AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE THE DOCUMENTS
NECESSARY FOR THE ACQUISITION OF PARCELS 3 AND 5, AND
PARCELS 25 THROUGH 39, SOUTH STAPLES STREET PROJECT;
APPROPRIATING FROM 220 STREET BOND FUND $40,000 FOR
SAID PURCHASES, APPLICABLE TO PROJECT 220 -70 -107; AND
DECLARING AN EMERGENCY.
WHEREAS, IT IS NECESSARY TO ACQUIRE FOR AND ON BEHALF OF THE CITY
OF CORPUS CHRISTI, CERTAIN PARCELS OF LAND FOR PROJECT N0. 220 -70 -107, SOUTH
STAPLES STREET PROJECT, AND IT 15 NECESSARY THAT NEGOTIATIONS BE HAD WITH
CERTAIN PROPERTY W NERS FOR THE ACQUISITION OF SAID LAND BY ENTERING INTO
PURCHASE CONTRACTS, AND IT IS NECESSARY TO AUTHORIZE THE SAID NEGOTIATIONS
AND PURCHASE CONTRACTS BY THE CITY AND PROVIDE SUFFICIENT FUNDS FOR SAID
LAND PURCHASES:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
TO EXECUTE ANY AND ALL DOCUMENTS NECESSARY FOR THE ACQUISITION OF PARCELS
3 AND 5, AND PARCELS 25 THROUGH 39 OF THE SOUTH STAPLES STREET PROJECT,
PROJECT NO. 220 -70 -107, AS SHOWN ON THE LIST OF OWNERS ATTACHED HERETO AND
MADE A PART HEREOF.
SECTION 2. THAT THERE IS HEREBY APPROPRIATED FROM NO. 220 STREET
BOND FUND $40,000 FOR THE ACQUISITION OF SAID PARCELS OF LAND.
SECTION 3. THAT THE NECESSITY TO ACQUIRE THE ABOVE LISTED PARCELS
OF LAND, SO THAT WORK MAY PROCEED AT AN ORDERLY PACE ON THE SUBJECT PROJECT,
CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE
SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND
THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING
REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN
FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO
ORDAINED, THIS THE 414-1DAY OF JULY, 1971.
