AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO CONVEY TO
T. A. HARRELL, JR., A TRACT OF LAND DESCRIBED
AS LOT 21, BLOCK 36, POPE PLACE UNIT FIVE (5),
A SUBDIVISION IN THE CITY OF.CORPUS CHRISTI,
NUECES COUNTY, TEXAS, UPON THE PAYMENT OF
$61,650.00 CASH CONSIDERATION FOR SAID PARCEL,
A COPY OF INSTRUMENT CONVEYING SAME BEING
ATTACHED HERETO AND MADE A PART HEREOF; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager be, and he is hereby
authorized, for and on behalf of the.City of Corpus Christi, to
execute a deed conveying to T. A. Harrell, Jr., the following
described property:
Lot 21, Block 36, Pope Place Unit Five (5)
Subdivision in the City of Corpus Christi,
Nueces County, Texas, as shown on map of
record in Volume 37, Page 84, Nueces County,
Texas, Map Records.
upon payment of the cash consideration of $61,650.00 for said
parcel of land, a copy of said deed is attached hereto and made
a part hereof.
SECTION 2. The necessity to immediately authorize the
execution of a deed in order to facilitate the sale of the above
described parcel of land creates a public emergency and imperative
public necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date of
its introduction but that such ordinance or resolution shall be
read at three several meetings of the City Council, and the Mayor
having declared such emergency and necessity to exist, and having
requested the suspension of the Charter rule and that this ordinance
be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO ORDAINED, this th day of Se tember, 1971.

AND IN CONSIDERATION OF THE SUM OF SIXTY -ONE THOUSAND SIX HUNDRED FIFTY
DOLLARS ($61,650.00) TO GRANTOR IN.HAND PAID BY T. A. HARRELL,•JR., THE
RECEIPT OF WHICH IS HEREBY ACKNOWLEDGED, AND FOR WHICH NO LIEN IS RETAINED,
EITHER EXPRESSED OR IMPLIED, HAS THIS DAY SOLD, AND BY THESE PRESENTS DOES
GRANT, BARGAIN, SELL AND CONVEY UNTO THE SAID T. A. HARRELL, JR., ALL THAT
CERTAIN TRACT OR PARCEL OF LAND LYING AND BEING SITUATED IN THE COUNTY OF
NUECES, STATE OF TEXAS, MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO -WIT:
LOT 21, BLOCK 36, POPE PLACE UNIT FIVE (5) SUBDIVISION
IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS
SHOWN ON MAP OF RECORD IN VOLUME 37, PAGE 84, NUECES
COUNTY, TEXAS, MAP RECORDS.
TO HAVE AW TO HOLD THE ABOVE DESCRIBED PREMISES HEREIN CONVEYED,
TOGETHER WITH ALL AND SINGULAR THE RIGHTS AND APPURTENANCES THERETO IN ANY-
WISE BELONGING, TO THE SAID T. A. HARRELL, JR., HIS HEIRS AND ASSIGNS, FOR-
EVER, AND GRANTOR DOES HEREBY BIND ITSELF, ITS SUCCESSORS AND ASSIGNS, TO
WARRANT AND FOREVER DEFEND ALL AND SINGULAR THE SAID PREMISES HEREIN CON-
VEYED AGAINST EVERY PERSON WHOMSOEVER LAWFULLY CLAIMING OR TO CLAIM THE
SAME OR ANY PART THEREOF BY, THROUGH, OR UNDER GRANTOR. THIS CONVEYANCE IS
SUBJECT TO THE FOLLOWING CONDITIONS:
1. THAT A STANDARD SCREENING FENCE, AS DEFINED BY THE CITY OF
CORPUS CHRISTI, BE ERECTED ALONG THE REAR OF THE SUBJECT PROPERTY AND A THREE -
FOOT (3') SCREENING FENCE BE ERECTED ALONG CARMEL TO THE PROPERTY LINE;
2. ;THAT USES BE RESTRICTED TO PROHIBIT THE SALE FOR OUTSIDE CON-
SUMPTION OF FOOD OR BEVERAGES;
t3. THAT NO ENTRANCES OR EXITS BE PERMITTED FROM CARMEL PARKWAY;
Y. THAT THE CITY OF CORPUS CHRISTI SHALL'BE PARTY TO THE ENFORCE-
14ENT OF THE DEED RESTRICTIONS UPON THE USE IN THIS ZONING DISTRICT, AND THE
CONDITIONS PROVIDED HEREIN SHALL BE INCORPORATED IN ANY CONVEYANCE MADE OF
THIS PROPERTY, WHETHER FOR SALE, LEASE OR OTHERWISE, AS COVENANTS OF RESTRIC-
TION, AND THE CITY SHALL BE ENTITLED TO ENFORCE THE SAME AS A PARTY TO SUCH
COVENANT BY CONVEYANCE.

BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
