AN ORDINANCE
APPROVING AND ADOPTING THE WRITTEN STATEMENT AND REPORT
OF THE DIRECTOR OF ENGINEERING SERVICES, SHOWING ESTIMATES
OF VARIOUS COST FOR THE IMPROVEMENT OF:
1. East Shoreline Boulevard (West side only) from Laguna
Street to Cooper Street, thence from Kinney Street
southward approximately 600 L.F., thence from Park
Avenue southward approximately 235 L.F.
2. West Shoreline Boulevard (East side only) from Laguna
Street to Cooper Street, thence front Kinney Street
southward approximately 640 L.F., thence from Park
Avenue southward approximately 180 L.F.
3. West Shoreline Boulevard (West side only) from Cooper
Street to Born Street„ thence from 181 L.F. South of
Born Street to Park Avenue, thence from 270 L.F. South
of Park Avenue to Furman Avenue.
4. Cooper Street (South side only) from West Shoreline
Boulevard westward approximately 200 L.F. to the
existing sidewalk.
5. Kinney Street (North side only) from West Shoreline
Boulevard to Water Street.
6. Born Street (North side only) from West Shoreline
Boulevard westward approximately 36 L.F.
7. Broadway Court (both sides) from West Shoreline Boule-
vard to Water Street.
IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; DETER-
MINING AND FIXING THE PORTION OF SAID COST TO BE PAID AND
ASSESSED AGAINST ABUTTING PROPERTY, THE PORTION THEREOF TO
BE PAID BY THE CITY OF CORPUS CHRISTI; DETERMINING THE NECES-
SITY OF LEVYING AN ASSESSMENT AGAINST SAID ABUTTING PROPERTY; Y
ORDERING AND SETTING A HEARING TO BE HELD WEDNESDAY,
FEBRUARY 2, 1972 AT 3:00 P.M. IN THE COUNCIL CHAMBER, TO GIVE
NOTICE OF SAID HEARING AS REQUIRED BY THE LAWS OF THE STATE
OF TEXAS AND THE CHARTER OF THE CITY OF CORPUS CHRISTI; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Council of the City of Corpus Christi,
Texas, hereby finds and determines:
(a) That the City Council has heretofore, by ordinance, ordered the
construction of sidewalks on the hereinafter named streets in the City of
Corpus Christi, Texas, within the limits defined:
1. East Shoreline Boulevard (West side only) from Laguna
Street to Cooper Street, thence from Kinney Street
southward approximately 600 L.P., thence from Park
Avenue southward approximately 235 L.F.
2. West Shoreline Boulevard (East side only) from Laguna
Street to Cooper Street, thence from Kinney Street

Street to Born Street, thence from 181 L.F. South of
Born Street to Park Avenue, thence from 270 L.F. South
of Park Avenue to Furman Avenue.
4. Cooper Street (South side only) from West Shoreline
Boulevard westward approximately 200 L.E. to the
existing sidewalk.
S. Kinney Street (North side only) from West Shoreline
Boulevard to Water Street.
6. Born Street (North side only) from West Shoreline
Boulevard westward approximately 36 L.F.
7. Broadway Court (both sides) from West Shoreline
Boulevard to Water Street.
and in the manner and according to the plans and specifications therefor,
which said plans and specifications have been approved and adopted by the
City Council.
(b) That a Notice duly enacted in the name of the City of Corpus
Christi, Texas, of the enactment of the said above described ordinance, has
heretofore been filed with the County Clerk of Nueces County, Texas, the County
in which the City of Corpus Christi is situated, and such Notice has been
duly recorded in the Deed of Trust Records of Nueces County, Texas.
(c) That the City Council of the City of Corpus Christi, Texas,
has caused the Director of Engineering Services to prepare and file estimates
of the costs of such improvements, and estimates of the amount per front foot
to be assessed against the property abutting said sidewalks; and the Director of
Engineering Services has heretofore filed said estimates and a statement of
other matters relating thereto with said City Council, and the same having been
received, examined and approved by said City Council; and that in accordance
with said statement of the estimate so filed by the Director of Engineering
Services and herein approved, the amount of said estimated costs are herein
approved, and the amount of said estimated costs are hereinafter stated and
set out and a schedule contained in Section 2 hereof.
SECTION 2. The written statement and report of the Director of
Engineering Services heretofore filed with the City Council, showing the
estimated total costs of the construction of said sidewalks, showing the amounts,
per front foot proposed to be assessed against the abutting property and against
the real and true owners thereof for said improvements, showing total estimated
cost of the construction of said sidewalks proposed to be assessed against and

paid to the City of Corpus Christi by the abutting property and the real and
true owners thereof to reimburse the said City for a portion of the costs of
said improvements and showing the total estimated cost of said improvements,
having been received and examined by the City Council said report and the
estimates therein shown are hereby in all things approved and adopted; and it
is hereby found and determined by the said City Council that the estimated
costs of said improvements as above described on said streets are as follows,

SIDEWALK IMPROVEMENTS FOR DOWNTOWN AREA AND
CITY RUL PARKING LOT EXPANSION
ASSESSMENT ROLL
December 21, 1971
This project shall be known as Sidewalk Improvements for Downtown Area
and City Hall Parking Lot Expansion and it consists of the construction
of concrete sidewalks in the downtown area of the City. The project
also includes the expansion of the City Hall parking lot.
The sidewalk portion of the project proposes walks 6' wide either tied
or away from the curb along a number of downtown locations as listed
below. The walks are 4" thick and include reinforcing steel.
The locations are as follows:
(1.) East Shoreline Boulevard (West side only) from Laguna Street
to Cooper Street, thence from Kinney Street southward approx-
imately 600 L.F., thence from Park Avenue southward approxi-
mately 235 L.F.
(2.) West Shoreline Boulevard (East side only) from Laguna Street
to Cooper Street, thence from Kinney Street southward approx-
imately 640 L.F., thence from Park Avenue southward approxi-
mately 180 L.F.
(3.) West Shoreline Boulevard (West side only) from Cooper Street
to Born Street, thence from 181 L.F. South of Born Street to
Park Avenue, thence from 270 L.F. South of Park Avenue to
Furman Avenue.
(4.) Cooper Street (South side only) from West Shoreline Boulevard
westward approximately 200 L.F. to the existing sidewalk.
(5.) Kinney Street (North side only) from-West Shoreline Boulevard
to Water Street.
(6.) Born Street (North side only) from West Shoreline Boulevard
westward approximately 36 L.F.
(7.) Broadway Court (Both sides) from West Shoreline Boulevard to
Water Street.
The assessment rates have been determined by using the unit bid price as
submitted by Asphalt Paving Company and applying this rate to the front
footage of abutting property.
1.) 6' wide sidewalk $0.60/S.F.

SECTIO14 3. THE COST OF SAID IMPROVEMENTS SHALL BE PAID AS
FOLLOWS TO -WIT:
(A) THE CITY SHALL REIMBURSE ITSELF FOR NOT MORE THAN 8V OF
THE COST OF THE IMPROVEMENTS BY ASSESSMENT AGA114ST THE RESPECTIVE ABUTTING
PROPERTIES AND THE REAL AND TRUE OWNERS THEREOF IN ACCORDANCE WITH THE
'PROVISIONS OF ARTICLE 11058, VERNON'S TEXAS CIVIL STATUTES. NO ASSESSMENTS
SHALL BE MADE AGAINST ANY ABUTTING PROPERTY OR THE REAL AND TRUE OWNERS
THEREOF FOR COSTS IN EXCESS OF THE BENEFITS TO SUCH PROPERTY IN ENHANCED
VALUE THEREOF BY MEANS OF SUCH IMPROVEMENTS. THE AMOUNTS OF SUCH ASSESS-
MENTS SHALL C014STITUTE A FIRST AND PRIOR LIEN UPON ALL SUCH PROPERTIES AND
A PERSONAL LIABILITY OF THE REAL AND TRUE OWNERS THEREOF, WHETHER' NAMED
OR CORRECTLY NA14ED OR NOT. ASSIGNABLE CERTIFICATES IN EVIDENCE OF THE
ASSESSMENTS SO LEVIED SHALL BE ISSUED IN FAVOR OF THE CITY OF CORPUS
CHRISTI FOR THE AMOUNT OF THE ASSESSMENT. SAID PAYMENTS SHALL BE PAYABLE
IN IIONTHLY•INSTALLI4F.NTS OE 140T EXCEEDING TWENTY -FOUR (I$) IN NUMBERS SAID
PAYMENTS TO BE MADE AT THE CITY HALL IN THE CITY OF CORPUS CHRISTI, NUECES
COUNTY, TEXAS, THE FIRST OF 11I1ICH SHALL BE PAYABLE WITHIN THIRTY (30) DAYS
FROM THE DATE OF THE COMPLETION OF SAID IMPROVEMENTS AND THEIR ACCEPTANCE
BY THE CITY OF CORPUS CHRISTI, A14D ONE INSTALLMENT EACH MONTH THEREAFTER
UNTIL PAID WITH INTEREST THEREON AT THE RATE OF SIX AND ONE -HALF PERCENT
(6-1/2 %) PER ANNUM PAST DUE PRINCIPAL AND INTEREST TO BEAR INTEREST AT
THE SAME RATE. PROVIDED, HOWEVER THAT THE OWNERS OF ANY OF SAID PROPER-
TIES SHALL HAVE THE PRIVILEGE OF PAYING ALL OR ANY OF SAID INSTALLMENTS
AT ANY TI14E BEFORE 14ATURITY THEREOF BY PAYING THE TOTAL AMOUNT OF PRINCIPAL

OF THE OWNER BE UNKNOWN, IT,SHALL BE SUFFICIENT TO SO STATE THE FACT, AND
IF SAID ABUTTING PROPERTY BE OWNED BY AN CSTATE� BY ANY FIRM OR CORPORATION,
IT SHALL BE SUFFICIENT TO SO STATE THE FACT, AND IT SHALL BE UNNECESSARY
TO GIVE THE CORRECT NAME OF ANY SUCH OWNER AND NO ERROR OR MISTAKE IN
ATTE14PTING TO NAME SUCH OWNER OR IN DESCRIBING ANY OF SAID PROPERTY SHALL.
INVALIDATE ANY ASSESSMENT OR CERTIFICATE ISSUED IN EVIDENCE THEREOF; BUT
NEVERTHELESS, THE REAL AND TRUE OWNERS OF SAID ABUTTING PROPERTY SHALL
BE LIABLE AND THE ASSESSMENT AGA114ST SAID ABUTTING PROPERTY SHALL BE

SECTION 6. EACH PORTION OF SAID STREETS HEREINABOVE DESCRIBED
AND DESIGNATED BY UNIT NUMBERS CONSTITUTES A SEPARATE AND INDEPENDENT
UNIT OF THE 114PROVEMENTS AND SHALL BE IMPROVED A14D THE IMPROVEMENTS CON-
STRUCTED THEREIN AS SEPARATE AND INDEPENDENT FROM EACH AND EVERY OTHER
UNIT OF SAID STREETS, ANO THE ASSESSMENTS TO BE LEVIED FOR SAID IMPROVE-
' MENTS IN EACH UNIT OR PORTION OF SAID STREETS SHALL BE ALTOGETHER' SEPARATE

SAID UNITS SHALL BE CONSIDERED OR HAVE ANY EFFECT UPON THE OTHER, ALL AS
FULLY_AND TO THE SAME EXTENT AS IF SEPARATE PROCEEDINGS AND CONTRACTS HAD
BEEN HAD AND EXECUTED WITH REFERENCE TO THE IMPROVCMENTS TO BE MADE IN

WITHOUT DELAY CREATES AN EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF TIIE CHARTER RULE THAT NO ORDINANCE. OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH -
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL 14EETINGS OF THE
CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY
TO EXIST, AND HAVING REQUESTED THAT SUCH CHARTER'RULE BE SUSPENDED AND
THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE -OF ITS INTRODUCTION AND
