" _ — AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF (HERBERT -ALEXANDER-,SBY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT "A ", BEING LOT 1, BLOCK 2, STODDART -SMITH SUBDIVISION, UNIT #1, AND A 6.3 -ACRE AREA OUT OF LOT 9, SECTION 49, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "R -2" TWO FAMILY DWELLING DISTRICT, AND CHANGING THE ZONING ON TRACT "B ", BEING ALL OF LOT 12, BLOCK 2, AND LOTS 1 THROUGH 6, BLOCK 3, STODDART -SMITH SUBDIVISION, UNIT #1, .AND A 4.6 7ACRE TRACT OUT OF LOT 9, SECTION -49, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "A -1" APARTMENT HOUSE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. k WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Herbert Alexander for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on January 12, 1972, at Regular Council Meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its cifizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution 10667 Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. SECTION 2. That the zoning of the hereinafter described tracts or parcels of land be and the same is hereby changed as hereinafter set forth: TRACT A A tract or parcel of land consisting of 6.3 acres, more or less, out of Lot 9, Section 49 of Flour Bluff and Encinal and Farm and Garden Tracts in Nueces County, Texas, consisting in part of Lot 1, Block 2, Stoddart Smith Subdivision Unit 1, as recorded by map filed in - V61ume`23, "Page'9 of the map records of said County: Beginning at the southeast corner of said Lot 1, Block 2, for the southeast corner and point of beginning of this tract; Thence with the easterly boundary line of Lot 1 and its projection N. 29° E. 1130 feet, more or less, to the center line of a proposed 60 foot street for the north- east corner of this tract; Thence with said center line N. 61° W. 270 feet, more or less, to the intersection of the center line of a proposed 60 foot street for the northwest corner of this tract; Thence with said center line S. 29° W. 720 feet, more or less, to the point of intersection of a curve to the left; Thence S. 7° W. 240 feet, more or less, to the point of intersection of a curve to the right; Thence S. 29° W. 100 feet, more or less, S. 61° E. 30 feet to the northwest corner of said Lot 1, Block 2 and a corner of this tract; Thence with the westerly boundary line of Lot 1, S. 29° W. 85 feet; S. 61° E. 135 feet, more or less, to the Point of Beginning. Said tract or parcel to be changed from "R -1B" One Family Dwelling District to "R -2" Two Family Dwelling District. TRACT B A tract or parcel of land consisting of 4.6 acres, more or less, out of Lot 9, Section 49 of Flour Bluff and Encinal Farm and Garden Tracts in Nueces County, Texas, and consisting in part of Lot 12, Block 2 and Lot 1 through 6, Block 3 of Stoddart Smith Subdivision Unit 1 as filed in Volume 23, Page 9 of the map records of said county; Beginning at the southeast corner of said Lot 12, Block 2, for the southeast corner and point of beginning of this tract; -2- -. .x - •� { , � ! r _.,(R±a'q'LC','Y'. �;,wa'4:°4.:... ...x... -. F. `Sx -' _�„ ,. �- Z- I Thence with the southerly boundary line of this tract N. 61° W. 270 feet, more or less, S. 29° W. 25 feet; N. 61° W. 25 feet to the southwest corner of this tract; Thence N. 29° E. 735 feet, more or less, to the intersection of the center line of Division Road for the northwest corner of this tract; Thence with said center line S. 61° E. 165 feet, more or less; S. 29° W. 36 feet; S. 61° E. 135 feet, more or less, to the westerly right of way line of Waldron Road for the northeast corner of this tract; Thence with said right of way line, same being the easterly boundary line of said Blocks 2 and 3, S. 29° W. 460 feet, more or less; N. 61° W. 85 feet, more or less, S. 29° W. 60 feet; S. 61° E. 85 feet, more or less, S. 29° W. 153 feet, more or less, to the Point of "Beginning. Said tract or parcel to be changed from "R -1B" One Family Dwelling District to "A -1" Apartment House District. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making the aforesaid changes for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emer- gency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, th the { day of Jary, 1972.
