HomeMy WebLinkAbout10407 ORD - 08/11/1971HG: JKH:U -9 -71 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN EXTENSION OF THE AGREEMENT BETWEEN THE CO'STIUNITY DEVELOPMENT CORPORATION OF CORPUS CHRISTI AND THE CITY OF CORPUS CHRISTI FOR THE PURPOSE OF COORDINATION OF CITYWIDE EFFORTS TO FURNISH ADEQUATE AND PERMANENT HOUSING FOR LOW- AND MODERATE - INCOME FAMILIES, ALL AS MORE FULLY SET FORTH IN THE EXTENSION AGREEMENT,.A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "A ", AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, AN EXTENSION OF THE AGREEMENT ENTERED ON NOVEMBER 12, 1970 BETWEEN THE CITY AND COMMUNITY DEVELOPMENT CORPORATION OF CORPUS CHRISTI, A NONPROFIT CORPORATION, FOR THE PURPOSE OF COORDINATION OF CITYWIDE EFFORTS TO FURNISH ADEQUATE AND PERMANENT HOUSING FOR LOW- AND MODERATE - INCOME FAMILIES, AS MORE FULLY SET FORTH IN THE EXTENSION AGREEMENT, A COPY OF WHICH 15 ATTACHED HERETO, MARKED EXHIBIT "A ", AND MACE A PART HEREOF. SECTION 2. THE NECESSITY TOIMMEDIATELY EXTEND THE AFORESAID AGREEMENT IN ORDER TO PROMOTE THE PUBLIC WELFARE, THE PUBLIC HEALTH, AND THE PUBLIC SAFETY IN THE FIELD OF HOUSING FOR LOW- AND MODERATE- INCOME FAMILIES CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLU- TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AN: THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE //V/I)DAY OF AUGUST, 1971. ATTES J O CITY SECRE AR ` MAYOR APPR VED: THE CITY OF IORPRISTI, TEXAS AY OF AUGU T, 1971: �5 1- CITY ATTORN JL040'7 • EXTENSION AGREEMENT THE STATE OF TEXAS d COUNTY OF NUECES a WHEREAS, THE CITY OF CORPUS CHRISTI, A MUNICIPAL CORPORATION AND BODY POLITIC OF THE STATE OF TEXAS, HEREINAFTER CALLED CITY, AND THE COMMUNITY DEVELOPMENT CORPORATION OF CORPUS CHRISTI, A NONPROFIT CORPORATION UNDER THE LAWS OF THE STATE OF TEXAS, HEREINAFTER CALLED CDC, ENTERED INTO AN AGREEMENT ON NOVEMBER 12, 1970 FOR THE COORDINATION OF CITYWIDE EFFORTS TO FURNISH ADEQUATE AND PERMANENT HOUSING FOR LOW- AND MODERATE - INCOME FAMILIES; AND WEREAS, SAID AGREEMENT EXPIRED ON JULY 31, 1971; AND WHEREAS, THERE IS STILL A NEED FOR SUCH PROGRAM AND THE ENTIRE AMOUNT OF MONEY BUDGETED HAS NOT BEEN EXPENDED: NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE UNDERTAKINGS HEREINAFTER SET FORTH: WITNESSETH: TiiE ENTERED INTO BY AND DETWEEN THE CITY" AND CDC ON NOVEMBER 12, 1970 AND WHICH EXPIRED ON JULY 31, 1971 IS HEREBY RENEWED AND EXTENDED FOR A PERIOD OF THREE (3) MONTHS, SUCH PERIOD BEGINNING AUGUST 1, 1971 AND ENDING OCTOBER 311 1971• II THE CONSIDERA TION FOR THIS RENEWAL AND EXTENSION IS THE UNEXPENDED BUDGETED FUNDS IN THE AFORESAID AGREEMENT AND CDC WILL MAKE REQUESTS FOR PAYMENT AS PROVIDED IN SAID AGREEMENT WHICH IS INCORPORATED HEREIN THE SAME IS IF COPIED VERBATIM HEREINIAND RENEWED AND EXTENDED IN ACCORDANCE WITH THE TERMS OF THIS EXTENSION AND SAID AGREEMENT SHALL BE IN FULL FORCE AND EFFECT.
