HomeMy WebLinkAbout10494 ORD - 09/29/19719 -29 -71 AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF AN AREA MANPOWER PLANNING COUNCIL TO ASSIST, REVIEW AND ADVISE IN THE PLANNING AND EXECUTION OF MANPOWER PROGRAMS; PROVIDING FOR 15- MEMBER COUNCIL WITH 2 -YEAR OVERLAPPING TERMS; DESIGNATING JURISDICTIONAL BOUNDARIES, PROVIDING FOR THE CITY MANAGER OR HIS DESIGNATED REPRESENTATIVE TO ACT AS CHAIRMAN ON BEHALF OF THE MAYOR; PROVIDING SECRETARIAT SUPPORT; AND DECLARING AN EMERGENCY. WHEREAS, INTERGOVERNMENTAL COOPERATIVE ISSUANCE #72 -2, DATED MAY 21, 1971, INSTITUTES REVISION OF THE COOPERATIVE AREA MANPOWER PLANNING SYSTEM; AND WHEREAS, SAID ISSUANCE IS DESIGNATED TO MOVE TOWARD A DECENTRALIZED METHOD OF OPERATION WHICH WILL PERMIT INCREASED PARTICIPATION BY LOCAL GOVERNMENTS IN THE PLANNING AND EXECUTION OF MANPOWER PROGRAMS; AND WHEREAS, THE DEPARTMENT OF LABOR HAS EXPRESSED A COMMITMENT TO FUND PROGRAMS IN RESPONSE TO AGREED AREA MANPOWER PLANS INSOFAR AS POSSIBLE; AND WHEREAS, SAID ISSUANCE REQUIRES THE FORMULATION OF AN AREA MANPOWER PLANNING COUNCIL WHOSE DUTIES WILL BE: 1) TO ADVISE LOCAL GOVERNMENTS OF THE NEEDS FOR MANPOWER SERVICES ACCORDING TO LOCALLY CONCEIVED PRIORITIES; 2) TO ASSIST LOCAL GOVERNMENTS IN THE DEVELOPMENT OF COMPREHENSIVE MANPOWER PLANS; 3) TO ESTABLISH PRIORITIES AND MAKE RECOMMENDATION FOR APPROPRIATE PROGRAM FUNDING; 4) TO REVIEW AND EVALUATE MANPOWER PROGRAM OPERATIONS; 5) TO COORDINATE PROGRAM AND PLANNING ACTIVITIES WITH THE STATE MANPOWER PLANNING COUNCIL AND THE REGIONAL MANPOWER COORDINATING COMMITTEE: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT AN AREA MANPOWER PLANNING COUNCIL, TO CONSIST OF 15 MEMBERS, ONE -THIRD OF WHICH WILL BE REPRESENTATIVES FROM MANPOWER TRAINING PROGRAMS, ONE -THIRD OF WHICH WILL REPRESENT THE CLIENT SECTOR, AND ONE -THIRD OF WHICH WILL REPRESENT THE BUSINESS/LABOR SECTOR, BE,APPOINTED. 1-9494 THE MEMBERS OF SAID COUNCIL SHALL BE APPOINTED ON THE EFFECTIVE DATE OF THIS ORDINANCE AS FOLLOWS: SEVEN (7) MEMBERS OF SAID COUNCIL SHALL BE INITIALLY APPOINTED FOR A TERM OF ONE (1) YEAR, AND EIGHT (8) MEMBERS OF SAID COUNCIL SHALL BE APPOINTED FOR A TERM OF TWO (Z) YEARS. INSOFAR AS POSSIBLE, THE EXPIRING TERMS OF OFFICE SHALL BE EQUALLY DIVIDED AMONG THE MEMBERSHIP OF THE THREE SECTORS OR AREAS HEREINABOVE DESCRIBED. UPON EXPIRATION OF THE TERM OF OFFICE OF THE FIRST SEVEN APPOINTEES, THE SUCCEEDING TERM OF OFFICE FOR EACH OF THE SAID FIFTEEN MEMBERS SHALL THEREAFTER BE FOR A TERM OF TWO YEARS. MEMBERS MAY BE REAPPOINTED AT THE DISCRETION OF THE CITY COUNCIL. SECTION Z. THE SAID AREA MANPOWER PLANNING COUNCIL WILL HAVE JURISDICTION WITHIN THOSE COUNTIES REPRESENTED IN THE COASTAL BEND PLANNING REGION. SECTION 3. THE CITY MANAGER OR HIS DESIGNATED REPRESENTATIVE WILL SERVE ON BEHALF OF THE MAYOR OF THE CITY OF CORPUS CHRISTI IN THE CAPACITY OF CHAIRMAN OF THE AFORESAID AREA MANPOWER PLANNING COUNCIL. SECTION 4. THE STAFF PROVIDED THROUGH A GRANT FROM THE DEPARTMENT OF LABOR AND RESPONSIBLE TOTHE DIRECTOR OF DEPARTMENT OF URBAN DEVELOPMENT SHALL BE DESIGNATED SECRETARIAT TO THE AFORESAID REGIONAL MANPOWER COORDINATING COMMITTEE. SECTION 5. THE NECESSITY TO ADOPT THE PROVISIONS HEREINABOVE PROVIDED AT THE EARLIEST PRACTICABLE DATE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS RESOLUTION BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO RESOLVED, THIS THE -1 OF SEPTEMBER, 1971• ATTEST: CI Y SECRET APPROVE �/ i CIT ATTORNEY a d M OR THE CITY OF CO S CHRISTI, TEXAS • TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS • CORPUS CHRISTI, TEXAS AqXILDAY FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCES A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI- NANCE FINALLY ON THE DATE IT IS INTRODUCED OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
