HomeMy WebLinkAbout10404 ORD - 08/04/1971e/4/71:e • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565,_ ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF M. HARVEY WEIL, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A 1.61 -ACRE TRACT OF LAND OUT OF SHARE IV OF THE McBRIDE PARTITION SITUATED IN THE CITY OF CORPUS CHRISTI, FROM "8 -4" GENERAL BUSINESS DISTRICT TO "I -2" LIGHT INDUSTRIAL DISTRICT, ALL AS IS MORE FULLY HEREINBELOW SET OUT AND AS SHOWN ON THE PLAT ATTACHED HERETO, MARKED EXHIBIT "A ", AND MADE A PART HEREOF; KEEPING IN EFFECT ALL OTHER PRO- VISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION OF M. Harvey Weil FOR AMENDMENT _TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THL CITY CUUNCIL.UF THE CIIY Of CURPUS CHRISTI, IN ACCORDANCE WI1H PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON July 26, 1971 , AT Special COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS C14RISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF - RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE OR AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE N0. 61o6, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. 1i�S24J`� 0 .- - . . . . 0 SECTION 2. That the zoning on a 1.61 -acre tract of land out of Share IV, of the McBride Partition, in the City of Corpus Christi, Nueces County, Texas, and described as follows: Beginning at a point in the westerly R.O.W. line of Lexington Boulevard, a 120' Street, said point bearing south 490 -20' W, 120 feet from the most southwesterly corner of Lot 27 -1), Ebony Acres. THENCE: S 490 -20' W, a distance of approximately 429.00 feet to the common line between Share III and Share IV of the McBride Partition. THENCE: North approximately 368.3 feet with the common line between Share III and Share IV of the McBride. Partition and its northerly projection to a point in the north line of a Central Power and Light Company easement,being also the south line of Ebony Acres. THENCE: With said north line of a Central Power and Light Company easement and south line of Ebony Acres S 88 -33' W, 254.8 feet to a point in the westerly R.O.W. line of Lexington Boulevard. THENCE: With said westerly line of Lexington Boulevard S 400 -40' E, 108.5 feet to the place of beginning, said tract containing 1.61 acres of land , more or less. be and the same is hereby changed from "B -4" General Business District, to "I -2" Light Industrial District, as shown on the plat attached hereto, marked Exhibit "A", and made a part hereof. The tract of land herein rezoned is located near the intersection -of Lexington Boulevard and Highway 9. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION 14. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF -CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS AMENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC,NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE - EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT•IS ACCORDINGLY SO ORDAINED, THIS THE PAY OF_ ATTES co z s C Tf SECRET Y MAYOR APPROVED: .
