I ORDINANCE NO. _ BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, CALLING AN ELECTION ON.THE QUESTION OF THE ISSUANCE OF COMMUNITY FACILITY BONDS; AND DECLARING AN EMERuENCY. WHEREAS, the City Council of said City deems it advisable to issue the bonds of said City for the purpose hereinafter stated; and WHEREAS, it is hereby officially found and determined: that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public necessity being that the proceeds from the proposed bonds are required as soon as possible and without delay for necessary and urgently needed public improvements; that said meeting was open to the public as required by law; and that public notice of the time, place, and purpose of said meeting was given as required by law; and that public notice of the time, place, and purpose of said meeting was given as required by Vernon's Ann. Civ. St. Article 6252 -17, as amended. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS:. 1. That an election shall be held in said City on the 1st day of May, 1971. The regular county election precincts of Nueces County within the said City are hereby established as the Election Precincts for such election. In all cases where a County Election Precinct is not located entirely within the City limits of the City of Corpus Christi so much of such County Elec- tion Precinct that is located within the said City limits shall be considered an election precinct for said City. That at said election the following PROPOSITION shall be submitted in accordance with law: DDnDnCTTTnN7 Shall the City Council of said' City be authorized to issue the bonds of said City, in one or more series or issues, in the aggre- gate principal amount of $24,500,000,with the bonds of each such series or issue, respectively, to mature serially within not to exceed thirty years frbm their date, and to be sold in accord- ance with law at such prices and bear interest at such rates as shall be determined within the discretion of the City Council for the purpose of providing funds for making permanent public improvements, to -wit: in the amount of $24,500,000 for constructing a community facility to be known as Plaza del Mar to include an arena, exhibit hall, meeting rooms, auditorium, and various related facilities, and acquiring the site therefor; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sink- ing fund to pay said bonds at maturity? 3. That said election shall be held in accordance with law, and that said election shall be held and conducted in effect as two separate but simultaneous elections, to -wit: one election at which only the resident, qualified electors j who own taxable property in the City and who have duly ` rendered the same for taxation shall be entitled to vote on ` said PROPOSITION, and another election at which all other resident, qualified electors of the City shall be entitled to vote on said PROPOSITION. The votes cast at each of said ` separate but simultaneous elections shall be recorded, returned, { and canvassed separately. It is hereby declared that the purpose; of holding the election in such manner is to ascertain arithmeti- cally: (a) the aggregate votes case at the election for and against said PROPOSITION by resident, qualified electors of the City, and also (b) the aggregate votes cast at the election for and against said PROPOSITION by resident, qualified electors who own taxable property in the City and who have duly rendered the same for taxation. Each elector shall be entitled to vote once, in accordance with the foregoing provisions of this Ordinance. 4. That the official ballots for said election shall• be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITION, which shall be set forth in substantially the following form: PROPOSITION CFOR The issuance of bonds in the amount of $24,500,000 for constructing a community facility�to be known as Plaza del Mar to include an arena, exhibit hall, meeting rooms, auditorium,�and various related facilities, and acquiring t e site therefor., AGAINST The issuance of bonds in the amount of $24,5/00,000 for constructing a community facility to be known de as Plaza del Mar to inclu an arena exhibit hall, meeting rooms, auditorium, /and various related facilities, and acquiring t e site therefol 5. That voting machines shall be employed at the election herein ordered'in accordance with the provisions of V.A.T.S. Election Code, Article 7.14. 6. That the City Secretary of the City of Corpus Christi shall be the clerk for absentee voting at said election; and the office of said City Secretary in the City Hall is hereby designated as the place at which absentee voting shall be con- ducted for said election, during the regular office hours of x; a - said City Secretary. Voting machines shall be used both for absentee voting by personal appearance and for voting at the regular polling places at said election; but paper ballots shall be used for absentee voting by mail. A Special Canvassing Board shall be appointed by the Mayor, as provided by law, to count and canvass all absentee votes and ballots cast at said election. 7. A substantial copy of this Ordinance shall serve as proper notice of said election. Notice shall be given in_ accordance with Article 704, Revised Civil Statutes of 1925, as amended. The Mayor is authorized and directed to have a copy of said notice posted at the City Hall in said City and at each of the voting places in said City, not less than fifteen days prior to the date fixed for holding said election. He shall also cause said notice to be published on the same day in each of two successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen days prior to the date set for said election. Except as otherwise provided in said Article 704, as amended, the manner of holding said election shall be governed by the laws governing general elections. 8. That the public importance and the pressing need for the permanent improvements to be constructed by use of the proceeds of the sale of said bonds create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring same to be considered and voted upon at three regular meetings, and such facts require that this ordinance be passed and take effect immediately as an emergency measure, and such rules and provisions are hereby suspended and this ordinance is passed and shall take effect as an emergency measure, and shall be in full force and effect immediately upon its passage. 9. It is hereby officially found and determined that the meeting at which said election was called was open to the public as required by law and public notice of the time, place, and purpose of said meeting was given as required by Vernon's Ann.
