LEE, BY AMENDING THE ZONING MAP BY CHANG- ING THE ZONING ON A PORTION OF LOTS 2 & 3, SECTION 31, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS, (APPROXIMATELY 0.7+9 ACRE) SITUATED IN THE CITY OF CORPUS CHRISTI, FROM "R -1B" ONE— FAMILY DWELLING DIS- TRICT TO 13-4" GENERAL BUSINESS DISTRICT, ALL AS IS MORE FULLY HEREINBELOW SET OUT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION OF WILLIAM E. LEE TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND FOR AMENDMENT WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON SEPTEMBER 15,. 1971 , AT SPECIAL COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE NO. 61o6; AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. SECTION 2. THAT THE ZONING ON A PORTION OF LOTS 2 & 3, SECTION 31, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS, (APPROXIMATELY 0.749 ACRE) SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, BE CHANGED FROM "R -1131" ONE- FAMILY DWELLING DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT, SAID PROPERTY BEING MORE FULLY DESCRIBED AS FOLLOWS, TO -WIT: Being a portion of Lots Two (2) and Three (3), Section Thirty One (31), FLOUR BLUFF AND ENCINAL FAMI AND GARDEN TRACTS, Nueces County, Texas, ac- cording to map or plat recorded in Vol. A, Page 44, Map Records of Nueces County, Texas, and being more particularly described by metes and bounds as follows, to -wit: To reach the point of beginning proceed S. 61 deg. E. a distance of 660.00 feet from the common corner of Sections 28, 30 and 31 (an old post marked E -16, the original corner of said sections) to an iron rod set in the N. Line of Section 31, in the S. line of Section 30, and also in the W. line of Lot 2, Section 31, Flour Bluff and Encinal Farm and Garden Tracts: THENCE, S.29 deg. W. a distance of 966.44 feet to an iron rod in the northern right of way of South Padre Island Drive; THENCE, S.63 deg. 36' 30" E. along and coinciding with the northern right of way of South Padre Island Drive a distance of 44.16 feet to an iron rod; THENCE, S.67 deg. 54 ft. E. along and coinciding with the northern right of way of South Padre Island Drive, a distance of 200.44 feet to an iron rod; THENCE, S. 63 deg. 36'30" E. along and coinciding with the northern right of way of South Padre Island Drive a distance of 157.06 feet to an iron rod for the SW corner of this tract and the point of beginning. THENCE,N. 29 deg. E. a distance of 178.53 feet to an iron rod for the NW corner of this tract; THENCE, S. 61 deg. E. a distance of 187.25 feet to an iron rod for the NE corner of this tract; THENCE, S. 29 deg. W. a distance of 170.00 feet to an iron rod for the SE corner of this tract and a point in the northern right of way of South Padre Island Drive; THENCE, N. 63 deg. 36'30" W. along and coinciding with the northern right of way of South Padre Island Drive, a distance of 187.44 feet to the point of beginning. Said tract or parcel contains 0.749 acres. And being that same property described in Deed from Edna Mary Lee to William E. Lee dated March 11, 1969 and recorded in Vol. 1357, Pages 391 -393, Deed Records, Nueces County, Texas. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION 4. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF -CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS AMENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND -2- AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS ASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THELLDAY OF s�C ATTEST: ~ J O CITY SEC ETAJj) ppppp// j/ MAYOR APQ:r� THE CITY OF CORP RISTI, TEXAS !DAY TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI TEXAS • CORPUS CHRISTI, TEXAS -2f -Z DAY O 9—Z/ e� FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCES A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE, REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI- NANCE FINALLY ON THE DATE IT IS INTRODUCED OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
