AN ORDINANCE
AMENDING THE CITY OF CORPUS CHRISTI CODE OF ORDINANCES,
1958, AS AMENDED, BY ADDING THERETO A NEW ARTICLE IV,
JOINT AIRPORT ZONING BOARD, IN CHAPTER 7, AVIATION, OF
SAID CODE; PRESCRIBING THE COMPOSITION OF SAID BOARD,
ITS POWERS AND JURISDICTION; RATIFYING, CONFIRMING AND
APPROVING THE REGULATIONS AND RULINGS OF SAID BOARD;
PROVIDING A REPEALING CLAUSE; PROVIDING SEVERABILITY;
AND DECLARING AN EMERGENCY.
WHEREAS, THE COUNTY OF NUECES, TEXAS, BY MOTION OF ITS
COMMISSIONERS' COURT ON APRIL 18,E 1957 (VOLUME 61 PAGES 255 -2561
COMMISSIONERS' COURT MINUTES) AND THE CITY OF CORPUS CHRISTI, TEXAS,
BY MOTION OF ITS CITY COUNCIL ON MAY 11 1957, DULY ENTERED IN THE
MINUTES OF SAID COUNCIL, ESTABLISHED THE JOINT AIRPORT ZONING BOARD OF
NUECES COUNTY, TEXAS AND THE CITY OF CORPUS CHRISTI, TEXAS; AND
WHEREAS, IT IS THE FINDING OF THE CITY COUNCIL THAT THE COMPO-
SITION OF SAID BOARD AND THE TERMS OF ITS MEMBERS SHOULD BE RESTATED IN
ACCORDANCE WITH ARTICLE 46E -3, V.A.C.S., TEXAS, AS AMENDED:
NOW, THEREFORE, BE IT ORDAiNED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS: I
SECTION 1. BY VIRTUE OF THE AUTHORITY OF ARTICLE 46E -3, V.A.C.S.,
TEXAS, AS AMENDED, THERE IS HEREBY ESTABLISHED THE JOINT AIRPORT ZONING
BOARD OF NUECES COUNTY, TEXAS AND THE CITY OF CORPUS CHRISTI, TEXAS, WHICH
MAY BE COMMONLY CALLED THE JOINT AIRPORT ZONING BOARD, IN COOPERATION WITH
THE COUNTY OF NUECES, TEXAS.
SECTION 2. SAID BOARD SHALL BE COMPOSED OF FIVE (5) MEMBERS,
TWO (2) OF WHOM SHALL BE APPOINTED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS AND TWO (2) OF WHOM SHALL BE APPOINTED BY THE
COMMISSIONERS' COURT OF NUECES COUNTY, TEXAS. THE FIFTH MEMBER SHALL
BE ELECTED BY A MAJORITY OF THE MEMBERS SO APPOINTED AND SHALL SERVE AS
THE CHAIRMAN OF SAID BOARD. EACH MEMBER SHALL SERVE FOR A TERM OF THREE
(3) YEARS FROM THE DATE OF HIS APPOINTMENT. THE PRESENT MEMBERS OF SAID
BOARD SHALL SERVE UNTIL THEIR SUCCESSORS ARE APPOINTED HEREUNDER.
SECTION 3. IN ADDITION TO THE CHAIRMAN, THE SAID BOARD MAY
PROVIDE FOR THE SELECTION OF SUCH OTHER OFFICERS FROM AMONG ITS MEMBER-
SHIP AS IT DEEMS PROPER. THE MANAGER OF THE CORPUS CHRISTI INTERNATIONAL

AIRPORT AND THE DIRECTOR OF PLANNING OF THE CITY OF CORPUS CHRISTI, OR
THEIR DESIGNEES, SHALL BE ENTITLED TO ATTEND ALL MEETINGS AND SESSIONS OF
THE SAID BOARD BUT SHALL HAVE NO VOTE IN MATTERS ACTED UPON BY SAID BOARD.
SECTION 4. THE JOINT AIRPORT ZONING BOARD SHALL POSSESS AND
EXERCISE ALL THE JURISDICTION) POWERS, AND PROCEDURE DESCRIBED BY ARTICLE
46E -3 AND BY ARTICLE 46E -5, V.A.C.S., TEXAS, AND BY SUCH OTHER PROVISIONS
OF SAID ARTICLE 46E APPLICABLE TO SAID BOARD.
SECTION 5. THE SAID BOARD SHALL ADOPT BY -LAWS TO GOVERN THE
CONDUCT OF ITS BUSINESS AND MAY AMEND THE SAME FROM TIME TO TIME. '
SECTION 6. ALL REGULATIONS AND RULINGS OF THE SAID BOARD HERE-
TOFORE PROMULGATED ISSUED AND MADE ARE HEREBY RATIFIED, CONFIRMEDIAND
APPROVED. i
SECTION 7. ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH SHALL BE AND ARE HEREBY REPEALED TO THE EXTENT OF CONFLICT
HEREWITH.
SECTION 8. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVI-
SION, CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID
BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION, IT SHALL NOT
-AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY
OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE.
SECTION 9. THE NECESSITY TO MAKE THE AFORESAID AMENDMENT TO
THE CORPUS CHRISTI CITY CODE OF ORDINANCES IN ORDER TO RESTATE THE
COMPOSITION OF THE JOINT AIRPORT ZONING BOARD OF NUECES COUNTY, TEXAS
AND THE CITY OF CORPUS CHRISTI, TEXAS IN ACCORDANCE WITH ARTICLE 46E -3,
V.A.C.S., TEXAS, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE

OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT
THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS
OF THE CITY COUNCILS AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND
NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER
RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND

ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
- REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
