HomeMy WebLinkAbout10602 ORD - 12/08/197112- 1- 71:JKH � , ­'­111-91- 1— ­, .r .mv. _a___ ' '..,,.� ".. ­ - -1 .._.Q... ­1 ­1 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, AN EXTENSION AND AMENDMENT AGREEMENT.OF THE CONTRACT HERE- TOFORE ENTERED INTO BETWEEN THE CITY AND THE CORPUS CHRISTI CHAMBER OF COMMERCE FOR THE YEAR ENDING SEPTEMBER 30, 1971, FOR THE PURPOSE OF PROMOTING ADDITIONAL CONVEN- TIONS AND TO BETTER SERVE THE CONVENTIONS WHICH ARE AND WILL BE SCHEDULED FOR CORPUS CHRISTI, ALL AS MORE FULLY SET FORTH IN THE EXTENSION AND AMENDMENT AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, AN EXTENSION AND AMENDMENT AGREEMENT OF THE CONTRACT HERETOFORE ENTERED INTO BETWEENTHE CITY AND THE CORPUS CHRISTI CHAMBER OF COMMERCE FOR THE YEAR ENDING SEPTEMBER 301 1971, FOR THE PURPOSE OF PROMOTING ADDITIONAL CONVEN- TIONS AND TO BETTER SERVE THE CONVENTIONS WHICH ARE AND WILL BE SCHEDULED FOR CORPUS CHRISTI, ALL AS MORE FULLY SET FORTH IN THE EXTENSION AND AMEND- MENT AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THERE IS HEREBY APPROPRIATED THE SUM OF $24,000 OUT OF THE TOURIST AND CONVENTION DEVELOPMENT FUND TO SUPPORT THE FUNDING OF THIS CONTRACT. SECTION 3. THE NECESSITY TO ENTER INTO THE AFORESAID AGREEMENT AT THE EARLIEST PRACTICABLE DATE IN ORDER TO CARRY OUT THE INTENTIONS OF THE PARTIES IN THE PROMOTION OF CONVENTIONS FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDI- NANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT 10602 L 1 AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE filb DAY OF DECEMBER, 1971. ATTEST: ` 1 CITY $EGRET RY V//, MAYOR THE CITY OF Cg CHRISTI, TEXAS VED: A // �c++ nAY OF DECEMBER, 1971: TY ATTORNEY :HG:VMP THE STATE OF TEXAS j COUNTY OF NUECES j THE AGREEMENT DATED THE 24TH DAY OF OCTOBER, 1965, BETWEEN THE CITY OF CORPUS CHRISTI AND THE CORPUS CHRISTI CHAMBER OF COMMERCE IS HEREBY EXTENDED FOR A PERIOD OF TWELVE (12) MONTHS FROM THE EXPIRATION DATE THEREOF OF SAID CONTRACT TO -WIT: SEPTEMBER 30, 1971, UNTIL SEPTEMBER 30, 1972, PRO- VIDED, HOWEVER, THAT PARAGRAPH 1 OF SECTION B, PROVIDING FOR REIMBURSEMENT NOT TO EXCEED THIRTY -SIX THOUSAND DOLLARS ($36,000) AS AMENDED FOR THE YEAR SEPTEMBER 30, 1970, UNTIL SEPTEMBER 30, 1971, TO READ "THIRTY -FIVE THOUSAND DOLLARS 035,000)," IS AMENDED TO THE EFFECT THAT THE CITY WILL COMPENSATE SAID CHAMBER FOR PROFESSIONAL SERVICES IN THE AMOUNT NOT TO EXCEED TWENTY - FOUR THOUSAND DOLLARS ($2,000). SAID AGREEMENT IS FURTHER AMENDED BY AMENDING SECTION A, PARAGRAPH 3 TO READ AS FOLLOWS: „3. THAT THE PROFESSIONAL SERVICES PROVIDED UNDER THIS CONTRACT WILL BE SUPERVISED BY THE EXECUTIVE VICE PRESIDENT OF THE CHAMBER." SAID AGREEMENT IS FURTHER AMENDED AS FOLLOWS: DELETE PARAGRAPH 4 OF SECTION A; DELETE SUBSECTION (H) OF SECTION C; SUBSTITUTE IN SECTION D THE FIGURE $24,000 FOR THE FIGURE $35,000 WHEREVER IT APPEARS IN SAID SECTION; DELETE IN SECTION D ALL REFERENCES -TO "CONVENTION MANAGER" WHEREVER IT APPEARS IN THAT SECTION. EXCE'P'T AS HEREIN EXPRESSLY PROVIDED, ALL OTHER PROVISIONS OF THE SAID OCTOBER 24, 192, AGREEMENT HERETOFORE ENTERED INTO ARE HEREBY CONTINUED IN FULL FORCE AND EFFECT.
