AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
AN AGREEMENT WITH BATH & ASSOCIATES, CONSULTING
ENGINEERS FOR ENGINEERING SERVICES REQUIRED FOR THE
REPAIR AND/OR IMPROVEMENT TO THE EXISTING AIR CON-
DITIONING SYSTEM AT THE POLICE BUILDING, A COPY OF
WHICH IS ATTACHED HERETO, MARKED EXHIBIT "A" AND
MADE A PART HEREOF; APPROPRIATING AND REAPPROPRIAT-
ING OUT OF THE NO. 102 GENERAL FUND, ACTIVITY 3327,
CODE 301, $3,100,OF WHICH $1,544 IS IN CONNECTION
WITH THE REPAIR AND/OR IMPROVEMENT OF THE EXISTING
SYSTEM AND $1,560 IS IN CONNECTION WITH THE NEW IN-
STALLATION IN THE UNFINISHED PORTION OF THE BUILDING;
AND DECLARING AN EMERGENCY.
WHEREAS, THE CITY INTENDS TO REPAIR AND /OR IMPROVE THE EXISTING
AIR CONDITIONING SYSTEM AT THE POLICE BUILDING; AND
WHEREAS, THE ENGINEERING FIRM OF BATH & ASSOCIATES HAS BEEN SELECTED
FOR ENGINEERING SERVICES REQUIRED FOR THE REPAIR AND /OR IMPROVEMENT OF SAID
AIR CONDITIONING SYSTEM:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO
EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, AN AGREEMENT WITH
BATH & ASSOCIATES, CONSULTING ENGINEERS FOR ENGINEERING SERVICES REQUIRED
FOR THE REPAIR AND/OR IMPROVEMENT TO THE EXISTING AIR CONDITIONING SYSTEM
AT THE POLICE BUILDING, A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT
"A" AND MADE A PART HEREOF.
SECTION 2. THE SUM OF $3,100 IS HEREBY APPROPRIATED AND REAPPRO-
PRIATED OUT OF THE N0. 102 GENERAL FUND, ACTIVITY 3327, CODE 301, OF WHICH
$1,540 IS IN CONNECTION WITH THE REPAIR AND /OR IMPROVEMENT OF THE EXISTING
SYSTEM AND $1,560 IS IN CONNECTION WITH THE NEW INSTALLATION IN THE UNFINISHED
PORTION OF THE BUILDING.
SECTION 3. THE NECESSITY FOR IMMEDIATELY PROCEEDING WITH THE
REPAIR AND/OR IMPROVEMENT AS OUTLINED ABOVE CREATES A PUBLIC EMERGENCY AND
AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE
THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE
SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH

EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID
CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND
EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE

THIS A,R —FFMM, made and entered into this day of
, 1971, by and between the CITY OF CORPUS CHRISTI, TEXAS, a
municipal corporation, acting herein by and through its City Manager, duly authorized
to act, hereinafter called the "City ", and Bath & Associates, Consulting Engineers, of
Corpus Christi Texas, hereinafter called the "Engineer ".
W I T N E S S E T H:
THAT WHEREAS, the City intends to repair the existing and install additional
air conditioning facilities at the Police Building in the City of Corpus Christi,
Texas, and that the scope of said work shall include but not be limited to the following:
Phase I.a.
Provide necessary field surveys, testing, load studies, equipment evaluation
and prepare recommendations and cost estimates for correction of the deficiencies
in the existing air condition system.
Phase I.b.
Prepare specifications drawings and bid documents, if required, for correction
of deficiencies in existing system.
Phase I.e.
Inspection of construction for repair of existing air conditioning systems, if
required.
Phase TT.
Prepare plans, specifications, bid documents and consultive services during
construction for the installation of an air conditioning system for the un-
finished portion of the building.

AND WfUTMAS, in connection with the above listed scope of work in the Police
Building the City employs the said Engineer and said City and Engineer agree as
follows:
Phase I.e. - Preliminary Phase
The Engineer agrees to do the following work related to the air conditioning:
(1) Review the project with appropriate agency or agencies of the City.
(2) Make necessary field surveys, load studies, and equipment evaluations.
(3) Prepare preliminary cost estimates for the projectand submit said
estimates to the City.
(4) Provide recommendation to the City after evaluation for correction of
existing system.
Phase I.b. - Detailed Plans and Specification Phase
After Phase I.a. recommendation has been approved, the Engineer shall prepare
plans and specifications and bid documents for contracting said work by the City.
Such work shall be as follows:
(1) Prepare necessary bidding information and contract documents in accordance
with City established procedure.
(2) Provide City with five (5) copies of approved plans and fifteen copies
of specifications for the project.
(3) Assist City in securing bids based upon-construction documents. -
(4) Assist the City in evaluating proposals and awarding contract.
(5) Prepare final contract documents after award of contract for the review
and approval of City.
Phase I.c. - Construction Administration Phase
Upon award of contract, Engineer shall provide hourly inspection as needed
during construction, but upon written authority of the City. Such work shall include
the following:
(1) Provide construction administration as set forth in General Provisions
of contract.
(2) Make periodic visits to the job site to determine whether work is pro-
ceeding in accordance with the contract document.
(3) Review shop drawing submitted by contractor for the project and recommend
approval to City.
(4) Review laboratory reports, if required.
(5) Interpret construction documents if needed to the contractor.

(6) Prepare monthly construction estimate and submit to-the City for payment.
(7) Prepare change orders on the project and submit to City and contractor
for approval.
(8) Deliver to the City all certificates of inspecting authorities, equipment
operating manuals, bonds, guarantees, and related documents.
(9) Make final inspection on project with appropriate City officials and
make recommendation for acceptance.
(10) Deliver to the City "As Built" Construction Drawing upon completion of
project in original reproducible form.
Phase II
This phase covers the installation of additional units in the unfinished portion
of the Police Building. The duties of the Engineer shall be the same as I.a., I.b.,
and I.e. above, but not limited to those items, but should include all other work
necessary to complete in accordance with the TSPE Manual of Professional Practice.
For and in consideration of the services listed, the City agrees to pay the Engineer
as follows:
Phase I
(1) Upon completion of Phase I.a., the lump sum of $840.00.
(2) Upon completion of Phase I.b. and approval by the City, the lump sum of $400.00.
(3) Upon completion of Phase I.e. and after prior written approval by the City, the
actual cost based on the hourly rate of $15.00 per hour, but not to exceed $300.00.
Phase II
Upon written authority to proceed with this phase of work, the City agrees to pay the
Engineer as follows:
(1) Upon completion of plans and specifications and award of contract, the City will
pay the Engineer 75% of the fee based on 13% of the construction contract.
(2) Upon completion and acceptance by the City, 25% of fee based on 13% of construction
contract.

SCHEDULING OF WORK
Engineer agrees to complete work in accordance with the following time table:
Phase I.a. - within two weeks from date of approval.
Phase I.b. - within two weeks from date of approval.
Phase II. - all design work, plans, specifications, etc., within 45 days from date
of authorization by the City.
TERMINATION OF CONTRACT
The City shall have the option of terminating this contract at any time and
the fees of Engineer shall be the fees due for such stage or stages as are completed.
IN TESTIMONY WHEREOF, witness our hands in duplicate, each of which shall be
considered an original, on the day and the year first above written.

CITY COUNCIL.
