HomeMy WebLinkAbout10324 ORD - 06/30/19711 r �-' 6- 30- 71:mv1 t AN ORDINANCE APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF $10,633.51 FOR REIMBURSEMENT TO THE DEVEL- OPER, NICHOLSON BUILDING SUPPLY COMPANY, INC., FOR ONE -HALF THE COST OF STREET IMPROVEMENTS AROUND THE PARK IN SURREY PLACE, UNIT 2, PROJECT NO. 220 -70 -123; AND DECLARING AN EMERGENCY. WHEREAS, by Ordinance No. 10,187, passed and approved by the City Council on March 24, 1971, the City entered into an agreement with Nicholson Building Supply, owner of Surrey Place Subdivision, under which agreement the owner obligated himself to construct an underground storm sewer when Unit 3 of Surrey Place Subdivision was developed and to perform such..other -obligations -as -- set - .forth in -the Agreement with the City to reim- burse the owner - developer to excess cost as result of the City's requiring oversize or overdepth storm sewer lines; and 'r S WHEREAS, the street improvements around the dedicated park in Surrey Place Unit 2 having been completed to the satisfaction of the City and the owner - developer having submitted a request for reimbursement, it is the finding of the City that such reimbursement is just and proper: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. There is hereby appropriated out of No. 220 Street Bond Fund the sum of $10,633.51 for reimbursement to the developer, Nicholson Building Supply Company, Inc., for one -half the cost of street improvements around the park in Surrey Place, Unit 2, being Project No. 220 -70 -123, and authorization is hereby given to reimburse the developer the amount hereby /ppropriated. ������/// SECTION 2. The necessity to reimburse the developer of the aforesaid subdivision and to make available the funds therefor creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having requested the suspension of the said Charter rule, and that this ordinance 103221 L be passed finally on the date of its introduction and take effect and be in full force and effect �� from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 16)4 'day of June, 1971.
