AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH BATH AND ASSOCIATES FOR CONSULTING ENGINEERING
SERVICES\ FOR INSTALLATION OF EMERGENCY POWER FACILITIES
AT CORPUS'�CHRISTI INTERNATIONAL AIRPORT, AS MORE FULLY
SET FORTH IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED
HERETO, MARKED EXHIBIT "A "t AND MADE A PART HEREOF;
APPROPRIATING OUT OF NO. 245 AIRPORT BOND FUND THE SUM
OF $8000 FOR THE AFORESAID SERVICES, APPLICABLE TO
PROJECT NO. 245-68-13; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THE CITY MANAGER-BE AND HE IS HEREBY AUTHORIZED
TO EXECUTE ANAGREEMENT WITH BATH & ASSOCIATES FOR CONSULTING ENGINEERING
SERVICES FOR INSTALLATION OF EMERGENCY STAND -IN POWER AT THE CORPUS CHRISTI
INTERNATIONAL AIRPORT, AS MORE FULLY SET FORTH IN THE AGREEMENT, ATTACHED
HERETO AND MADE A PART HEREOF, AND MARKED EXHIBIT "A ".
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 245 AIRPORT
BOND FUND THE SUM OF $8000 FOR THE AFORESAID SERVICES, APPLICABLE TO
PROJECT No. 245 °68-13.
SECTION 3. THE NECESSITY TO AUTHORIZE THE AFORESAID AGREEMENT
AND TO PROVIDE THE NECESSARY FUNDS THEREFOR IN ORDER THAT THE ENGINEERING
SERVICES MAY BE COMMENCED WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND AN
IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE
THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT
THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED
SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION
OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE
DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT
FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE
DAY OF AUGUST, 1971.

THIS AGREEMENT, made and entered into this day of
1971, by and between the CITY OF CORPUS CHRISTI, TEXAS, a municipal
corporation, acting herein by and through its City Manager, duly authorized to act,
hereinafter called the "City ", and Bath & Associates, Consulting Engineers, of
Corpus Christi, Texas, hereinafter called the "Engineer ".
W I T N E S S E T H:
THAT WHEREAS, the City intends to install two emergency generators at the
Corpus Christi International Airport in the City of Corpus Christi, Texas and that
the scope of said installation shall include but na be limited to the following:
(1) Perform necessary field work to determine the electrical loads.
(2) Install two emergency generators to serve the following loads:
(two 125 KVA generators will be furnished by the City.)
(a) Tower Lighting.
(b) Communications and Rader Facilities.
(c) Runway Lighting.
(d) Terminal Emergency Lighting.
(e) Teletype Facilities.
(f) Air Conditioning of the Tower Building.
(3) Provide building for installation of emergency generators.
(4) Provide control panels, fuel systems, automatic transfer scheme, in
accordance with F.A.A. requirements, and cooling system for the genera-
tors.
(5) Check the power methods - either diesel or natural gas.
AND WHEREAS, in connection with the above listed scope of work in the Inter-
national Airport the City employs the said Engineer and said City and Engineer
agree as follows:

I.
Phase I - Preliminary Phase
The
Engineer agrees to do the following work related to the installation of
generators:
(1)
Review the project with appropriate agency or agencies of the City
(2)
Coun�� with the City agency or agencies about- the general plan and
scope of improvements
(3)
Prepare preliminary schematics
(4)
Develop preliminary floor plans of Generator Housing Building
(5)
Assist in making the necessary application to F.A.A. in connection with
grant application on the project
(6)
Prepare preliminary cost estimates for the project and submit said es-
timates to the City.
II.
Phase II - Detailed Plans and Specification Phase
After
the City has determined and approved the scope of the work to be per-
formed
and
after such scope has also been approved by Federal Agency where grant
application
has been made, then the Engineer will be authorized to proceed with
Phase
II of
project and the Engineer then agrees to perform the following work:
(1)
Prepare from approved preliminary designs the detailed plans and speci-
fications.
(2)
Develop working drawings of building to large scale.
(3)
Make necessary field surveys required for drawing plans and specifica-
tions.
(4)
Prepare large scale working drawing for structural, mechanical, elect-
rical, plumbing, heating, and ventilating systems, air conditioning, etc.
(5)
Submit large scale drawing and system to City for approval.
(6)
Re- evaluate and adjust the estimate of probable construction cost, if
required.
(7)
Confer with City and appropriate Federal agencies regarding detailed
plan.
(8)
The Engineer will make an evaluation of gas powered generator as well as
diesel to the City and in no event shall plans be approved without this
evaluation.

(9) Prepare necessary bidding information and contract documents in accor-
dance with City established procedure
(10) Assist City in filing proper documents and securing necessary approvals
of government or other agencies on the project
(11) Provide City with five (5) copies of approved plans and thirty-five
(35) copies of specifications for the project.
(12) Assist City in securing bids based upon construction documents
(13) Assist the City in evaluating proposals and awarding contracts
(14) Prepare final contract documents after award of contract for the review
and approval of City.
III. Construction Administration Phase
(1) Provide construction administration as set forth in General Provisions
of contract
(2) Make periodic visits to the job site to determine whether work is pro-
ceeding in accordance with the contract document.
(3) Review shop drawing submitted by contractor for the project and re-
commend approval to City
(4) Review laboraLory repurL's, if required
(5) Interpret construction documents if needed to the contractor
(6) Prepare monthly construction estimate and submit to the City for pay-
ment.
(7) Prepare change orders on the project and submit to City and contractor
fo for approval
(8) Deliver to the City all certificates of inspecting authorities, equip-
ment operating manuals, bonds, guarantees, and related documents.
(9) Make final inspection on project with appropriate City officials and
make recommendation for acceptance
(10) Deliver to the City "As Built" Construction Drawing upon completion of
project in original reproducible form.
Fee Basis
The fee of the Engineer will be based on an hourly rate as follows:
(a) $15. /hr. for engineering
(b) $8. /hr. for drafting
Since the work is of alteration type, the fee will not'exceed the recommended
fee by "Texas Society of Professional Engineers" for class of work involved and in
no event will exceed $8,000.00. The fee will be adjusted accordingly after the final
construction of the project is completed.
Payment
For and in consideration of the services listed above the City agrees to pay
the Engineer on the following basis:
(1) Upon completion of all work indicated in Phase I (Preliminary Design
Phase) and upon review and approval of such work by the City, the City
will pay the Engineer 20% of estimated fee of $8,000.00
(2) Upon award of contract and completion of Phase II the City will pay
Engineer 507 of basic estimated fee or as 'adjusted after award.
(3) Upon completion of construction of project, Phase III, the City will
pay Engineer 30% of basic fee and will also make proper adjustments to
the fee based on final construction cost.
SCHEDULING OF'WORK
Engineer agrees to complete work in accordance with the following time table:
(1) Phase I (Preliminary Work): All preliminary work shall be completed
and preliminary report submitted to the City within 45 days from the
date of written authorization by the City.
(2) Phase II: All design and detailed specifications shall be completed
within 60 days from the date of written authorization by the City.'
TERMINATION OF CONTRACT
The City shall have the option of terminating this contract at any time and
the fees of Engineer shall be the fees due for such stage or stages as are completed.

for the contract, agreement, obligation or expenditures contemplated in the
above and foregoing ordinance is in the Treasury of the City of Corpus Christi

NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
