OSO DEVELOPMENT COMPANY FOR THE DEVELOPMENT OF THE COMMONLY CALLED'a'TRACT C°

OF THE CAYO DEL OSO, WHICH PROPOSAL AND PRELIMINARY PLAN ARE HEREBY FOUND

3. THAT THE CITY OF CORPUS CHRISTI WILLp IN CONCERT WITH THE
ACTUAL CONSTRUCTION IN SAID TRACT C PURSUANT TO SAID PLANS2 BUILD A SYSTEM
TO DIVERT EFFLUENT FROM THE OSO SEWAGE TREATMENT-PLANT TO A POINT AWAY
FROM THE PROJECT AND TERMINATED SO THAT CURRENT FLOW WILL NOT PASS IN
ANY MATERI'A'L VOLUME THROUGH THE PROJECT.
4. THAT THE CITY OF CORPUS CHRIST12 SUBJECT TO ITS APPROVAL
OF THE SAID PLANS, SHALL CAUSE TO BE INITIATED SUCH ZONING APPLICATIONS
AS MAY BE REQUIRED TO EFFECTUATE THE USES AND DEVELOPMENT PROJECTED BY v "'

`j. INASMUCH AS A CHANGE IN THE FORM OF ORGANIZATION OF OSO
DEVELOPMENT COMPANY IS TENTATIVELY PLANNED, IT IS THE SENSE OF.THE COUNCIL ,
THAT ALL BENEFITS CONFERRED HEREBY TO OSO DEVELOPMENT COMPANY SHALL INURE
TO ITS SUCCESSORS AND ASSIGNS, IF ANY, WITH THE APPROVAL OF THE CITY

6. IT IS FURTHER THE CONSENSUS OF THE COUNCIL THAT IF THAT
PARCEL OF CAYO DEL OSO COMMONLY CALLED "TRACT B" BECOMES AVAILABLE TO
THE CITY OF CORPUS CHRISTI BY ACT OF THE LEGISLATURE OF THE STATE OF `
TEXAS ON THE SAME, OR SUBSTANTIALLY THE SAME, TERMS AS APPLY TO "TRACT
C "2 AND SUCH AVAILABILITY OCCURS DURING THE DEVELOPMENT OF "TRACT C ",
THAT SUCH DEVELOPER SHALL BE AFFORDED THE FIRST OPPORTUNITY TO SUBMIT
PLANS TO THE CITY FOR DEVELOPMENT OF "TRACT B.°
• 7. IT IS FURTHER THE CONSENSUS OF THE COUNCIL THAT SHOULD Y

THE CITY OF CORPUS CHRISTI.

TION FROM THE-UNITED STATES CORPS OF ENGINEERS FOR THE CONDUCT OF DREDGING

THE OSO DEV. COMP., FORMED BY CHARLES KUHN, D.W. CAMPBELL AND T.J.
FOUTS, JR., DESIRES TO SUBMIT A PROPOSAL IN RESPONSE TO THE CITY OF
CORPUS CHRISTI'S INVITATION FOR A PROPOSAL TO DEVELOP THE CAYO DEL OSO.
WE WISH AT THIS TIME TO EXPRESS OUR SINCERE APPRECIATION TO THF; CITY
PLANNING AND TRAFFIC DEPARTMENTS AND TO CITY MANAGER, MARVIN TOWNSEND,
FOR THEIR INVALUABLE ASSISTANCE IN PROVIDING NEEDED DATA, TIMELY COOPERATION
AND UNTIRING EFFORTS DURING THE PAST YEAR. WE ALSO WISH TO COM MEND.SEN.

THE PROPONENTS AFFIRM THEY ARE READY TO PROCEED IMMEDIATELY AND THAT
THEY ARE FINANCIALLY CAPABLE TO IMPLEMENT A PROGRAM WHICH WILL DEVELOP
THE CAYO DEL OSO INTO A MODERN, WATER ORIENTED SUBDIVISION OF WHICH THE
CITY OF CORPUS CHRISTI AND ITS LEADERS MAY FEEL JUSTIFIABLY PROUD. IN
ADDITION, WE DESIRE TO UTILIZE LOCAL FINANCING, ENGINEERING AND CONSTRUCTION
FIRMS TO THE MAXIMUM EXTENT POSSIBLE. .Q
OUR PROPOSAL IS SUBMITTED HEREWITH. IT HAS BEEN CAREFULLY COMPARED WITH
THE CONTENTS OF YOUR INVITATION AND CONTAINS ONLY THOSE VARIATIONS REQUIRED
TO UPDATE THE STIPULATIONS THEREIN. YOUR AFFIRMATIVE RESPONSE IS THEREFORE

GENTLEMEN:
IN RESPONSE TO THE CITY COUNCIL OF CORPUS CHRISTIIS INVITATION FOR A PROPOSAL
TO ENTER INTO A CONTRACT FOR THE DEVELOPMENT OF THE CAYO DEL OSO, THE OSO
DEV. COMP., HEREIN RESPECTFULLY SUBMITS THE FOLLOWING PROPOSAL:
1. REQUEST OF STATE LEGISLATURE TO OE COMPLIED WITH:
A. THE FILLING OF THE LAND FOR THE FIRST SECTION OF THE DEVELOP-
MENT WILL BE ACCOMPLISHED AS SOON AS PRACTICABLE. EACH
ADDITIONAL SECTION WILL FOLLOW AS RAPIDLY AS FEASIBLE WITH
,r TOTAL DEVELOPMENT TIME ESTIMATED AT LESS THAN TEN (10)
YEARS.
13. SUCH IMPROVEMENTS SHALL CONSIST OF THE RAISING OR FILLING
OF THE AREA TO A HEIGHT OF AT LEAST THREE (3) FEET -ABOVE MEAN
HIGH TIDE EXCEPT THOSE PORTIONS USED FOR CHANNELS OR WATER-
WAYS. THE DEVELOPER WILL REQUIRE FINISH FLOOR ELEVATION
EIGHT AND ONE -HALF (8-1/2) FEET A13OVE U.S.G.S. DATUM.
C. PROVISION SHALL OE MADE FOR POSSIBLE DRILLING SITES IN
ACCORDANCE WITH THE PROVISIONS OF SAID LAW (ONE SITE FOR EACH
160 ACRES).
2. PLAN FOR DEVELOPMENT:
A PRELIMINARY PLAN IS SUBMITTED WITH THIS PROPOSAL, THE FINAL
PLAN WILL BE SUBJECT TO APPROVAL BY THE CITY.

3. BRIDGE AT OCEAN DRIVE:
THE DEVELOPER WILL BE PROVIDED WITH PARTICIPATION IN THE AMOUNT OF
500,000.00 BY THE CITY OF CORPUS CHRISTI IN THE CONSTRUCTION OF
A VEHICULAR BRIDGE AND REALIGNMENT OF ROADWAY FOR'OCEAN DRIVE
OVER THE ENTRANCE CHANNEL. THE DEVELOPER WILL ASSUME ALL ADDI-
TIONAL COST NECESSARY FOR CONSTRUCTION OF AN ENTRANCE CHANNEL
FROM C.C. BAY AND SAID BRIDGE OVER SAID CHANNEL INCLUDING AP-
PROACHES AND ROADWAY AT LEAST 44 FEET IN WIDTH.
4. WATER ARF_AS:
A. THE CHANNELS AND OTHER PERMANENT WATER AREAS SHALL BE SO
LAID OUT AS TO PROVIDE FOR PROPER CIRCULATION AND TO AVOID
"DEAD WATER ". THE WIDTH OF THE CHANNELS SHALL BE APPROVED
BY THE CITY AND THE MINIMUM DEPTH OF THE CHANNELS AT THE
EFFECTIVE WIDTH (TOE TO BERM TO TOE OF BERM) SHALL BE AS
FOLLOWS:
1. MAIN ENTRANCE CHANNEL - 12 FEET
2. PRIMARY CHANNEL - 10 FEET
3. SECONDARY CHANNELS - 7.5 FEET '
BULKHEADING OR STABILIZATION OF THE BANKS SHALL BE PROVIDED
IN ACCORDANCE WITH THE APPROVED FINAL PLAN.
B. A WATER AREA OF A SIZE, SHAPE AND LOCATION AS DETERMINED
BY THE PLAN AND APPROVED BY THE CITY, AS WELL AS TIIE CHANNELS,
SHALL BE DEDICATED FOR PUBLIC USE WITH ADEQUATE ACCESS THERE-
TO FOR BATHING, SWIMMING, BOATING AND WATER SPORTS. ,
C. RATIO OF WATER TO LAND SHALL NOT EXCEED 500, I.E., THE
WATER SHALL NOT CONSTITUTE MORE THAN 50%. OF THE PROJECT
AREA.
S. RIGHTS -OF -WAY:
THE CITY WILL PROVIDE NECESSARY RIGHT -OF -WAY FROM PUBLIC LAND
TO THE PROPERTY IF THE APPROVED PLAN OR PLAT DETERMINES SUCH
RIGHTS -OF -WAY TO BE NECESSARY FOR THE PROPER DEVELOPMENT OF
THE PROPERTY.

6. WARRANTY DEED: "
THE CITY WILL DELIVER A SPECIAL WARRANTY DEED ON AREAS WHERE
WORK HAS BEEN COMPLETED IN ACCORDANCE WITH THE PROVISIONS OF
THE STATE LEGISLATION IN INCREMENTS OF FORTY (AO) ACRES OF
LAND OR MORE,
7. CITY COOPERATION:
ALL INFORMATION, MAPS, PLATS AND OTHCR DATA IN POSSESSION OF
THE CITY WILL BE MADE AVAILABLE TO THE DEVELOPER AND THE
CITY PLEDGES ITSELF TO COOPERATE IN THE CONSUMMATION OF THIS
DEVELOPMENT. SHOULD DEVELOPMENT EXTEND BEYOND JULY, 1977
(PATENT EXPIRATION). THE CITY WILL PETITION THE STATE OF TEXAS
FOR A 6 YEAR PATENT EXTENSION TO ALLOW COMPLETION. THE CITY
GRANTS TO THE DEVELOPER FIRST REFUSAL ON TRACT "Bn SHOULD IT
BECOME AVAILABLE DUR114G THE DEVELOPMENT OF TRACT 11C11.
H. SEWAGE EFFLUENT:
i THE CITY WILL DIVERT EFFLUENT FROM THE OSO SEWAGE TREATMENT
PLANT TO A POINT OTHER THAN OSO BAY.
9. ALL RIGHTS AND PRIVILEGES HEREUNDER SHALL INURE TO THE BENEFIT
OF OSO DEVELOPMENT COMPANY, ITS SUCCESSORS AND ASSIGNS.
