TIONS SET FORTH IN THE BID INVITATION, INSTRUCTIONS TO
BIDDERS, BID SPECIFICATIONS, AND DETAILED PROJECT DESCRIP-
TION, ATTACHED HERETO AS EXHIBITS "A ", "B ", "C" AND "D",
RESPECTIVELY, UNDER DATE OF SEPTEMBER 21, 1971, AND IN-
CORPORATED HEREIN; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI,
A CONTRACT WITH EASTMAN KODAK COMPANY —BSMD FOR THE FURNISHING AND INSTALLA-
TION OF A COMPLETE AND READY —TO— OPERATE AUTOMATIC MICROFILM RETRIEVAL SYSTEM
FOR THE POLICE DIVISION OF THE CITY OF CORPUS CHRISTI, TEXAS, IN ACCORDANCE
WITH THE SPECIFICATIONS SET FORTH IN THE BID INVITATION, INSTRUCTIONS TO

SECTION 2. THE NECESSITY TO IMMEDIATELY EXECUTE THE AFORESAID
CONTRACT IN ORDER TO INSTALL AND PUT INTO OPERATION THE MICROFILM RETRIEVAL
SYSTEM FOR THE POLICE DIVISION OF THE CITY CREATES A PUBLIC EMERGENCY AND
IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE
THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE
SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SU4H
EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF
THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF

INSTRUCTIONS TO BIDDERS
It is the intent of this invitation to solicit offer from qualified bidders to
provide the City of Corpus Christi, Texas, with an Automatic Microfilm Retrieval
System reflecting the current state of the art. The system must be designed to
meet the immediate needs of the City's Police operation and have the flexibility
for future expansion.
All bidders are to attach a detailed description of the system they propose to
furnish. All detailed job engineering of the entire system, installations, and
tests shall be performed by the contractor. The Contractor shall assume respons-
ibility for the performance, quality of work and the meeting of installation
schedules and shall be subject to inspection by a•duly authorized representative
of the City who will be solely responsible for the acceptability of the work
performed and of equipment performance.
The successful bidder will be required to have the entire system outlined'in
this invitation to bid engineered, installed, tested, approved and ready for
operation within 60 calendar days after the signing of the contract.
INSTRUCTIONS TO BIDDERS

SIGNATURE TO BIDS: Each bid must give the full business address of the bidder and be signed by him with his usual

ship or by an authorized representative with the designation of the person signing. Bids by corporations or companies
must show the legal name of the corporation or company and be signed by the president or other persons authorized to
bind it in the matter, with his designation. The name of the person signing shall also be typed or printed below his
signature, if the bid is signed in a capacity other than an individual, partner, owner, or as president, vice- president,
secretary, or treasurer of a company, or corporation, satisfactory evidence of the authority of this person signing, in
behalf of the principal should be furnished with the bid, unless such authority has previously been furnished the con-
tracting officer issuing the invitation. All bid sheets on which bids are submitted and applicable certificates will be
manually signed by the person signing the bid. Other sheets of the invitation must show the bidder's name, which may be
manually signed, typed, printed, or stamped.
MARKING AND MAILING OF BIDS: Bids, with their guarantees, must be securely sealed in suitable envelopes, addressed and
marked on e outside as required by the invitation. Bids with insufficient postage will not be acepted. Bids (including
deposit or bond when required) must be mailed in sufficient time to arrive and be in the hands of the City Purchasing Agent

WITHDRAWAL OF BIDS: Bids may be withdrawn on written or telegraphic request received from bidders prior to the time fixed
or open ng. Neg igence on the part of the bidder in preparing the bid confers no right for the withdrawal of the bid.

GENERAL SALES TERMS AND CONDITIONS
INSPECTION: Bidders are invited and urged to inspect the property (when applicable) prior to submitting bids. Property

furnish any labor for such purpose. In no case will failure to inspect constitute grounds for a claim or for the with-
drawal of a bid after opening.
CONSIDERATION OF BIDS: The City reserves the right to reject any or all bids, to waive any 'technical defects in the bids,
and unless otherwise sped ffed by the City or by the bidder, to accept any one item or group of items to the bid as may
be in the best interest of the City. Unless otherwise specified, bids must be submitted on the basis of the unit specified
for the item to the Invitation, and bids may be submitted on any or all ltema. In case of error in the extension of prices
in the bid, the unit prices will govern. ,
BID GUARANTEE: The bidder agrees that the bid will not be withdrawn within 60 calendar days next following the date of
open ng un ess afferent period be specified by the bid notice), and will during that time remain firm and irrevocable.
If a bid deposit or bond is required, the bid must be a
ccompaned by same. In the event of any default by the bidder or
any failure by the bidder to comply with all terms and conditions of this contract, the deposit or bond made by the bidder
may be forfeited to the City as liquidated damages. Deposits on rejected and /or unsuccessful bids will be returned to
bidder by mail. I
ADIUBTMENT FOR VARIATION IN QUANTITY OR HEIGHT: Any variation between the quantity or weight listed for any item and the
quart ty or we t o su taco ten re or delivered to the City will be adjusted on the basis of the unit price quoted
for such item.
VERBAL MODIFICATIONS: Any oral statement by any representative of the City, modifying or changing any conditions of this
contract, t�ression of opinion only and confers no right upon the seller.
DISPUTES: Except as otherwise specifically provided in this contract, all questions of fact involved in disputes arising
un7er�tiis contract shall be decided by the City, whose decision uppon said facts shall be final and conclusive upon the
parties, subject to written appeal by the Vendor within thirty (30) days to the City Manager or his duly authorized
representative, whose decision on said facts shall be final and conclusive upon the parties hereto. In the meantime, the
Vendor shall diligently proceed with performance.
DEFINITIONS: (a) The term "his duly authorized representative" shall mean any person or persons, other than the centracting
officer. er. autAorized to act for him, or any board set up in accordance with regulations and empowered to act.
(b) The tens "contracting officer" as used herein shall include his duly appointed successor and his duly
authorized representative.
EQUAL OPPORTUNITY EMPLOYER: Every contractor must agree that, during the performance of its contract, it will:
(a) Treat all applicants and employees without discrimination as to race, color, religion, sex, or

(b) Identify itself as an equal opportunity employer in all help wanted advertising or requests.
The contractor Is hereby advised that any complaints filed with the City alleging that a contractor is not an equal
opportunity employer during the 6 months preceding the date of receipt of bids will be referred to the Human Relations
Commission, through its Human Relations Administrator, for the purpose of review and recommendations. The report of the
Noonan Relatl ons Commission will be transmitted to the Purchasing Agent or the Director of Public Hooks who will include a
summary of such report with any future bid award recommendations for which the contractor is a bidder and bring to the
attention of the City Council any such report received prior to the issuance of authority to deliver or a work order to
any such contractor. A copy of this report shall be sent to the contractor. The Human Relations Administrator will follow
up any such re port and bring to the attentton of the Commission any further action by the contractor which would include
that the findings of the Commission should be modified. Any such modified findings of the Commission will be delivered to
the Dire ctor of Public Works or Purchasing Agent with a copy to the contractor and be Included in any future bid award
recom andations.
The City Council reserves the right to consider such reports In determining the best bid and to, an the basis of such report,
terminate any portion of a contract for which work orders or authorities to deliver have not been issued. However, the
contractor 6 specifically advised that no equal opportunity employment complaint will be the basis.for cancellation of
any contract for which authority to deliver has been granted or a work order issued,

DELAYS AND EXTENSIONS OF TIME: If the contract is delayed at any time in the delivery
of the supplies, materials, equipment, and services by any act of neglect of the City
or any employee of the City; or by any separate contractor employed by the City; or by
changes ordered in the supplies, materials, equipment and services; or by strikes,
fires, unavoidable casualties; or by delay authorized by the City, the City shall
decide the extent of such delay or the justification of any other delay, and the time
of completion may be extended for such reasonable time-as the City may decide. Any
extensions must be accomplished by mutual agreement, in writing.
PREPARATION OF BIDS: Bidders are expected to examine the specifications, schedule and
all instructions. Failure to do so will be at the Bidder's risk. Each bidder shall
furnish the information required by the specification. Erasures or other changes must
be initialed by the person signing the bid.' Bids signed by an agent must be accompanied
by evidence of his authority.
Unit price for each unit bid on shall be shown and such price shall include packing and
shipping, unless otherwise specified. Unit price and extended total shall be shown for
each bid item. In case of error in extension of price, the unit price will govern and
the total prices adjusted accordingly.
Bidder must submit schedule of equipment deliveries and timetable for installation of
equipment, such timetable to be stated in days elapsed time from date of contract award.
Telegraphic bids will not be authorized.
FAILURE TO DELIVER: In the event the contractor fails to deliver any of the supplies,
materials, equipment and services covered by the contract and in accordance with the
delivery dates stipulated in the contract, then the City shall have the right to
purchase on the open market any of the supplies, materials, equipment and services
covered in the bid proposal and shall deduct as liquidated damages any additional costs
incurred by the City as a result of such failure to delivery from any money due the
successful bidder under the contract.
ADDENDA: Any addenda issued after the invitation to bid and before the opening of bids
shall be covered in the proposal and, in closing the contract, they will become a part
thereof.
BID ENVELOPE: Bids shall be returned to City of Corpus Christi Purchasing Division in
the enclosed bid envelope.
TERMS: The contractor shall include terms of payment in his proposal, and such terms
shall be an item for consideration in bid award.
EXPERIENCE OF THE CONTRACTOR: Bids will be accepted only from companies regularly
engaged in Microfilm Retrieval Systems for a period of 3 years.
CERTIFICATION: Signing and certification of the proposal shall be made by an authorized
officer of the proposing company.
ADDITIONAL PURCHASES: The City reserves the right to purchase up to 50% of any supply
item quantities in this specification at the original bid price for a period of one year
following completion of contract. .

PAYMENT: Final payment will be made only after the acceptance of.the completed system
by the representative designated to act as an agent for the City's Purchasing Division.
EVALUATION Or BID PROPOSALS: Evaluation of the system and equipment offered will be
made by a duly authorized representative of the City who shall be sole judge thereof
and who shall consider the following among other things, but not necessarily in the
order presented herein:
a. Whether or not equipment meets specifications and /or requirements.
b. Quality of workmanship and materials used.
c. Ease of servicing and adjustment of equipment.
d. Any superior design features advantageous to the system.
e. Equipment performance.
f. Maintenance expense based on buyer's experience.and information
from other users of equipment offered.
g. Ease of installation and removal of equipment.
h. Evidence of ability to perfprm the work required.
i. Evaluation of proposed system, equipment and performance values.
BRAND NAMES AND NUMBERS: The showing of brand names and numbers by the bidder to define
equipment offered shall indicate that such equipment is functionally equal to, or exceeds,
minimum requirements shall be shown in detail'by the bidder as part of the bid.
CURRENT PRODUCTION EQ.UIR ENT: Only new, unused equipment in current production by
manufacturers with at least 3 year's experience in this field will be considered. The
equipment offered shall be of the latest design in current production by the contractor
and as free from obsolescence as possible.

SPECIFICATION:
This is a high speed film reader- printer with logic package
used to locate, display and print, all automatically at high
speeds, any document image committed to the microfilm system.
To accept magazine loaded microfilm and search at the rate of
ten feet per second. Keyboard Control unit to control the
operation of the reader - printer, push buttons to control power,
search, stop, rewind, and single image positioning both forward
and reverse. An image stop position control to allow proper
alignment of image or display screen. Individual controls to
allow the operator to select print mode, check for parity
errors, and designate positive or negative film search.

DETAILED PROJECT DESCRIPTION
A. GOALS:
1. Problems
a. Currently, there is no complete mug book in the Corpus Christi
Police Department from which a victim or witness to a crime can
identify the suspect. Unless the investigating officer can
recognize the suspect from the description given, identification
is virtually impossible from muc shots.
b. A complete mug book on all known offenders is effective, but it
has severe limitations. After looking at several, the witness
tires and his ability to identify the suspect is greatly reduced.
c. Time required to search the fingerprint file when a latent print
is lifted at the scene of a crime is often several days with
conventiondl-search methods. 'This delay in identification can
cause a much longer delay in apprehension of the suspect.
2. Target Groups
The target is to provide law enforcement agencies in the Coastal Bend
with the ability to retrieve information through any one of many
descriptors.
3. Aims
a. This project will allow local law enforcement agencies to establish
and search a comprehensive mug shot file by describing the suspect.
The system will be selective, in that only criminals answering
the physical description of the suspect will be retrieved for
identification by the victim or witness. This faster, more accurate
system for identification of criminals should significantly reduce
the time required for their apprehension.
b, In addition, the rapid retrieval of all similar fingerprints for
comparison with that of a latent lifted from the scene of a crime

will allow the identification officer to make this search in 10
percent of the time currently required. This faster identification
will be a major factor in reducing time.required to apprehend the
suspect.
For example, the Atlanta Police Department in Atlanta, Georgia has
found that a 10 hour search of their fingerprint file has been
reduced to 30 minutes, upon implementation of a similar system.
We know that the longer a person is free after committing a
crime, the less chance there is of there is of apprehension and
the greater the chances of his committing another crime. We feel
that such a system will provide a similar increase in the efficiency
of our department.
B. METHODS:
Phase I
The 14000 fingerprint.cards currently on file in Corpus will be
coded and microfilmed. It will be the job of one'identification'
officer to spend 80 percent of his time to see that all prints
°arc °properly coded with the three digit code required for input
to the MIRACODE System (See Page 51). He will be assisted by six
other identification officers who will devote 10 percent of their
time to the project.
After coding, the fingerprint cards will be microfilmed with proper
coding by one full time file clerk. She will process the exposed
film also.
One Records Supervisor (steno) will spend 50 percent of her time
updating magazines and retrieving information from the system.
The entire process of encoding and filming backlog should take
one year.

Phase II
Mug shots will be pulled from jackets by a second full -time file
clerk and coded as to physical description of the offender (See
page 5J, K and Q.
The identification supervisor will oversee this portion of the system
and will be aided by one identification lieutenant in this function.
The seed of input will allow one microfilm operator to keep up with
both Phase I and Phase II of the Project simultaneously. Both Phase I
and II should be completed within a period of one year.
Phase III
Once the backlog is input to the system, the daily updating of the
system will be accomplished by a clerk in a very short.period of
time (a couple of hours) on a daily basis. The rest of the time,
she will retrieve information.
