AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH
OSO BAY LIMITED, DEVELOPERS OF PHARAOH VALLEY, CARRIAGE
PARK TOWNHOUSE EAST, FOR PARTICIPATION IN OVERSIZING AND
EXTRA DEPTH FOR A SANITARY SE14ER LINE IN McARDLE ROAD
ACCORDING TO THE MASTER PLAN; APPROPRIATING OUT OF THE
SANITARY SEWER BOND FUND, NO. 250, THE SUM OF $5,925, OF
WHICH $5,530.50 IS FOR OVERSIZING AND EXTRA DEPTH, AND
$394.50 IS FOR ENGINEERING, ALL APPLICABLE TO PROJECT
NO. 250- 67 -54; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be, and he is hereby, authorized
to execute a contract with Oso Bay Limited, developers of Pharaoh Valley,
Carriage Park Townhouse East, for participation in oversizing and extra
depth for a sanitary sewer line in McArdle Road, according to the Master
Plan, all as is more fully set forth in the Contract, a copy of which is
attached hereto, marked Exhibit "A" and made a part hereof.
SECTION 2. There is hereby appropriated out of the Sanitary Sewer
Bond Fund, No. 250, the sum of $5,925, of which $5,530.50 is for oversizing
and extra depth, and $394.50 is for engineering, all applicable to Project
No. 250- 67 -54.
SECTION 3. The necessity to authorize the execution of the afore-
said contract and to appropriate the necessary sums in order that the con-
struction of the oversize and overdepth sanitary sewer line in McArdle
Road may be commenced without delay creates a public emergency and an impera-
tive necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction but
that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared such emergency and
necessity to exist, and having requested the suspension of the Charter
rule and that this ordinance be passed finally on the date of its intro-
duction and take effect and be in full force and effect from and after its

AGREEMENT
THE STATE OF TEXAS
COUNTY OF NUECES
This agreement is authorized by Ordinance No. and is
entered into between the City of Corpus Christi, Texas, ( "Party of the First
Part ") hereinafter called "City ", and Oso Bay Limited, ( "Party of the Second
Part ") being referred to as "Developer ", and pertains to the City's share of
the cost for improvements when City participation is set forth in the Platting
Ordinance and for improvements required by the City over and above -those set
forth in the Platting Ordinance in the development of Pharaoh Valley, Carriage
Park Townhouse East Subdivision.
NOW, THEREFORE, the City and the Developer agree as follows:
1. The Developer will construct a 15" vitrified clay sanitary sewer
line and appurtenances as approved by the Director of Engineering Services and
located in McArdle Road. This construction will be contracted for and financed
by the Developer.
2. The City agrees to reimburse the Developer as its share for the cost
of the above stated construction, including engineering, the sum of Five
Thousand, Nine Hundred and Twenty -Five Dollars. Such reimbursement will be
made by the City to the Developer upon completion and acceptance of the improve-
ments by the City.
3• The Developer agrees to indemnify the City against any claims arising
as a result of the project.
4. This agreement shall be executed in duplicate, both of which shall
be considered one instrument. When both of the duplicates have been executed
by the City, and at least one duplicate has been executed by the Developer, this
agreement shall become effective and shall be binding upon and shall inure to
the benefit of the parties hereto and their respective heirs, successors and
assigns.
