HomeMy WebLinkAbout10542 ORD - 10/27/1971HG:VMP:10/27/71 !_0 AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "ADOPTING AND PROVIDING FOR THE COMPENSATION PLAN FOR ALL POSITIONS IN THE CITY SERVICE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING FOR AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY ", BEING ORDINANCE NO. 5127, PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 3, 1966, AND AS AMENDED, BY PROVIDING FOR RATES OF COM- PENSATION FOR EMPLOYEES OF THE HOUSING SECTION 14HICH ADMINISTERS THE EMERGENCY HOUSING FOR VICTIMS OF HURRI- CANE CELIA; RECOGNIZING PRIOR SERVICE OF SUCH EMPLOYEES; PROVIDING THE HOUSING SECTION TO BE TEMPORARY EMPLOYEES; PROVIDING FOR OVERTIME COMPENSATION FOR CERTAIN EMPLOYEES; PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY OF CORPUS CHRISTI, TEXAS, HEREINAFTER CALLED CITY, AND THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, HEREINAFTER CALLED HUD, ENTERED INTO A CONTRACT FOR THE PROVISION OF EMERGENCY HOUSING FOR VICTIMS OF HURRICANE CELIA; AND WHEREAS, THE CITY AND THE HOUSING AUTHORITY OF THE CITY OF CORPUS CHRISTI, TEXAS, HEREINAFTER CALLED HOUSING AUTHORITY, PURSUANT TO MOTION OF THE CITY COUNCIL ON AUGUST 51 1970, ENTERED INTO A CONTRACT FOR THE PROVISION OF MANAGEMENT OF SAID EMERGENCY HOUSING; AND WHEREAS, SAID CONTRACT IS TO TERMINATE EFFECTIVE MIDNIGHT, OCTOBER 31, 1971; AND WHEREAS, THE NEED FOR EMERGENCY HOUSING STILL EXISTS IN THE CITY OF CORPUS CHRISTI, TEXAS, FOR THE VICTIMS OF HURRICANE CELIA, AND THE CITY IS BOUND UNDER THE AFORESAID CONTRACT WITH HUD TO PROVIDE EMERGENCY HOUSING; AND WHEREAS, THERE IS CURRENTLY EMPLOYED BY THE HOUSING AUTHORITY A GROUP OF EMPLOYEES WHO ARE SKILLED AND EXPERIENCED IN THE MANAGEMENT OF SAID EMERGENCY HOUSING FOR VICTIMS OF HURRICANE CELIA; AND WHEREAS, THE CITY WILL HAVE NEED OF THE SERVICES OF SAID EMPLOYEES EFFECTIVE NOVEMBER 1, 1971: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT SECTION 1 OF SAID ORDINANCE N0. 5127, PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 3, 1966, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY ADDING THE FOLLOWING NEW SUBSECTION (1): I- ®542 i j "(I) UNTIL AND UNLESS CLASSIFICATIONS AND MONTHLY PAY RATES ARE ESTABLISHED, THOSE EMPLOYEES IN THE HOUSING SECTION OF THE DEPARTMENT OF URBAN DEVELOPMENT WHO MANAGE THE PROVISION OF EMERGENCY HOUSING FOR THE VICTIMS OF HURRICANE CELIA PURSUANT TO THE AFORESAID CONTRACT BY AND BETWEEN THE CITY AND HUD WILL BE PAID ACCORDING TO THE FOLLOWING SCHEDULE: POSITION BIWEEKLY SALARY MANAGER 4 $311.51+� SECRETARY 188,54 BOOKKEEPER 168.00 CLERK 161.54 CLERK 161.5+ REPORT CLERK 161.54 CLERK TYPIST 150.00 TYPIST 139.85 INSPECTOR- HELPER 200.00 INSPECTOR 240.00 MAINTENANCE SUPERINTENDENT 300,00 MECHANIC 240,00 MECHANIC 240.00 MECHANIC AIDE 1 .00 MECHANIC 240.00° SECTION 2. THAT SECTION 3 OF SAID ORDINANCE N0. 8127, PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 3, 1966, AS AMENDED, BE, AND THE SAME IS HEREBY, AMENDED BY ADDING THE FOLLOWING NEW SUBSECTION (F): nr F) ANY EMPLOYEE ENTERING INTO A POSITION UNDER THIS COMPENSATION PLAN AS OF NOVEMBER 1, 1971, HAVING BEEN EMPLOYED BY THE HOUSING SECTION OF THE HOUSING AUTHORITY PURSUANT TO THE AFORESAID CONTRACT FOR THE MANAGEMENT OF THE EMERGENCY HOUSING PROGRAM PROVIDED PURSUANT TO THE AFORESAID CONTRACT BY AND BETWEEN THE HOUSING AUTHORITY AND THE CITY IMMEDIATELY PRIOR TO ' NOVEMBER 1, 1971, SHALL RECEIVE COMPENSATION AS SET FORTH IN SECTION 1 OF THIS ORDINANCE. FOR COMPENSATION PURPOSES ONLY, CONTINUOUS SERVICE WITH SAID HOUSING SECTION MAY BE CONSIDERED AS SERVICE WITH THE CITY, BUT SUCH SERVICE SHALL BE CONSIDERED FOR LONGEVITY PURPOSES ONLY AND NOT FOR RETIREMENT OR VACATION DETERMINATIONS." SECTION 3. THE EMPLOYEES COVERED BY THIS ORDINANCE ARE TEMPORARY EMPLOYEES FOR THE MANAGEMENT OF THE EMERGENCY HOUSING PROVIDED FOR UNDER THE TERMS OF THE AFORESAID CONTRACT BY AND BETWEEN THE CITY AND HUD, THE EMPLOYEES COVERED HEREUNDER, SUBJECT TO SECTION 1 OF THIS ORDINANCE, SHALL RECEIVE THE BENEFITS REGULARLY AVAILABLE TO OTHER CITY EMPLOYEES AND SUCH BENEFITS SHALL ACCRUE FROM NOVEMBER 1, 1971. PROVIDED, HOWEVER, THE EMPLOYEES COVERED UNDER 541 THIS ORDINANCE ARE NOT COVERED BY OR PART OF THE CITY'S REGULAR CIVIL SERVICE CLASSIFICATION PLAN. SECTION 4. THOSE PERSONS I'N POSITIONS CLASSIFIED IN SECTION 1 OF THIS ORDINANCE AS MECHANICS OR MECHANIC'S AIDE SHALL BE PAID FOR AUTHORIZED OVERTIME WORK, I.E. ALL AUTHORIZED WORK OVER FORTY HOURS IN ANY ONE WEEK, AT THE RATE OF ONE AND ONE -HALF TIMES THE REGULAR RATE. THOSE PERSONS IN POSITIONS CLASSIFIED IN SECTION 1 OF THIS ORDINANCE AS MANAGER OR MAINTENANCE SUPERINTENDENT SHALL NOT RECEIVE ANY ADDITIONAL SALARY OR BENEFITS FOR OVER- TIME WORK. ALL OTHER SUCH EMPLOYEES SHALL BE GRANTED COMPENSATORY TIME OFF EQUAL TO THE ACTUAL HOURS OF AUTHORIZED OVERTIME BY THE MANAGER OF THE HOUSING SECTION UPON REQUEST OF THE EMPLOYEE. SECTION 5. THE CHANGES PROVIDED FOR IN THIS ORDINANCE SHALL BE EFFECTIVE NOVEMBER 1, 1971, AND NOTICE SHALL BE PUBLISHED ONCE PRIOR TO THAT DATE BY PUBLISHING THE CAPTION OF THIS ORDINANCE IN A NEWSPAPER OF GENERAL CIRCULATION IN THE CITY. SECTION 6. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 7. THE FACT THAT THERE IS AN IMMEDIATE NEED TO PROVIDE FOR THE MANAGEMENT OF THE AFORESAID EMERGENCY HOUSING PROGRAM DUE TO THE TERMINATION OF THE CONTRACT BY AND BETWEEN THE CITY AND THE HOUSING AUTHORITY EFFECTIVE MIDNIGHT, OCTOBER 31, 1971, AND THE CITY'S CONTINUING DUTY TO PROVIDE SUCH EMERGENCY HOUSINGS CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF 1TS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT -3- AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT 13 ACCORDINGLY SO ORDAINED, THIS THE <�'IVW DAY OF ee-Z�C-EL e-L' , 1971.
