AMENDING SECTION 16 -84 OF THE CORPUS CHRISTI CITY
CODE, 1958, AS AMENDED, SO AS TO CHARGE $2.00 FOR A
SIX -MONTH TEMPORARY FOODHANDLER'S PERMIT AND TO CHARGE
$4.00 FOR A PERMANENT ONE -YEAR FOODHANDLER'S PERMIT;
AMENDING SECTION 16 -88 OF.&THE CORPUS CHRISTI CITY CODE,
1958, AS AMENDED, SO AS TO PROVIDE FOR A SIX —MONTH TEMPO-
RARY FOOD HANDLER'S PERMIT AND A ONE —YEAR PERMANENT FOOD —
HANDLER'S PERMIT; PROVIDING FOR REPEAL OF ALL ORDINANCES
IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND
DECLARING AN EMERGENCY,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,

TEXAS:
SECTION 1. THAT' SECTION 16 -84 OF THE CORPUS CHRISTI CITY CODE,
1958, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS:
"SECTION 16 -84. FEE — FOR ORIGINAL.

"THERE SHALL BE A CHARGE MADE OF TWO DOLLARS ($2.00 FOR THE.
ISSUANCE OF A SIX -MONTH TEMPORARY FOODHANDLER'S PERMIT AND A CHARGE OF FOUR
DOLLARS ($4.00) FOR A ONE —YEAR PERMANENT FOODHANDLER'S PERMIT, AND THE

REVENUES DERIVED FROM THE ISSUANCE OF SUCH'PERMITS SHALL BE USED TO DEFRAY

THE EXPENSES OF ISSUING SUCH PERMITS AND THE KEEPING OF THE NECESSARY FILES
AND RECORDS IN REGARD TO FOODHANDLER'S PERMITS."
SECTION 2. THAT SECTION 16 -88 OF THE CORPUS CHRISTI CODE, 1958,
AS AMENDED, BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS:
"SECTION 16 -88. TERMS;RE— EXAMINATION.
"NO TEMPORARY FOODHANDLER'S PERMIT SHALL BE VALID FOR MORE THAN
SIX (6) MONTHS AND NO PERMANENT FOODHANDLER'S PERMIT SHALL BE VALID FOR MORE
THAN ONE (1) YEAR AND EVERY PERSON IN CHARGE OF OR CONTROL OF, OR OPERATING
' OR CONDUCTING ANY FOOD ESTABLISHMENT SHALL INSTITUTE AND HAVE MADE A PERSONAL
14EDICAL EXAMINATION OF EACH OF HIS EMPLOYEES OR OTHER PERSONS, WHETHER EM-
PLOYED OR NOT, WORKING IN OR ABOUT SUCH ESTABLISHMENT BY THE CITY PHYSICIAN
REGULARLY EMPLOYED BY THE CITY FOR THE PURPOSE OF CONDUCTING THE EXAMINATION
OF PERSONS APPLYING FOR FOODHANDLER'S PERMITS, AT INTERVALS NOT TO EXCEED
SIX MONTHS IN THE CASE A TEMPORARY PERMIT IS REQUESTED AND ISSUED OR ONE
YEAR IN THE CASE A PERMANENT PERMIT IS REQUESTED AND ISSUED, WHICH EXAMINA-
TION SHALL BE CONDUCTED AS PROVIDED IN THIS ARTICLE, AND SHALL, AFTER SUCH
EXAMINATION BY SUCH PHYSICIAN, PROMPTLY DISCHARGE ANY PERSON FOUND TO BE
INFECTED BY OR AFFECTED WITH ANY INFECTIOUS OR CONTAGIOUS DISEASE. THE CITY

PHYSICIAN SHALL REPORT THE RESULTS OF THE TESTS MADE AND THE RESULTS OF
THE MEDICAL EXAMINATION TO THE EMPLOYER OF ANY EMPLOYEE."
SECTION 3. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH SHALL BE AND ARE HEREBY REPEALED TO THE EXTENT OF CONFLICT HEREWITH.
SECTION 4. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION,
CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID BY FINAL
JUDGMENT OF A COURT OF COMPETENT JURISDICTION, IT SHALL NOT AFFECT ANY VALID
PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO
WHICH THESE RULES AND REGULATIONS RELATE.
SECTION 5. THE NECESSITY TO AMEND THE REGULATIONS CONCERNING
FOODHANDLERS' PERMITS IN ORDER TO MAKE PROVISION FOR ISSUING TEMPORARY AS
WELL AS PERMANENT PERMITS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE
CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO
EXIST, AND HAVING REQUESTED THE SUSPENSION OF. THE CHARTER RULE AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT
AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative ndcessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
