HomeMy WebLinkAbout10574 ORD - 11/17/197111/17/71:e AN ORDINANCE CLOSING PORTIONS OF EASY CIRCLE, BEING THE _ NORTHWEST 1/3 OF THE EASY STREET CUL -DE -SAC, THE NORTHEAST 5.0 FEET, THE SOUTHWEST 5.0 FEET AND THE SOUTHEAST 100` FEET OF EASY STREET, AS SHOWN BY MAP OF KINGSWOOD ADDITION RECORDED IN VOLUME 24, PAGE 30, NUECES COUNTY MAP RECORDS; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing concerning the closing of portions of Easy Circle in Kingswood Addition was given by publication and registered mail to the last known addresses of the owners of property abutting said alley and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Meeting of the City Council of the City of Corpus Christi on Wednesday, September 15, 1971, in accordance with the provisions of the City Charter; and WHEREAS, it was determined at said hearing that it would best serve the public convenience and necessity to close said portions of Easy Circle; and WHEREAS, Application to Vacate a Portion of the Plat of Kingswood Addition, Corpus Christi, Nueces County, Texas,, was filed on the 8th day of November, 1971: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the portions of Easy Circle which are more fully hereinafter described, shown in red on the attached replat of a portion of Kingswood Addition (Exhibit A), being the Northewest 1/3 of the Easy Street cul -de -sac, the Northeast 5.0 feet, the Southwest 5.0 feet and the Southeast 110 feet of Easy Street (as shown by map of Kingswood Addition recorded in Volume 24, Page 30, Nueces County Map Records), is hereby closed for public use and abandoned to the owner of the abutting property, Trendomatic Corporation. 10574 In the event any reservation of easement herein made by this closing is nullified, invalidated or revoked by any legal authority or by final judgment of a court of competent juris- siction, this closure is thereby voided to the extent of such revocation or invalidation of easement. Those portions of Easy Circle which are hereby closed afr more fully described by metes and bounds, as follows: TRACT NO. 1 Being an irregularly shaped tract of land out of a portion of Easy Street as shown by Kingswood Addition recorded in Volume 24, page 30, Map Records of Nueces County, Texas, said irregularly shaped tract of land being more particularly described by metes and bounds as follows: Beginning at a point in the Northwest right of way line of said Easy Street and at the P.C. of a curve, said point being N. 290 00' E. 2.61 feet from the most easterly corner of Lot 12, Block 2, said Kingswood Addition for the most southerly and beginning corner of the tract herein described; Thence in a northerly direction with the arc of said curve to the left whose central angle is 38° 40' 57 ", and whose radius is 34.05 feet, a distance of 22.98 feet to a point the P.C.C. of curves for a corner; Thence in a northerly and northeasterly direction with a curve to the right whose central angle is 90° 00', and whose radius is 48.0 feet, a distance of 75.40 feet to a point, the most northerly corner of this tract; Thence S. 29° 00' W., a distance of 88.75 feet to the point of beginning; Containing 959.7 square feet of land more or less. TRACT NO. 2 Being an irregularly shaped tract of land out of a portion of Easy Street as shown by Kingswood Addition map recorded in Volume 24, page 30, Map Records of Nueces County, Texas, said irregularly shaped tract of land being more particularly described by metes and bounds as follows: Beginning at the most westerly corner of Lot 16, Block 2, said Kingswood Addition, and the P.C.C. of curves and in the North right of way line of said Easy Street for the beginning corner of the tract herein described; MOM Thence in a southeasterly direction with the arc of a curve to the left whose central angle is 38° 40' 57 ", and whose radius is 34.05, a distance of 22.98 feet to a point, the P.T. of said curve for a corner of this tract; Thence S. 610 00' E., with the northeast right of way line of said Easy Street, a distance of 212.04 feet to a point in the arc of a curve for the most easterly corner of this tract; Thence in a westerly direction with the arc of a curve to the right whose central angle is 15° 33' 00 ", and whose radius is 136.60 feet, a distance of 37.07 feet to a point the P.T. of said curve for a corner of this tract; Thence N. 61° 00' W., with a line that is 5.0 feet southwest of and parallel to the northeast right of -way .line of =said Easy Street, a distance of 196.70 feet to a point, the P.C. of a curve for a corner of this tract; Thence in a northerly direction with the arc or a curve to the right whose central angle is 90° 001, and whose radius is 10.0 feet, a distance of 15.71 feet to a point, the P.T. of said curve for a corner of this tract; Thence N. 29° 00' E., a distance of 8.63 feet to a point in the arc of the North cul -de -sac curve of said Easy Street for a corner of this tract; Thence in a southerly direction with the arc of said cul -de -sac curve to the right whose central angle is 14° 03' 36 ", and whose radius is 48.0 feet, a distance of 11.78 feet to the point of beginning; Containing 1285.8 square feet of land more or less. TRACT NO. 3 Being a strip of land out of a portion of Easy Street as shown by Kingswood Addition Map recorded in Volume 24, Page 30, Map Records, Nueces County, Texas, said strip of land being more particularly described by metes and bounds as follows: Beginning at a point in the southeast right of way line of said Easy Street and at the P.T. of a curve at the north part of Lot 6, Block 1, said Kingswood Addition for the beginning corner of the tract herein described; Thence N. 290 00' E., a distance of 5.0 feet to a point in the P.C. of a curve, for a corner of this tract; Thence in an easterly direction with the arc of said curve to the right whose central angle is 90° 00', and whose radius is 10.0 feet,a distance of 15.71 feet to a point, the P.T. of said curve for a corner of this tract; Thence S. 61° 00" E., with a line that is 5.0 feet northeast of and parallel to the southwest right of way line of said Easy Street, a distance of 186.60 feet to a point the P.C. of a curve for a corner of this tract. -3- Thence in a southeasterly direction, with the arc of said curve to the right whose central angle is 151 33' 00 ", and whose radius is 136.60 feet, a distance of 37.07 feet to a point in the existing southwest right of way line of said Easy Street for the most easterly corner of this tract; Thence N. 610 00' W., with the southwest right of way line of said Easy Street, a distance of 223.32 feet to a point, the P.C. of a curve for a corner of this tract; Thence in a westerly direction with the arc of a curve to the left whose central angle is 90 °00', and whose radius is 10.0 feet, a distance of 15.71 feet to the point of beginning; Containing 1106.0 square feet of land more or less. TRACT NO. 4 Being a tract of land out of a portion of Easy Street as shown by Kingswood Addition Map recorded in Volume 24, Page 30, Map Records, Nueces County, Texas, said tract of land being more particularly described by metes and bounds as follows: Beginning at a point in the Northwest right of way line of Whiteley Drive and at the P.C. of a curve at the east end of Lot 10, Block 1, said Kingswood Addition for the beginning corner of the tract herein described; Thence in a northerly direction with the arc of a curve to the left whose central angle is 90° 00 ", and whose radius is 20.0 feet, a distance of 31.40 feet to a point the P.T. of said curve in the southwest right of way line of said Easy Street for a corner of this tract; Thence N. 61° 00" W., with the southwest right of way line of said Easy Street, a distance of 90.0 feet to a point in the arc of a curve for the most westerly corner of this tract; Thence in a northeasterly direction with the arc of a curve to the left whose central angle is 73° 44' 24 ", and whose radius is 50.0 feet, a distance of 64.35 feet to a point, the P.T. of said curve, in the northeast right of way line of said Easy Street for the most northerly corner of this tract; Thence S. 610 00' E., with the Northeast right of way line of said Easy Street, a distance of 90.0 feet to a point, the P.C. of a curve for a corner of this tract; Thence in a northeasterly direction with the arc of a curve to the left whose central angle is 90 °00', and whose radius is 20.0 feet, a distance of 31.40 feet to a point, the P.T. of said curve in the north- west right of way line of said Whiteley Drive for a corner of this tract; Thence S. 29 °00' W., with the extension of the north- west right of way line of said Whiteley Drive across Easy Street, a distance of 100.0 feet to the point of beginning. -4- Containing 6505.8 square feet of land more or less. SECTION 2. The fact that the public convenience and necessity would be better served by the closing of the aforesaid portions of Easy Circle, creates a public emergency and an imper- ative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /110 day of November, 1971.
