HomeMy WebLinkAbout10517 RES - 10/13/19711013 /Jl rIC A RESOLUTION AUTHORIZING AND ESTABLISHING THE 050 ECOLOGY ADVISORY COMMITTEE; DESCRIBING ITS POWER AND FUNCTION; PROVIDING FOR MEMBERSHIP AND OFFICERS; AND DECLARING AN EMERGENCY. WHEREAS, IT IS THE FINDING OF THE CITY COUNCIL THAT THE DEVELOP- MENT OF CAYO DEL OSO INVOLVES ECOLOGICAL FACTORS WHICH COULD HAVE AN IMPACT ON THE EXISTING NATURAL ENVIRONMENT OF THE OSO AND ITS SURROUNDINGS; AND WHEREAS, IT IS THE FINDING OF THE CITY COUNCIL THAT THERE IS A NEED WITHIN THE CITY GOVERNMENT FOR A GROUP TO STUDY THE ECOLOGICAL ASPECTS RELATING TO THE DEVELOPMENT OF THE OSO THROUGH PRIVATE AND /OR GOVERNMENTAL OPERATIONS AND ADVISE THE CITY COUNCIL OF ITS FINDINGS. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE IS HEREBY AUTHORIZED AND ESTABLISHED A SPECIAL COMMITTEE OF THE CITY COUNCIL TO BE CALLED "THE CORPUS CHRISTI 050 ECOLOGY ADVISORY COMMITTEE." THE COMMITTEE SHALL CONSIST OF 15 MEMBERS, AT LEAST 12 OF WHICH SHALL BE APPOINTED FROM AMONG THE RESIDENTS OF THE CITY. THE COMMITTEE SHALL SERVE AT THE PLEASURE OF THE CITY COUNCIL AND SHALL TERMINATE WHEN IT IS OF THE OPINION ITS WORK HAS BEEN COMPLETED BUT NOT LATER THAN DECEMBER 311 1972. SECTION 2. OFFICERS OF THE COMMITTEE SMALL BE A CHAIRMAN, DESIGNATED BY THE CITY COUNCIL AT THE TIME OF HIS APPOINTMENT, A VICE - CHAIRMAN AND SECRETARY, BOTH ELECTED BY THE COMMITTEE. THE COMMITTEE SHALL MEET AT LEAST ONCE A MONTH AND AT SUCH OTHER TIMES AS IT CHOOSES. AT ITS FIRST MEETING THE VICE- CHAIRMAN AND SECRETARY SHALL BE ELECTED AND SUCH BY- LAWS AS MAY BE NECESSARY, IF ANY, SHALL BE ADOPTED. THE CITY MANAGER SHALL DESIGNATE SUCH STAFF REPRESENTATIVES TO SERVE THE COMMITTEE AS HE DEEMS APPROPRIATE.AS APPROVED BY CITY COUNCIL. SECTION 3. THE FUNCTION OF THE COMMITTEE SHALL BE TO STUDY THE RELATIONSHIP OF GOVERNMENTAL AND PRIVATE OPERATIONS IN THE DEVELOPMENT OF THE OSO AND THE ECOLOGICAL ASPECTS OF THE DEVELOPMENT WHICH SHOULD BE OF CONCERN TO THE CITY COUNCIL, AND SHALL MAKE SUCH ECOLOGICAL RECOMMENDATIONS AS THEY DEEM ADVISABLE. -/r bay'/ SECTION II. THE COMMITTEE SHALL CREATE NO PECUNIARY OBLIGATION WITHOUT THE PRIOR CONSENT OF THE CITY COUNCILS SHALL FURNISH TO THE CITY COUNCIL AND THE CITY MANAGER, ON REQUEST BY EITHER, A REPORT OF THE STATUS OF ITS WORK IN WRITING; AND SHALL ISSUE NO STATEMENT TO THE PUBLIC OR THE PRESS AS AN OFFICIAL STATEMENT OF THE CITY COUNCIL OR THE CITY OF CORPUS CHRISTI. SECTION 5. THE PUBLIC IMPORTANCE AND NECESSITY TO ESTABLISH AT THE EARLIEST PRACTICABLE DATE THE CORPUS CHRISTI OSO ECOLOGY ADVISORY COM- MITTEE TO STUDY THE RELATIONSHIP OF GOVERNMENTAL AND PRIVATE OPERATIONS TO THE CONDITION OF THE CITY'S ENVIRONMENT AND TO POINT OUT TO THE CITY COUNCIL PROBLEMS IN SUCH RELATIONSHIP AND ADVISE ON THEIR CORRECTION CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS RESOLUTION BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE.
