AN ORDINANCE
AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED,
BY THE REPEAL OF CHAPTER 2, ARTICLE III, OFFICE OF ADMINIS-
TRATIVE MANAGEMENT, SECTIONS 2 -21 THROUGH 2 -28, AND THE
ENACTMENT OF A NEW CHAPTER 2, ARTICLE III, CITY MANAGER
SUCCESSION; DESIGNATING THE ASSISTANT CITY MANAGER, CITY
OF CORPUS CHRISTI, TO ACT AS CITY MANAGER IN CASES OF
ABSENCE, DISABILITY, OR DEATH OF THE CITY MANAGER; PRO-
VIDING SEVERABILITY; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED,
CHAPTER 2, ARTICLE 111, OFFICE OF ADMINISTRATIVE MANAGEMENT, SECTIONS 2 -21
THROUGH 2 -28, BE HEREBY REPEALED.
SECTION 2. THAT THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED,
IS HEREBY AMENDED IN CHAPTER 2 THEREOF AS FOLLOWS:
"ARTICLE III. CITY MANAGER SUCCESSION.
IN CASES OF ABSENCE, DISABILITY OR DEATH OF THE CITY MANAGER OF
CORPUS CHRISTI, THE ASSISTANT CITY MANAGER IS HEREBY EMPOWERED AND DESIG-
NATED TO ACT AND SERVE AS THE CITY MANAGER SO LONG AS SUCH ABSENCE OR
DISABILITY CONTINUES OR UNTIL THE APPOINTMENT AND QUALIFICATION OF THE
SUCCESSOR TO THE OFFICE, AS THE CASE MAY BE; PROVIDED, HOWEVER, THE CITY
COUNCIL MAY BY ORDINANCE EMPOWER AND DESIGNATE SOME PERSON OTHER THAN THE
ASSISTANT CITY MANAGER TO TEMPORARILY ACT AND SERVE AS CITY MANAGER.
ALL QUESTIONS AS TO THE OCCURRENCE AND CONTINUANCE OF THE CITY
MANAGER'S ABSENCE OR DISABILITY, AS WELL AS THE FACT OF HIS DEATH, SHALL
BE DETERMINABLE BY THE CITY COUNCIL AND ITS DECISION SHALL BE FINAL."
SECTION 3. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION,
CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID BY
FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION, IT SHALL NOT AFFECT
ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS
CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE.
SECTION 4. THE NECESSITY TO AMEND THE CORPUS CHRISTI CITY CODE
IN ORDER TO MAKE PROVISION FOR DESIGNATION OF THE ASSISTANT CITY MANAGER
TO ACT AS CITY MANAGER UNDER CIRCUMSTANCES HEREINABOVE OUTLINED CREATES A
PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIR NG THE SUSPEN-
SION OF THE CHARTER RULE THAT NO ORDINANCE OR RE$OLUTIONHALL BE PASSED

FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLU-
TION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE
MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING
REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN
FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO
ORDAINED, THIS THE-11/1&t DAY OF , 1971•

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
