HomeMy WebLinkAbout10580 RES - 11/24/197111/24/71 JRR Mc r ' A RESOLUTION REQUESTING THAT THE TEXAS STATE HIGHWAY DEPARTMENT CONSTRUCT, AS SOON AS PRACTICABLE, A PEDESTRIAN OVERPASS IN THE VICINITY OF RICHTER STREET AND ACROSS PADRE ISLAND DRIVE IN THE CITY OF CORPUS CHRISTI; DECLARING THE WILLINGNESS OF THE CITY OF CORPUS CHRISTI TO FURNISH ALL NECESSARY RIGHT -OF -WAY FOR SAID OVERPASS CONSTRUCTION AT ITS SOLE EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS IT IS THE FINDING OF THE CITY COUNCIL OF CORPUS CHRISTI THAT THERE EXISTS IN THE CITY A NEED FOR A PEDESTRIAN OVERPASS IN THE VICINITY OF RICHTER STREET AT PADRE ISLAND DRIVE, TO AFFORD CONVENIENT AND SAFE PASSAGE FOR SCHOOL CHILDREN AND SHOPPERS IN THE AREA ACROSS PADRE ISLAND DRIVE; AND WHEREAS IT IS THE FINDING OF SAID COUNCIL THAT THE TEXAS STATE HIGHWAY DEPARTMENT IS THE AGENCY OF PROPER JURISDICTION TO CONSTRUCT SUCH OVERPASS; AND WHEREAS IT IS THE FINDING OF SAID COUNCIL THAT IT WOULD BE PROPER FOR THE SAID CITY TO FURNISH, AT ITS SOLE EXPENSE, ALL RIGHT -OF -WAY NECESSARY FOR THE CONSTRUCTION OF SAID PROJECT; AND WHEREAS IT IS THE FINDING OF SAID COUNCIL THAT SAID OVERPASS SHOULD BE CONSTRUCTED AS SOON AS PRACTICABLE, A REAL NEED THEREFOR EXISTING, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE TEXAS STATE HIGHWAY DEPARTMENT IS HEREBY REQUESTED TO CONSTRUCT, AS SOON AS PRACTICABLE, A PEDESTRIAN OVERPASS IN THE VICINITY OF RICHTER STREET AND ACROSS PADRE ISLAND DRIVE IN THE CITY OF CORPUS CHRISTI. SECTION 2. THAT THE TEXAS STATE HIGHWAY DEPARTMENT BE HEREBY ADVISED THAT THE CITY OF CORPUS CHRISTI IS WILLING TO FURNISH ALL NECESSARY RIGHT -OF -WAY FOR SAID OVERPASS CONSTRUCTION AT ITS SOLE EXPENSE. SECTION 3. THE NECESSITY TO CONSTRUCT A PEDESTRIAN OVERPASS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING O 10580 CORPUS CHRISTI, TEXAS y a V DAY OF TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED,, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI- NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
