On this the 5th day of May, 1971, the City Council
of the City of Corpus Christi, Texas, convened in Regular t
Meeting, with the following members of said Council present,
to -wit:
Jack R. Blackmon, Mayor
V. A. Bradley, Jr.
• Eduardo E. deAses
Gabe Lozano, Sr.
Ken McDaniel _
W. J. Roberts
Ronnie Sizemore
T. Ray Kring, City Secretary
James R. Riggs, City Attorney
with the following absent:
constituting a quorum, at which time the following among other
business was transacted:
Mr. Blackmon, Mayor, presented for -the consideration
of the Council an Ordinance. The Ordinance was,read by the City
Secretary. The'Mayor presented to the Council a communication in

writing pertaining to said proposed ordinance, as follows:

Gentlemen:
The necessity for promptly canvassing the result of
the election on the question of the issuance of improvement
bonds held on May 1, 1971, and to make an immediate record of
the said results creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule,
that no ordinance or resolution shall be passed finally on the
date of its introduction and that such ordinance or resolution
shall be read at three several meetings of the City Council, and
the Mayor having declared such emergency and necessity to exist,
and having requested the suspension of the Charter rule and
that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect
from and after its passage, it is accordingly so ordained,
this the 5th day of May, 1971.

written request of .the Mayor and stated in the emergency clause
of the ordinance. The motion was seconded by Commissioner

The Mayor requested that the records show that he
voted Aye. This was done.

BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS, CANVASSING RETURNS AND
DECLARING RESULTS OF AN ELECTION ON TllE
QUESTION OF THE ISSUANCE OF IMPROVEMENT
BONDS; AND DECLARING AN EMERGENCY.
WHEREAS, heretofore on the 7th day of April, 1971,
the City Council of the City of Corpus Christi, Texas, passed
an ordinance calling an election to be held in said City
on the lst day of May, 1971, on the Proposition herein-
after stated; and
-WHEREAS, said City Council has investigated all matters
pertaining to said election, including the ordering, giving
notice, officers, holding, and making returns of said election;
and
WHEREAS, the election officers who held said election

have duly made the returns of the result thereof, and said

returns have been duly delivered to said City Council; and
WHEREAS, it is hereby officially found and determined:
that a case of'emergency or urgent public necessity exists which

requires the holding of the meeting ae,which this Ordinance is
passed, such emergency or urgent public necessity being that the,
proceeds from the proposed bonds are required as soon as possible
and without delay for necessary and 'urgently needed public

improvements; that said meeting was open to the public as
required by law; and that public notice of the time, place, and
i
purpose of said meeting was given as required by law; and that
i
public notice of the time, place, and purpose of said meeting
was given as required by Vernon's Ann. Civ. St. Article 6252 -17,

as amended.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
1. That the City Council officially finds and i
determines that said election was duly ordered, that proper
notice of said election was duly given, that proper election
officers iaere.duly appointed by the City Council prior to said
election, that said election was duly held, that due returns of,
the result of said-election have been made and delivered, and I
that the City Council has duly canvassed said returns, all in
accordance with law..

' 2. That-the City Council officially finds and

determines that the following votes were cast at the election

on the submitted Proposition, by the resident, qualified
electors who own taxable property in said City, and who have

duly rendered the same for taxation, and who voted at the ,
election:

of $24,500,000 for constructing a com-
munity facility to be known as Plaza del
Mar to include an arena, exhibit hall,
meeting rooms, auditorium, and various
i ) related facilities, and acquiring the

3. That the City Council officially.finds• aid
determines that the following votes were cast at the election,
on the submitted Proposition, by all other resident,•qualified
electors of said City who voted at the election:
PROPOSITION

of $24,500,000 for constructing a com-
munity facility, to be known as Plaza del
Mar to include an arena, exhibit hall,
meeting rooms, auditorium, and various
)• related facilities, and acquiring the

4. That the City Council officially finds, determines
and declares the result of said election to be that said
Proposition so submitted failed to receive a favorable majority I
vote.
5. That the necessity for promptly canvassing the
results of the election on the question of issuance of bonds
for permanent improvements in the City of Corpus Christi and to
make record of such canvass creates an emergency and an impera-
tive public necessity requiring the suspension of rules and
C'.arter provisions requiring same to be considered and voted upon
at three regular meetings, and such facts require that this ordi-
nance be passed and take effect immediately as an emergency
measure, and such rules and provisions are hereby suspended and
this ordinance is passed and shall take effect as an emergency
measure, and shall be in full force and effect immediately upon
its passage.
6. It is hereby officially found and determined that
the meeting at which said election returns were canvassed was
open to the public as required by law and public notice of the
time, place and purpose of said meeting was given as required
by Chapter 227, Acts of the 61st Legislature, Regular Session,
1969.

I, the undersigned, City Secretary of the City of
Corpus Christi, Texas, do hereby certify that the above and
foregoing is true and correct copy of an ordinance passed by the
City Council of the City of Corpus Christi, Texas (and of the
Minutes pertaining thereto), on the 5th day of May, 1971, can-
vassing returns and declaring results of an election on the
propositions set -forth in said ordinance, which ordinance is
duly on record in the Minutes of the City Council and that said
Meeting was open to the public as required by law and public
notice of the time, place and purpose of said Meeting was given
as required by Chapter 227, Acts of the 61st Legislature, Regular
Session, 1969.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I. therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
