HomeMy WebLinkAbout10422 ORD - 08/18/19718 /11 /71:RG:e AN ORDINANCE AMENDING CHAPTER 19 -B, HUMAN RELATIONS, OF THE CODE OF THE CITY OF CORPUS CHRISTI, TEXAS, 1958, AS AMENDED, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 9410 PASSED AND APPROVED BY THE CITY COUNCIL ON JULY 2, 1969, AND AS AMENDED BY ORDINANCE NO. 9551, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 12TH DAY OF NOVEMBER, 1969, BY AMENDING SECTION 19 -B -8 THEREOF TO INCREASE THE MEMBERSHIP OF THE HUMAN RELATIONS COMMISSION FROM NINE (9) MEMBERS TO TEN (10) MEMBERS BY INCLUDING THE EXECUTIVE DIRECTOR OR A MEMBER OF THE STAFF OF THE LEGAL AID SOCIETY; AND BY AMENDING SECTION 19 -B -12 THEREOF TO AUTHORIZE THE COMMISSION CHAIRMAN, WITH THE ADVICE AND CONSENT OF THE COMMISSION, TO CALL UPON INDIVIDUALS FROM THROUGHOUT THE COMMUNITY TO ASSIST THE COMMISSION OR ITS COMMITTEES IN THE INVESTIGATION OF ANY MATTER BEING CONSIDERED BY THE COMMISSION; PRO- VIDING FOR PUBLICATION; PROVIDING A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 19 -B, Human Relations, of the Code of the City of Corpus Christi, 1958, as amended, and particularly as amended by Ordinance No. 9410, passed and approved by the City Council of the City of Corpus Christi on July 2, 1969, be and the same is hereby amended by amending Section 19 -B -8, as amended by Section 2 of the said Ordinance No. 9410, to read as follows: "There is hereby established a commission advisory to the City Council to be known as the Corpus Christi Human Relations Commission. Said Commission shall consist of nine (9) members appointed by the Mayor with the approval of the City Council. The members shall be broadly representative of the total community, drawn from various racial, religious and ethnic groups. The Commission shall also have as a tenth member the director of the Nueces County Legal Aid Society or a member of his staff designated to represent him. "The members of the Commission shall serve without compensation. Members of such Commission shall serve staggered terms of three (3) years. Initial appointment of three (3) of the members shall be for one (1) year, three (3) of the members 10 422 for two (2) years, and three (3) of the members for three (3) years. All terms shall begin on the anniversary date of the adoption of this Ordinance, but each member shall serve until a successor is appointed. The tenth member, the representative from the Nueces County Legal Aid Society, shall serve contin- uously and shall not be subject to the appointment required under this Section." SECTION 2. That Chapter 19 -B, Human Relations, of the Code of the City of Corpus Christi, 1958, as amended, and par- ticularly as amended by Ordinance No. 9551, passed and approved by the City Council of the City of Corpus Christi on the 12th day of November, 1969, be and the same is hereby amended by adding the following sentence at the end of Section 19 -B -12, as amended, and particularly as amended by Section 2 of said Ordinance No. 9551, to read as follows: "Said Commission Chairman, with the advice and consent of the Commission, may call upon individuals from throughout the community to assist the Commission or its committees in the in- vestigation of any matter being considered by the Commission." SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi, by publish- ing the caption of this Ordinance, stating in substance the purpose of the ordinance. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, or provision of this Ordinance shall be held invalid by final judgment of a court of competent jurisdiction, it shall not affect any valid provisions of this or any other ordinance of the City of Corpus Christi to which these rules and regulations relate. SECTION 5. All ordinances or parts of ordinances in conflict herewith shall be and are hereby repealed to the extent of conflict herewith. -2- • - • SECTION 6. The necessity of adding a tenth member to the Human Relations Commission and the necessity to appoint non - Commission members to Human Relation Commission committees creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordi- nance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage and publication, IT IS ACCORDINGLY SO ORDAINED, this the led day of August, 1971.
