HomeMy WebLinkAbout10242 ORD - 04/14/1971JRR:JKH:4 -14 -71 AN ORDINANCE AMENDING THE CITY OF CORPUS CHRISTI CODE OF ORDINANCES, 1958, AS AMENDED, AND ORDINANCE NO. 4168, COMMONLY CALLED THE PLATTING ORDINANCE, AS AMENDED, BY AMENDING SECTION IV - DESIGN STANDARDS, SUBSECTION E. LOTS, PARAGRAPH (I+); PROVIDING REPEALER; PROVIDING SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY COUNCIL OF CORPUS CHRISTI FINDS THAT THERE IS A SEVERE SHORTAGE OF PUBLIC HOUSING IN THE CITY; AND WHEREAS, THE SAID CITY COUNCIL FINDS THAT THE CORPUS CHRISTI HOUSING AUTHORITY HAS CAUSED TO BE DEVELOPED SITE PLANS FOR.PUBLIC HOUSING IN THE CITY FOR ONE HUNDRED SEVENTY -EIGHT (178) TWO - AND -THREE BEDROOM DWELLING UNITS AT TREYWAY LANE AND HOLLY ROAD, THIRTY (30) SINGLE - FAMILY UNITS AT RICHTER AND SACKY ROADS, AND TWENTY -TWO (22) ONE - BEDROOM UNITS AT RAMSEY AND HOUSTON STREETS; AND WHEREAS, THE CITY COUNCIL FINDS SUCH SITE PLANS TO BE IN THE PUBLIC INTEREST AND TO IMPROVE THE PUBLIC HEALTH, SAFETY, AND WELFARE; AND WHEREAS, THE CITY COUNCIL FINDS THAT THE CITY OF CORPUS CHRISTI CODE OF ORDINANCES, AS AMENDED, AND THE CITY PLATTING ORDINANCE, AS AMENDED, SHOULD BE FURTHER AMENDED TO ACCOMMODATE THE OUTSTANDING SITE PLANS FOR PUBLIC HOUSING TYPIFIED BY THE ABOVEMENTIONED SITE PLANS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THE CITY OF CORPUS CHRISTI CODE OF ORDINANCES, 1958, AS AMENDED, AND ORDINANCE No. 4168, COMMONLY CALLED THE PLATTING ORDINANCE, AS AMENDED, IS HEREBY AMENDED BY THE AMENDMENT OF SECTION IV - DESIGN STANDARDS, SUBSECTION E. LOTS, PARAGRAPH (4), TO HEREAFTER READ AS FOLLOWS: "(4) THE SUBDIVIDING OF THE LAND SHALL BE SUCH AS TO PROVIDE EACH LOT WITH REASONABLE ACCESS TO AN EXISTING PUBLIC STREET BY MEANS OF A PUBLIC STREET OR A NON- PUBLIC ROADWAY OWNED BY THE CORPUS CHRISTI HOUSING AUTHORITY OR OTHER GOVERNMENTALLY SPONSORED PUBLIC HOUSING PROJECT. FOR THE PURPOSES OF THIS PARAGRAPH IN ITS APPLICATION TO THE CORPUS CHRISTI HOUSING AUTHORITY OR OTHER GOVERNMENTALLY SPONSORED PUBLIC HOUSING PROJECT, ANY OTHERPROVISIONS OF THIS OR OTHER ORDINANCES TO THE CONTRARY NOTWITHSTANDING, THE FOLLOWING RULES SHALL APPLY: 10212 3 "A. A PLAT OR BUILDING PERMIT APPLICATION SUBMITTED BY A PERSON OR AGENCY OTHER THAN THE CORPUS CHRISTI HOUSING AUTHORITY OR OTHER GOVERNMENTALLY SPONSORED PUBLIC HOUSING PROJECT SHALL BE ENTITLED TO TREATMENT UNDER THE PROVISIONS OF THIS PARAGRAPH AS AN APPLICA- TION OF SAID AUTHORITY OR SAID PROJECT IF SUCH PERSON OR AGENCY SUBMITS WITH SUCH APPLICATION AN AGREEMENT IN WRITING BINDING SUCH PERSON OR AGENCY TO CONVEY ALL RIGHT, TITLE, INTEREST AND CLAIM IN AND TO THE PROPERTY SUBJECT OF SUCH APPLICATION TO THE SAID AUTHORITY OR OTHER PROJECT UPON COMPLETION OF AN EXISTING CONTRACT FOR THE PROCUREMENT OF LAND AND/OR THE DEVELOPMENT AND IMPROVEMENT OF SUCH LAND FOR PUBLIC HOUSING. APPROVAL BY THE CITY ATTORNEY OF SUCH AGREEMENT AS TO ITS COM- PLIANCE WITH THIS PROVISION SHALL BE PREREQUISITE TO CONSIDERATION HEREUNDER. "B. A CONDITION EXPRESSED ON THE PLAT SHALL RECITE: 'No PART OF A NON - PUBLIC ROADWAY OR STREET HEREIN SHALL BE SOLD OR DEDICATED TO ANY PERSON OTHER THAN THE CITY OF CORPUS CHRISTI OR ITS SUCCESSOR OR THE CORPUS CHRISTI HOUSING AUTHORITY OR ITS SUCCESSOR.' "C. UPON SALE OF ALL OR ANY PORTION OF THE PLATTED PROPERTY TO ANY PERSON OTHER THAN THE CITY OF CORPUS CHRISTI, OR ITS SUCCESSOR, OR THE CORPUS CHRISTI HOUSING AUTHORITY, OR ITS SUCCESSOR, THE GRANTOR SHALL THEREUPON REPLAT ALL OF THE PROPERTY ORIGINALLY PLATTED TO FULLY CONFORM TO ALL REQUIREMENTS OF THE PLATTING ORDINANCE." SECTION 2. ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE- WITH ARE HEREBY REPEALED TO THE EXTENT OF CONFLICT HEREWITH. SECTION 3. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. -2- SECTION 4. THE NECESSITY FOR ERECTING PUBLIC HOUSING AS RAPIDLY AS POSSIBLE DUE TO THE LARGE NUMBER OF PERSONS MADE HOMELESS BY HURRICANE CELIA CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND'EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE f4V DAY OF W�✓� , 1971.
