HomeMy WebLinkAbout10383 ORD - 07/28/1971BjW:7 /28/71 AN ORDINANCE AMENDING CHAPTER 35, TAXATION AND LICENSING OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED BY ORDINANCE NO. 5613, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 11TH DAY OF DECEMBER, 1951, BY AMEND- ING SECTION 35 -1 SO AS TO PROVIDE FOR A CHARGE OF $2.00 FOR EACH TAX CERTIFICATE ISSUED BY THE TAX ASSESSOR - COLLECTOR OF THE CITY; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICA- TION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT CHAPTER 35, TAXATION AND LICENSING, SECTION 35 -1 OF THE CORPUS CHRISTI CITY CODE, 19581 AS AMENDED BY ORDINANCE N0. 5613, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 11TH DAY OF DECEMBER 1959, BE, AND THE SAME IS HEREBY, AMENDED TO HEREAFTER READ AS FOLLOWS: "SECTION 35 -1. CHARGE FOR TAX CERTIFICATES. THE TAX ASSESSOR - COLLECTOR OF THE CITY SHALL CHARGE $2.00 FOR EACH TAX CERTIFICATE ISSUED BY HIS OFFICE. SUCH SUM SHALL BE DI'POSITED IN THE GENERAL FUND OF THE CITY." SECTION 2. THAT THE SUMS COLLECTED FROM THE ISSUANCE OF TAX CERTIFICATES, AS PROVIDED IN THE PRECEDING SECTION, SHALL BE TAKEN INTO ACCOUNT EACH MONTH AS AN OFFSET AGAINST THE EXPENSES OF THE OPERATION OF THE OFFICE OF TAX ASSESSOR- COLLECTOR UNDER THE TERMS OF CONTRACTS WHICH THE CITY HAS WITH THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT, CORPUS CHRISTI JUNIOR COLLEGE DISTRICT, AND LOWER NUECES RIVER WATER SUPPLY DISTRICT FOR THE COLLECTION OF TAXES. SECTION 3. ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH SHALL BE AND ARE HEREBY REPEALED. SECTION 4. PUBLICATION SHALL BE MADE IN THE OFFICIAL PUBLICA- TION OF THE CITY OF CORPUS CHRISTI, ONE TIME, WHICH PUBLICATION SHALL CON- TAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE. SECTION 5. THE NECESSITY FOR FIXING A CHARGE SUFFICIENT TO COVER THE COST OF RENDERING THE SERVICE NECESSARY TO ISSUE TAX CERTIFICATES CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE iIn�83 • PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THEI-1-9pAY OF 1971.
