AN ORDINANCE
DECLARING THE ABANDONMENT OF BID PROPOSAL OF MANSON
INDUSTRIES FOR HURRICANE CELIA DAMAGE REPAIRS TO
MEMORIAL COLISEUM FOR FAILURE TO EXECUTE THE CONTRACT
AND FURNISH THE REQUIRED BONDS; ANNULLING THE AWARD
OF SAID CONTRACT AS AUTHORIZED BY ORDINANCE NO. 10314,
AND DECLARING FORFEITURE BY MANSON INDUSTRIES OF BID
SECURITY IN THE AMOUNT OF $1,500, ALL AS SPECIFIED IN
SECTION B -2 -8, AS AMENDED, AND SECTION B -3 -6 OF THE
SPECIFICATIONS APPROVED BY ACTION OF THE CORPUS CHRISTI
CITY COUNCIL OF MAY 5, 1971; AUTHORIZING THE CITY MANAGER
TO EXECUTE A CONTRACT IN THE AMOUNT OF $49,743.50 IN
FAVOR OF THE SECOND LOW BIDDER, ROOFCRAFT, INCORPORATED,
FOR SAID REPAIRS; APPROPRIATING $7,5+5& 90 OUT OF NO. 102 e
GENERAL FUND, ACTIVITY 4298, CODE 502, TO SUPPLEMENT
FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 10314;
AND DECLARING AN EMERGENCY.
WHEREAS, BY ORDINANCE N0. 10314, THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI DID, ON JUNE 23, 1971, AUTHORIZE THE EXECUTION OF A CONTRACT
WITH MANSON INDUSTRIES FOR HURRICANE CELIA DAMAGE REPAIRS TO MEMORIAL
COLISEUM; AND
WHEREAS, MANSON INDUSTRIES HAS FAILED TO EXECUTE A CONTRACT WITH-
IN THE PRESCRIBED TIME AND FURNISHTHE REQUIRED BONDS; AND
WHEREAS, ROOFCRAFT, INCORPORATED, SUBMITTED THE SECOND LOW BID
FOR SAID HURRICANE CELIA DAMAGE REPAIRS TO MEMORIAL COLISEUM:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE BID PROPOSAL BY MANSON INDUSTRIES FOR
HURRICANE CELIA DAMAGE REPAIRS TO MEMORIAL COLISEUM IS HEREBY DECLARED
ABANDONED BY REASON OF THE FAILURE OF MANSON INDUSTRIES TO EXECUTE THE
CONTRACT WITHIN THE PRESCRIBED TIME AND FURNISH THE REQUIRED BONDS. THAT
FURTHER, THE CONTRACT AS AUTHORIZED BY ORDINANCE N0. 10314 IS HEREBY DECLARED
ANNULLED, AND FORFEITURE OF BID SECURITY IN THE AMOUNT OF $1,500 IS HEREBY
DECLARED, ALL AS SPECIFIED IN SECTION B -2 -8, AS AMENDED, AND SECTION B -3 -6
OF THE SPECIFICATIONS APPROVED BY ACTION OF THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI ON MAY 5, 1971.
SECTION 2. THAT THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI
SE, AND HE IS HEREBY, AUTHORIZED TO EXECUTE A CONTRACT IN THE AMOUNT OF
$49,743.50 WITH THE SECOND LOW BIDDER, ROOFCRAFT, INCORPORATED, FOR
HURRICANE CELIA DAMAGE REPAIRS TO MEMORIAL COLISEUM, ALL AS IS MORE FULLY

DESCRIBED IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE
IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF
BY REFERENCE AND ACCORDING TO THE BID OF ROOFCRAFT, INCORPORATED, OPENED ON
THE 26TH DAY OF MAY, 1971, SAID BID OF ROOFCRAFT, INCORPORATED, BEING THE
SECOND LOW BID SUBMITTED.
SECTION 3. THAT THERE IS HEREBY APPROPRIATED $7,553.90 OUT OF
N0. 102 GENERAL FUND, ACTIVITY 4298, CODE '5102, TO SUPPLEMENT FUNDS PRE-
VIOUSLY APPROPRIATED BY ORDINANCE NO. 10314.
SECTION 4. THE NECESSITY TO EXECUTE THE AFORESAID CONTRACT AT
THE EARLIEST POSSIBLE DATE SO THAT REPAIRS TO MEMORIAL COLISEUM MAY BE
COMMENCED AS SOON AS POSSIBLE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI-
NANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEET-
INGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND
NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE
AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,
IT IS ACCORDINGLY SO ORDAINED, THIS THE I-V.o.71DAY OF JULY, 1971.

RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
