HomeMy WebLinkAbout10401 ORD - 08/04/1971JKH:8 -4 -71 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH THE BISHOP CONSOLIDATED INDEPENDENT SCHOOL DISTRICT FOR THE LEASING BY THE CITY OF CORPUS CHRISTI OF A SCHOOL BUS FOR THE PERIOD OF JULY 26, 1971 THROUGH AUGUST 20, 1971, ALL AS MORE FULLY SET FORTH IN THE CONTRACT, A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "A ", AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED TO ENTER INTO A CONTRACT WITH THE BISHOP CONSOLIDATED INDEPENDENT SCHOOL DISTRICT FOR THE LEASING BY THE CITY OF CORPUS CHRISTI OF A SCHOOL BUS FOR THE PERIOD OF JULY 26, 1971 THROUGH AUGUST 20, 1971, ALL AS MORE FULLY SET FORTH IN THE CONTRACT, A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "A ", AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO ENTER INTO THE AFORESAID CONTRACT AT THE EARLIEST PRACTICABLE DATE IN ORDER THAT THE SCHOOL BUS MAY BE USED IN THE CITY OF CORPUS CHRISTI FOR THE PURPOSE OF TRANSPORTING CHILDREN IN CONNECTION WITH THE CITY'S RECREATION PROGRAM CREATES A PUBLIC EMER- GENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE�DAY OF AUGUST, 1971. That District will lease to City a 1957 Chevrolet, sixty -six (66) passenger school bus, Identification No. 8F57W107863, Texas 1971 Registration No. XJ7193• r 2. The term of this lease shall be from July 26, 1971 s thru 12:00 o'clock midnight, August 20, 1971. V 3. The leased vehicle shall be used for the purpose of transporting children. 4• City shall pay the sum of Thirty Cents (:x.30) per mile. City accepts the bus on an "as is" basis. 7• City agrees to indemnify and forever hold harmless District against each and every claim, demand or cause of action that may be made or come against District by reason of or in any way arising out of the lease and.use of said vehicle. 8.
