HomeMy WebLinkAbout10701 ORD - 02/09/19722 /10 /72:vmp AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A REAL ESTATE SALES CONTRACT FOR THE ACQUISITION OF A PARCEL OF LAND OUT OF LOT 12, SECTION 28, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, AS SHOWN BY MAP OR PLAT OF RECORD IN VOLUME A, PAGE 43, MAP RECORDS OF NUECES COUNTY MAP RECORDS, FROM THE OWNER, ENNIS S. JOSLIN, SAID ACQUISITION TO BE FOR THE THOMPSON ROAD RIGHT OF WAY AND SEWAGE LIFT STATION; APPROPRIATING AND REAPPROPRIATING OUT OF NO. 250 SANITARY SEWER BOND FUND THE SUM OF $1,090, OF WHICH AMOUNT $1,000 IS FOR COST OF ACQUISITION AND $90 IS FOR INCIDENTAL EXPENSES RELATED TO CLOS- ING COSTS, ALL IN CONNECTION WITH PROJECT NO. 250- 61 -29, THOMPSON ROAD LIFT STATION AND FORCE MAIN; AND DECLAR- ING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be, and he is hereby, authorized and directed to execute, for and on behalf of the City of Corpus Christi, a real estate sales contract for the acquisition of a parcel or tract of land out of Lot 12, Section 28,,Flour Bluff and Encinal Farm and Garden Tracts, as shown by map or plat of record in Volume A, page 43, Map Records of Nueces County, Texas, and more fully described hereinafter, from the owner, Ennis S. Joslin, said acquisition to be for the Thompson Road Right of Way and Sewage Lift Station: A tract of land 50 feet in width and 70 feet in length out of Lot 12, Section 28, of the Flour Bluff and Encinal Farm and Garden Tracts as shown by map or plat of record in Vol. A, Page 43, Map Records of Nueces County, Texas. Said tract of land being more particularly described by metes and bounds as follows: Beginning at a point in the southeast boundary line of Lot 12, Section 28, Flour Bluff and Encinal Farm and Garden Tracts, said point bears N. 281 01' 40" E. 20 feet from the south corner of said Lot 12; Thence N. 620 W. with the northeast right of way line of Thompson Road a distance of 50 feet to a point for the west corner of this tract; Thence N. 28° 01' 40" E. a distance of 70 feet to a point for the north corner of this tract; Thence S. 62° E. a distance of 50 feet to a point in the southeast boundary line of said Lot 12 for the east corner of this tract; '10701 Thence S. 281 01 40" W. with the southeast boundary line of said Lot 12 a distance of 70 feet to the place of beginning. SECTION 2. There is hereby appropriated and reappropriated out of No. 250 Sanitary Sewer Bond Fund the sum of $1,090, of which amount $1,000 is for the acquisition costs and $90 is for incidental expenses related to closing costs, all in connection with Project No. 250- 61 -29, Thompson Road Right of Way and Sewage Lift Station. SECTION 3. The necessity to authorize the acquisition of the aforesaid parcel or tract of land in order that the project may be completed without delay creates a public emergency and an impera- tive public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the '?#J day of February, 1972.
