HomeMy WebLinkAbout10519 ORD - 10/13/1971AN ORDINANCE AMENDING ORDINANCE N0. 8879, AS AMENDED, OF THE CITY OF CORPUS CHRISTI, TEXAS BY AMENDING SEC. 5.111 "TENURE OF DRILLING PERMIT' THEREOF TO PROVIDE_ EXTENSIONS AT COUNCIL DISCRETION ON STATED GROUNDS; PROVIDING SEVERABILITY; PROVIDING PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. ORDINANCE NO. 8879, AS AMENDED, OF THE CITY OF CORPUS CHRISTI, TEXAS, SEC. 5.14 "TENURE OF DRILLING PERMIT ", IS HEREBY AMENDED TO HEREAFTER READ AS FOLLOWS: "5.14. TENURE OF DRILLING PERMIT. THE TERM OF A DRILLING PERMIT SHALL BE FOR A PERIOD OF ONE (1) YEAR, UNLESS WITHIN SUCH YEAR OPERATIONS ARE COMMENCED, IN WHICH EVENT THE TERM SHALL CONTINUE AS LONG THEREAFTER AS PRODUCTION IS OBTAINED OR DRILLING, REWORKING, RECOMPLETION OR WELL SERVICE OPERATIONS ARE CONDUCTED WITH NO CESSATION OF ALL SUCH PRODUCTION AND OPERA- TIONS FOR MORE THAN NINETY (90) CONSECUTIVE DAYS AND UNTIL THE WELL IS PLUGGED AND ABANDONED IN ACCORDANCE WITH THIS ORDINANCE AND A RELEASE OF THE PERMIT ISSUED BY THE SUPERINTENDENT. HOWEVER, UPON WRITTEN REQUEST OF THE PERMIT HOLDER, ENDORSED WITH COMMENT BY THE PETROLEUM SUPERINTENDENT, PRESENTED TO THE CITY COUNCIL, EXTENSION OF SAID PERMIT PERIOD FOR AN AGGREGATE PERIOD OF NOT MORE THAN TWELVE (12) MONTHS, OR FRACTION THEREOF, MAY, IN ITS DISCRETION, BE GRANTED BY THE CITY- COUNCIL ON MOTION IF THE CITY COUNCIL FINDS (1) THE CITY BY ACT OR OMISSION HAS SUBSTANTIALLY CAUSED THE DELAY IN MEETING ORDINANCE REQUIREMENTS, OR (2) ACTS OF GOD, OR CONDITIONS TOTALLY BEYOND THE CONTROL OF THE HOLDER, HAVE CAUSED THE INABILITY TO COMPLY." SECTION 2. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 3. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, AFTER FINAL PASSAGE, WHICH PUBLICA- TION SHALL CONTAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE AND RECITING THE PENALTY FOR VIOLATION OF THE ORDINANCE. 2' 0519 SECTION 4. THE NECESSITY TO AMEND ORDINANCE NO. 8879 AS OUTLINED ABOVE WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND �AFTER � -ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 1 - ?Vk DAY OF 11( ��, 1971.
