HomeMy WebLinkAbout10572 ORD - 11/17/197111/16f71 HG/Mc AN ORDINANCE AMENDING CHAPTER 21, SECTION 21 -145, OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6603, PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 15, 1962, TO ENCOURAGE COMPLIANCE WITH PARKING REGULATIONS BY INCREASING FINES FOR OVERTIME PARKING, PARKING IN FRONT OF FIRE HYDRANTS, LOADING ZONES AND NO PARKING ZONES AND OTHER PARKING VIOLATIONS; INCREASING FINES NOT PAID WITHIN TEN DAYS; PROVIDING A WARRANT FEE WHEN A WARRANT FOR ARREST IS ISSUED; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT CHAPTER 21, SECTION 21 -145, OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, AND PARTICULARLY AS AMENDED BY ORDINANCE N0. 6603, PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 15, 1962, BE, AND THE SAME IS HEREBY, AMENDED TO READ AS FOLLOWS: "SECTION 21 -145. PENALTY. A. UNLESS ANOTHER PENALTY IS EXPRESSLY PROVIDED BY LAW, EVERY PERSON CONVICTED OF A VIOLATION OF ANY PROVISION OF THIS CHAPTER SHALL BE PUNISHED BY A FINE OF NOT LESS THAN TWO DOLLARS ($2.00) NOR MORE THAN TWO HUNDRED DOLLARS ($200). B. UNLESS ANOTHER PENALTY IS EXPRESSLY PROVIDED IBY LAW, EVERY PERSON CONVICTED OF A VIOLATION OF ANY OF THE PROVISIONS OF CHAPTER 21, ARTICLE VII, DIVISION 5, SECTIONS 21 -129 THROUGH SECTIONS 21-04, INCLUSIVE, CORPUS CHRISTI f CITY CODE, 1958, AS AMENDED, SHALL BE PUNISHED BY A FINE OF NOT LESS THAN TWO DOLLARS ($2.00) NOR MORE THAN TWO HUNDRED DOLLARS ($200). PROVIDED, HOWEVER, IF THE FINE PRESCRIBED IN THIS SUBSECTION IS NOT PAID OR AN APPEARANCE IS MADE WITH A PLEA ENTERED TO HAVE THE CASE HEARD IN MUNICIPAL COURT WITHIN TEN (10) DAYS OF THE DATE OF THE ALLEGED VIOLATION, THEN AND IN THAT EVENT, SAID FINE SHALL BE NOT LESS THAN FOUR DOLLARS ($4.00) NOR MORE THAN TWO HUNDRED DOLLARS ($200). C. UNLESS ANOTHER PENALTY IS EXPRESSLY PROVIDED BY LAW, EVERY PERSON CONVICTED OF A VIOLATION OF THE PROVISIONS OF ARTICLE 6701D, SECTION 95, V.A.C.S., AS ADOPTED BY ORDINANCE N0. 7693, PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 25, 119,65, OR CHAPTER 21, ARTICLE VII, DIVISION 1, DIVISION 2, DIVISION 3 4 OR DIVISION , CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, SHALL BE PUNISHED BY A FINE OF NOT LESS THAN FOUR DOLLARS ($4.00) NOR MORE THAN TWO HUNDRED DOLLARS ($200). PROVIDED HOWEVER, IF THE FINE PRESCRIBED IN THIS SUBSECTION IS NOT PAID 1. ®5'72. OR AN APPEARANCE IS MADE WITH A PLEA ENTERED TO HAVE THE CASE HEARD IN MUNICIPAL COURT WITHIN TEN (10) DAYS OF THE DATE OF THE ALLEGED VIOLATION, THEN AND IN THAT EVENT, SAID FINE SHALL BE NOT LESS THAN EIGHT DOLLARS ($8.00) NOR MORE THAN TWO HUNDRED DOLLARS ($200). D. WHENEVER A PERSON-CHARGED WITH A VIOLATION OF ANY PROVISION OF CHAPTER 21, CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, OR OF ANY PROVISION OF ARTICLE 67010, V.A.C.S., FAILS TO PAY THE PRESCRIBED FINE OR ENTER THE CASE ON THE MUNICIPAL COURT DOCKET AND IT BECOMES NECESSARY TO ISSUE A WARRANT FOR HIS OR HER ARREST, THEN AND IN THAT EVENT, AN ADDITIONAL PENALTY SHALL BE ADDED TO THE FINE PRESCRIBED FOR THE VIOLATION AS A WARRANT FEE IN THE AMOUNT OF TEN DOLLARS ($10.00)." SECTION 2. ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH SHALL BE AND ARE HEREBY REPEALED TQ THE EXTENT OF CONFLICT HEREWITH. SECTION 3. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 11. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLICA- TION OF THE CITY OF CORPUS CHRISTI, BY PUBLISHING THE CAPTION OF THIS ORDINANCE, STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE. SECTION 5. THE NECESSITY TO IMMEDIATELY AMEND THE CORPUS CHRISTI CITY CODE TO ENCOURAGE COMPLIANCE WITH PARKING REGULATIONS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THEl7ili DAY OF NOVEMBER, 1971• ATT p O CITY SECRET MAYOR APPROVED- / / l THE CITY OF S CHRISTI, TEXAS r C.!,Tll ATTORNEY CORPUS CHRISTI, TEXAS �y DAY O �'" j 9 / TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI- NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
