AN ORDINANCE
CLOSING TO VEHICULAR TRAFFIC THAT ALLEY WHICH
RUNS PARALLEL TO AND LIES BETWEEN KENNEDY STREET
AND PEABODY STREET IN HILLCREST ADDITION, AS IT
EXISTS FROM WEST BROADWAY TO MINTON STREET, SO
THAT SAID ALLEY WILL BECOME A PART OF THE PARK
WHICH IT ADJOINS; SAID ALLEY WILL REMAIN IN USE
FOR-�PEDESTRIAN TRAFFIC AND UTILITY RIGHT OF WAY;
AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a
hearing concerning the closing to vehicular traffic of that
certain alley which runs parallel to and lies between Kennedy
Street and Peabody Street in Hillcrest Addition, as it exists
from West Broadway to Minton Street, was given by publication
and registered mail to the last known addresses of the owners
of property abutting said alley and within 450 feet of the area
to be closed, and thereafter, pursuant to said notice, public
hearing was held at Regular Council Meeting of the City Council
of the City of Corpus Christi on Wednesday, June 16, 1971, in
accordance with the provisions of the City Charter; and
WHEREAS, it was determined by the City Council that
this alley is not now needed for vehicular traffic, nor will it
be needed for such within the foreseeable future; and
WHEREAS, it has been determined that it is to the
advantage of the City to close to vehicular traffic that portion
of the alley described above, so that same may be used as a part
of the adjoining park and for utility right of way:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That that portion of an alley which runs
parallel to and lies between Kennedy Street and Peabody Street
in Hillcrest Addition, as it exists from West Broadway to Minton
Street, is hereby closed to vehicular traffic. Thus said alley
will become a part of the adjoining park and will remain open to
pedestrian traffic and will remain in use for utility right of way.
The area involved in this closing is more particularly described
as follows:

That portion of the alley lying between the northeast
right of way line of Minton Street and the southwest
right of way line of Nueces Street and between Bay
View Park and Blocks 35 and 36, Hillcrest Addition;
That portion of the alley lying between the northeast
right of way line of Nueces Street and the southwest
right of way line of Dempsey Street, Hillcrest Addition;
That portion of the alley lying between the northeast
right of way line of Dempsey Street and the southwest
right of way line of John Street, Hillcrest Addition;
and
That portion of the alley lying between the northeast
right of way line of John Street and the southwest
right of way line of West Broadway, Hillcrest Addition.
SECTION 2. The fact that the public convenience and
necessity would be better served by the closing of the above
described alley to vehicular traffic creates a public emergency
and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed
finally on the date of its introduction and that such ordinance
or resolution shall be read at three several meetings of the City
Council, and the Mayor having declared such emergency and necessity
to exist, and having requested the suspension of the Charter rule
and that this ordinance be passed finally on the date of its intro-
duction and take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINED, this the
day of August, 1971.

ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
