HomeMy WebLinkAbout10450 ORD - 09/01/1971TEXAS: AN ORDINANCE AMENDING ORDINANCE N0.9349, APPROVED BY THE CITY COUNCIL ON JULY 22, 1970) TO AUTHORIZE THE EXECU- TION OF A SUBSTITUTE AGREEMENT FOR ARCHITECTURAL SERVICE FOR THE CONSTRUCTION OF A NEIGHBORHOOD FACILITY COMPLEX IN BEN GARZA PARK, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; APPROPRIATING $43,400 OUT OF NO. 291 PARK BOND FUND TO SUPPLEMENT FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 98119, OF SAID APPROPRIATION $42,490 IS FOR THE ARCHITECTURAL FEES AND $910 IS FOR TESTING AND INCIDENTAL EXPENSES, ALL APPLICABLE TO PROJECT NO. 291- 70 -15; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT ORDINANCE No. 9849, APPROVED BY THE CITY COUNCIL ON JULY 22, 1970, BE AND THE SAME IS HEREBY AMENDED TO AUTHORIZE THE EXECU- TION OF A SUBSTITUTE AGREEMENT FOR ARCHITECTURAL SERVICE FOR THE CONSTRUC- TION OF A NEIGHBORHOOD FACILITY COMPLEX IN BEN GARZA PARK, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A ". SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 291 PARK BOND FUND THE SUM OF $43,400 TO SUPPLEMENT FUNDS PREVIOUSLY APPROPRIATED_ BY ORDINANCE No. 9849, OF SAID APPROPRIATION 42,490 BEING FOR THE ARCHITECTURAL FEES AND $910 BEING FOR TESTING AND INCIDENTAL EXPENSES, ALL APPLICABLE TO PROJECT N0. 291- 70 -15. SECTION 3. THE NECESSITY TO AMEND THE AFORESAID ORDINANCE AND TO AUTHORIZE EXECUTION OF A SUBSTITUTE AGREEMENT FOR ARCHITECTURAL SERVICE FOR CONSTRUCTION OF A NEIGHBORHOOD FACILITY COMPLEX IN BEN GARZA PARK IN ORDER THAT A COMPLETE NEIGHBORHOOD FACILITY COMPLEX MAY BE CONSTRUCTED TO AID AND ASSIST THE CITIZENS OF THE COMMUNITY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE.SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM 10450 i • AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE Z4t- DAY OF SEPTEMBER, 1971. This agreement supereedes the previous agreement authorized by the City Council on , 1970. WITNESS1;TH : THAT 14HEP01'1S, the City intends to construct a Neighborhood Facility Complex in the Ben Garza Park area in the City of CorpusChristi, Texas and that the scope of said coMplex shall include but not be limited to.the following: (1) Unit A: Health Clinic, recreational, vocational, mental health = mental retardation, day care, C.A.P., and family counseling (2) Unit B: Diterior recreational slabs, covered area,. volleyball courts, shuffleboard courts, arcade, and shelter (-3) Unit C: The reconstruction of the Hurricane Celia damaged gymnasium and existing structures (4) Any other work related to the scope above which may arise after conferences with City and after preliminary plans have been prepared. Phase II - Detailed Plans and Specification Phase After the City has determined and approved the scope of the work to be performed and after such scope has also been approved by Federal Agency where grant application has been made, then the Architect will be authorized to proceed with Phase II of project and the Architect then agrees to perform the following work; A. Design Development Phase (1) Prepare from approved preliminary schematic designs the detailed plans and specifications (2) Develop working drawings to large scale (3) Make necessary field, surveys required for ara -iring plans and specifications (4) Prepare large scale working drawing for stractural,• mechanical, electrical, plumbing, heating, and ventilating systems, air conditioning, etc. (5) Submit large scale drawing and system to City.for approval (6) Re- evaluate and adjust the estimate of probably construction cost if required (7) Confer with City and appropriate agencies regarding detailed plan (8) The Architect will make an evaluation of gas air conditioning to the City and in no event shall plans be approved without this evaluation. (fit) Assist City in filing proper documents and securing necessary approvals of government or other agencies on the project (5) Provide City with five (5) copies of approved plans and thirty- five (35) copies of spccifications for the project. C. Bidding or Iegotiation Phase (1) Assist City in securing bids based upon construction documents (2) Assist the City in evaluating proposals and awarding contracts (3) Prepare final contract documents after award of contract for the review and approval of City. D. Construction Administration Phase (1) Provide construction administration as set forth in General Provisions of contract ` (2) Make periodic visits to the job site to determine whether work is proceeding in accordance with the contract document I (3) Review shop drawing submitted by contractor for the project and recommend approval to City (4) Review laboratory reports (5) Interpret construction documents if needed to the contractor (6) Prepare monthly construction estimate and submit to the City for payment (7) Prepare change orders on the project and submit to City and contractor for approval (8) Deliver to the City all certificates'of inspecting authorities, equipment operating manuals, bonds, guarantees, and related docu- ments (9) Puke final inspection on project with appropriate City officials and nuke recommendation for acceptance f (10) Deliver to the City "A!3 Duilt" Construction Drawing upon completion of project in original reproducible fortn. However, the percentage will vary depending on which group the type of construction is based on, and such determination will be made at the time of approval of plans and specifications. Payment For and in consideration of the services listed above the City agrees to pay the Architect on the following basis: (1) Upon completion of all work indicated in Phase I (Preliminary Design Phase Phase) and upon review and approval of such work by the City, the City will pay the Architect 1% of the basic fee. table: (2) Upon completion of all work indicated in Phase II - A (Design Develop- ment Phase) and upon review and approval of such work by the City, the City will pay the Architect 20% of the basic fee. (3) Upon completion of all work indicated in Phase II - B (Construction Documents Phase) and upon review and approval of such work by the City, the City will pay Architect 110% of the basic fee (4) Upon award of contract and completion of Phase IT - C (Bidding and Negotiation Phase) the City will pay Architect 5% of basic fee. (5) Upon completion of construction of project, Phase IT - D, the City Vill pay Architect 20,0' of basic fee and will also make-proper adjust- ments to the fee based on final construction cost SCHEDULING OF WORT: Architect agrees to.complete work in accordance with the following time (1) Pl=c I (Preliminary Work): All preliminary work shall be completed and preliminary report submitted to the City within 90 days from the date of written nuthorizntion by the City. Page 4 (2) Phase II: All design and detailed specifications shall be completed within 120 days from the date of smitten authorization by the City. STAGING OF DESIGN AND CONSTRUCTION Should the City desire to stage the architectural work, thus authorizing a portion of the total work, the Architect's fee shall be based in accordance with the payment schedule in this contract, but the payment percentage for all phases shall be based on the design and construction portion authorized only. TERMINATION OF CONTRACT The City shall have the option of terminating this contract at any time and the fees of Architect shall be the fees due for such stage or stages as are completed. The City may terminate this contract at the completion of Phase I if it is indicated that no grant would be approved to complete this work. In the event, however, that termination occurs after request of the City to proceed with a certain stage but before such stage is completed, the payment due the Architect shall be the payment herein provided for the stage completed and a percentage of the uncompleted stage commensurate with the percentage of completion at 'that stage.
