HomeMy WebLinkAbout10488 ORD - 09/29/1971• VMP79 /28/71 • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF MAVERICK MARKETS, INC. BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A PORTION OF SHARE 2, GEORGE FRANK PARTITION D , SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "F -R" FARM -RURAL DISTRICT TO B GENERAL BUSINESS DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION OF MAVERICK MARKETS, INC. FOR AMENDMENT TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON SEPTEMBER 22, 1971 , AT SPECIAL COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937,. APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE N0. 6106, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. 1048© SECTION 2. THAT THE ZONING OF A TRACT OF LAND 150 FEET BY 230 FEET DEEP OUT OF A 75.623 ACRE TRACT OUT OF SURVEY 416, ABSTRACT 838 AND SURVEY 421, ABSTRACT 572, NUECES COUNTY, TEXAS, AND BEING OUT OF SHARE NO. 2, FRANK PARTITION, VOLUME 142, PAGE 579, NUECES COUNTY DEED RECORDS, AND BEING THE REMAINDER OF A 101.3 ACRE TRACT RECORDED IN VOLUME 177, PAGES 581-583 OF THE NUECES COUNTY, TEXAS, DEED RECORDS, BE CHANGED FROM °F -R° FARM -RURAL DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT, SAID PROPERTY BEING MORE FULLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: COMMENCING AT A 1 -INCH IRON PIPE FOUND TO MARK THE ORIGINAL SOUTHEAST CORNER OF THE RALPH PAGE 101.3 ACRE TRACT AS STATED ABOVE; THENCE ON THE EAST LINE OF SAID 101.3 ACRE TRACT, NORTH 0° 06 MINUTES WEST, 195.05 FEET TO A 1 -INCH IRON PIPE FOUND ON THE NORTH RIGHT OF WAY OF STATE HIGHWAY N0. 9 (LEOPARD STREET); THENCE ON THE NORTH LINE OF HIGHWAY N0. 9 (LEOPARD STREET) NORTH 65° 15 MINUTES 00 SECONDS WEST, 1333.99 FEET; THENCE NORTH 32° 110 MINUTES 25 SECONDS WEST, 126.40 FEET TO A POINT IN THE EAST RIGHT OF WAY LINE OF RAND MORGAN ROAD; THENCE NORTH 65° 15 MINUTES WEST, 33.06 FEET TO THE CENTER LINE OF RAND MORGAN ROAD, THE WEST LINE OF THE ORIGINAL 101.3 ACRE TRACT; THENCE ON THE CENTER LINE OF RAND MORGAN ROAD, THE ORIGINAL WEST LINE OF SAID 101.3 ACRE TRACT, NORTH 00 06 MINUTES WEST, 260.0 FEET TO THE SOUTHWEST CORNER OF THIS TRACT AND THE POINT OF BEGINNING; THENCE CONTINUING ALONG THE CENTER LINE OF RAND MORGAN ROAD NORTH 0° O6 MINUTES WEST 100 FEET TO A POINT FOR THE NORTHWEST CORNER OF THIS TRACT; THENCE SOUTH 65° 15 MINUTES EAST A DISTANCE OF 233.06 FEET TO A POINT FOR THE NORTHEAST CORNER OF THIS TRACT; THENCE SOUTH 0° 06 MINUTES EAST A DISTANCE OF 150 FEET TO A POINT FOR THE SOUTHEAST CORNER OF THIS TRACT; THENCE NORTH 65° 15 MINUTES WEST A DISTANCE OF 233.06 FEET TO A POINT IN THE CENTER LINE OF RAND MORGAN ROAD, THE SOUTHWEST CORNER AND BEGINNING POINT OF THIS TRACT. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION 4. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF -CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS A14ENDED FROM TIME TO TIMC, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. -2- SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6.
