HomeMy WebLinkAbout10316 ORD - 06/23/19716 -23 -71 AN ORDINANCE ABANDONING THE 15 -FOOT UTILITY EASEMENT CROSSING THE NORTHEAST PORTION OF A 20.054 ACRE TRACT OF LAND IN AND ADJACENT TO GULFWAY AIRLINE PARK, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, UPON DELIVERY TO THE CITY OF SUBSTITUTE EASEMENTS ACCORDING TO REPLAT OF THE AFORESAID TRACT OR PARCEL OF LAND; AND DECLARING AN EMERGENCY. WHEREAS, '1A CERTAIN 15 -FOOT UTILITY EASEMENT CROSSES THE NORTHEAST PORTION OF A 20.054 ACRE TRACT OF LAND IN AND ADJACENT TO GULFWAY AIRLINE PARK, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SAID TRACT OR PARCEL BEING DEVELOPED AND KNOWN AS HOUSING AUTHORITY SITE „A„ ON TREWAY LINE AND HOLLY ROAD; AND WHEREAS, THE OWNER OF THE PROPERTY HEREINABOVE MENTIONED HAS EXPRESSED A WILLINGNESS TO GRANT SUBSTITUTE EASEMENTS ACCORDING TO REPLAT OF THE AFORESAID TRACT OR PARCEL OF LAND; AND WHEREAS, THE CITY OF CORPUS CHRISTI IS AGREEABLE TO THE RELOCA- TION OF THE HEREINABOVE DESCRIBED EASEMENT: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THERE 'IS HEREBY ABANDONED THE FOLLOWING 15 -FOOT UTILITY EASEMENT,BEING THE NORTHERLY 7.5 -FOOT EASEMENT DEDICATED ON THE PLAT OF LOT 31, BLOCK 2, GULFWAY - AIRLINE PARK FILED IN VOL. 34, PAGE 51, MAP RECORDS OF NUECES COUNTY, TEXAS, AND THE SOUTHERLY 7.5 -FOOT EASEMENT BEING DEDICATED BY SEPARATE INSTRUMENT, FILE No. 769046, SAID EASEMENT TO BE ABANDONED, RELEASED AND RELINQUISHED BY THE CITY OF CORPUS CHRISTI UNTO THE PRESENT OWNERS, SUBJECT TO SUBSTITUTE EASEMENTS ACCORDING TO REPLAT OF THE AFORESAID TRACT OR PARCEL OF LAND, SAID REPLAT TO BE APPROVED BY THE PLANNING COMMISSION AND FILED OF RECORD IN THE COUNTY CLERK'S OFFICE. SECTION 2.
