HomeMy WebLinkAbout10622 ORD - 12/15/197112:15:71:jkh TEXAS: AN ORDINANCE REPEALING ORDINANCE NO. 10578, PASSED AND APPROVED BY THE CITY COUNCIL ON NOVEMBER 24, 19.71; A.'PROPRI- ATING OUT OF THE NO. 220 STREET BOND FUND $1,791.75 TO SUPPLEMENT FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 10410 FOR REIMBURSEMENT TO THE DEVELOPER, BUFORD NICHOLSON, AS THE CITY'S PORTION OF COST TO CONSTRUCT A BRIDGE IN BRIARWOOD SUBDIVI- SION, UNIT I, PROJECT NO. 220 -70 -125; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. Ordinance No. 10578, passed and approved by the City Council on November 24, 1971, is hereby repealed in its entirety. SECTION 2. There is hereby appropriated out of No. 220 Street Bond Fund the sum of $1,791.75, to supplement funds previously appropriated by Ordinance No. 10410, passed and approved by the City Council on August 11, 1971, for reimbursement to the developer, Buford Nicholson, as the City's portion of cost to construct a bridge in Briarwood Subdivision, Unit I, applicable to Project No. 220 -70 -125. SECTION 3. The sum appropriated shall be paid to Buford Nicholson, or his duly authorized representative, contemporaneous with delivery to the City Secretary of a duly executed Release, in the form made in Exhibit 'W', annexed hereto and made a part hereof. SECTION 4. The necessity to appropriate the hereinabove described sums and to make reimbursement to the developer as promptly as possible creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the �STLtJ day of December, 1971. t ATTEST* Q4C413Z r Ci y Secre a y MAYOR THE CITY OF CORP U C ISTI, TEXAS APPRO 10622 ,Ci Attorney 12- 15- 71:jkh THE STATE OF TEXAS X KNOW ALL MEN BY THESE PRESENTS: COUNTY OF NUECES X That BUFORD NICHOLSON and his heirs, executors, administrators, and assigns, in consideration of the sum of One Thousand Seven Hundred Ninety -One and Seventy -Five One- Hundredths ($1,791.75) Dollars lawful money of the United States of America, to me in hand paid by the CITY OF CORPUS CHRISTI, a home rule city, municipal corporation and body politic under the laws of the State of Texas, the receipt of which is hereby acknowledged, has remised, released, and forever discharged and by these presents does for myself, my heirs, executors, administrators, and assigns, remise, release, and forever discharge the said CITY OF CORPUS CHRISTI, its successors and assigns, of and from all debts, charges, demands, actions, suits, agreements, damages, claims and liabili- ties whatsoever that they might now have or that might subsequently accrue to them by reason of any manner or thing whatsoever growing out of or in anywise connected with, directly or indirectly, the acquisition, preparation, design, engineering, and construction of the bridge in Briarwood Subdivision, Unit I, in the City of Corpus Christi, Nueces County, Texas, and any and all contracts, oral or written, appertaining thereto. IN WITNESS WHEREOF, BUFORD NICHOLSON has hereunto set his hand in triplicate originals this the day of December, 1971.
