HomeMy WebLinkAbout10565 ORD - 11/17/1971/0- 0-7l Y* AN ORDINANCE r AMENDING ORDINANCE NO. 97110, PASSED AND APPROVED BY THE CITY COUNCIL ON MAY 13, 1970, GRANTING A FIVE -YEAR FRANCHISE TO HUMBLE PIPE LINE COI.IPANY TO LAY, CONSTRUCT, OPERATE, MAINTAIN, REPAIR AND REMOVE A CERTAIN FOUR -INCH (11 ") PETROLEUM PRODUCTS (INCLUDING CRUDE OIL AND GAS) PIPELINE WITHIN, BENEATH, ALONG AND ACROSS CERTAIN STREETS WITHIN THE CITY OF CORPUS CHRISTI, BY CHANGING THE LOCATION OF THE AFORESAID LINE AS FOLLOWS: CROSSING YORKTOWN ROAD AT THE INTERSECTION OF FLOUR•BLUFF DRIVE; THEN ALONG FLOUR BLUFF DRIVE, IN A NORTHERLY DIRECTION, TO A POINT IN AN EXISTING PIPELINE LOCATION ABOUT 2071 FEET NORTH OF PURDUE ROAD CROSSING, YORKTOWN BOULEVARD, CARIBBEAN (NOT OPEN), GLENOAK DRIVE, FLOUR BLUFF ROAD, AND DIVISION ROAD (UNOPENED) FOR THE TRANS- PORTATION OF LIQU +D PETROLEUM PRODUCTS, INCLUDING CRUDE OIL AND GAS; KEEPING IN FORCE ALL OTHER PROVISIONS OF ORDINANCE NO. 97110 EXCEPT AS HEREIN PROVIDED; PROVIDING FOR PUBLICATION. WHEREAS, BY ORDINANCE NO. 974O, PASSED AND APPROVED ON MAY 13, 1970, THE CITY COUNCIL GRANTED A FIVE -YEAR FRANCHISE TO HUMBLE PIPE LINE COMPANY TO LAY, CONSTRUCT, OPERATE, MAINTAIN, REPAIR AND REMOVE A CERTAIN • FOUR -INCH (11 ") PETROLEUM PRODUCTS (INCLUDING CRUDE OIL AND GAS) PIPELINE WITHIN, BENEATH, ALONG AND ACROSS CERTAIN STREETS WITHIN THE CITY OF CORPUS CHRISTI; AND ' WHEREAS, HUMBLE PIPE LINE COMPANY HAS REQUESTED AUTHORITY TO CHANGE THE LOCATION OF THE PIPELINE, AND THE REQUEST IS AGREEABLE TO THE CITY OF CORPUS CHRISTI: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ORDINANCE No.-9740, PASSED AND APPROVED BY THE CITY COUNCIL ON MAY 13, 1970, BE AND 1T��HE SAME IS HEREBY AMENDED BY CHANGING THE LOCATION OF A CERTAIN FOUR =INCH (Y ") PETROLEUM PRODUCTS (INCLUDING .'CRUDE OIL AND GAS) PIPELINE WITHIN, BENEATH, ALONG AND ACROSS CERTAIN STREETS WITHIN THE CITY OF CORPUS CHRISTI AS FOLLOWS: ALONG AND UNDER CITY STREETS ALONG THE ROUTE SHOWN ON THE MAP ATTACHED HERETO AND MARKED •EXHIBIT "A" AND CROSSING YORKTOWN ROAD AT THE INTERSECTION OF FLOUR BLUFF •, DRIVE; THEN ALONG FLOUR BLUFF DRIVE, IN A NORTHERLY DIRECTION, TO A POINT 1 IN•Aq EXISTING PIPELINE LOCATION ABOUT 207I.FEET NORTH OF PURDUE ROAD CROSSING, YORKTOWN BOULEVARD, CARIBBEAN (NOT OPEN), GLENOAK DRIVE, FLOUR Y BLUFF ROAD AND DIVISION ROAD (UNOPENED), AS MORE PARTICULARLY SHOWN ON THE PLANS FILED WITH THE DIRECTOR OF ENGINEERING SERVICES OF THE CITY OF CORPUS CHRISTI. JL0565 e SECTION Z. EXCEPT AS HEREBY AMENDED, THE TERMS AND CONDITIONS OF ORDINANCE No. 974o SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 3. WITHIN THIRTY (30) DAYS OF THE DATE OF FINAL PASSAGE OF THIS ORDINANCE, HUMBLE PIPE LINE COMPANY SHALL FILE ITS WRITTEN,ACCEPTANCE OF SAME WITH THE CITY SECRETARY, AND PAY THE COSTS OF PUBLICATION REQUIRED BY THE CITY CHARTER AS A PART OF THE PROCEDURE OF GRANTING THIS FRANCHISE. SECTION 4. UPON THE PAYMENT OF PUBLICATION FEES AND THE FILING OF THE WRITTEN ACCEPTANCE HEREOF] THIS ORDINANCE SHALL IMMEDIATELY BECOME EFFECTIVE AS OF THE DATE OF ITS FINAL ADOPTION BY THE CITY COUNCIL. .;n SECTION 5. A COPY OF THIS ORDINANCE SHALL BE PUBLISHED IN THE CORPUS CHRISTI TIMES, THE OFFICIAL NEWSPAPER OF THE CITY OF CORPUS CHRISTI, WITHIN FIVE (5) DAYS FOLLOWING EACH OF THE THREE READINGS OF THIS ORDINANCE) AND THE EXPENSE OF SUCH PUBLICATION SHALL BE BORNE BY THE GRANTEE. SECTION 6.
