HomeMy WebLinkAbout10467 ORD - 09/15/1971AN ORDINANCE APPROPRIATING OUT OF NO. 291 PARK BOND FUND THE SUM OF $12,574, OF WHICH $12,375 IS FOR ACQUISITION OF PARCEL NO. 1 AND $199 IS FOR INCIDENTAL EXPENSES AND RELATED COSTS APPLICABLE TO PROJECT NO. 291 -70 -10.1, HILLCREST PARK (TEX- OSC -85); AUTHORIZING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACT WITH THE OWNERS, AUTRY FLOYD AND WIFE, MARY FLOYD; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE I IS HEREBY APPROPRIATED OUT OF NO. 291 PARK BOND FUND THE SUM OF $12,574, OF WHICH AMOUNT $12,375 IS FOR ACQUISITION OF PARCEL NO. 1, AND $199 IS FOR INCIDENTAL EXPENSES, ALL APPLICABLE TO PROJECT NO. 291 -70 -10.1, HILLCREST PARK (TEX- OSC -85), SAID PARCEL BEING DESCRIBED AS FOLLOWS: LOTS 1 AND 2, BLOCK 36, HILLCREST ADDITION AS SHOWN BY MAP OF RECORD IN VOLUME 3, PAGE 29, MAP RECORDS OF NUECES COUNTY, TEXAS. SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT AND SUCH 5 OTHER INSTRUMENTS AS MAY BE NECESSARY TO ACQUIRE, FOR AND ON BEHALF OF I THE CITY OF CORPUS CHRISTI, THE AFORESAID PARCEL FROM THE OWNERS, AUTRY FLOYD AND WIFE, MARY FLOYD. SECTION 3. THE NECESSITY TO APPROPRIATE THE SUMS HEREINABOVE DESCRIBED AND TO ACQUIRE THE PARCEL AFORESAID CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY 10467 ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFT R ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE /00` DAY OF 1971, ATTEST: a 0 CITY SEC E/ Y M YOR THE CITY OF CORPUS I I, TEXAS APPROVED: DAY OF 1971: CI ATTORNEY ' • CITY OF CORPUS CHRISTI, TEXAS CERTIFICATION OF FUNM (City Charter Article IV Section 21) September 7, 1971 • I certify to the City Council that $ 12,574.00 , the amount required for the contract, agreement, obligation or expenditures contemplated in the above and foregoing ordinance is in the Treasury of the City of Corpus Christi to the credit of: Fund No, and Name 291 Park Bond Fund Project No. 291 -70 -10.1 Project Name Hillcrest Park (=- OSC -85) from which it is proposed to be drawn, and such money is not appropriated for any other purpose.
