HomeMy WebLinkAbout10715 ORD - 02/16/1972AN ORDINANCE CLOSING ALL THAT AREA SHOWN ON THE CITY MAP AS BEING A PORTION OF RAILROAD AVENUE LYING IMMEDIATELY NORTH OF AND ADJOINING LOTS 9, 10, 11 AND 12, AND THE EAST ONE -HALF OF THE CLOSED PORTION OF &OTH STREET ADJOINING LOT 12, BLOCK 5; AND A PORTION OF RAILROAD AVENUE LYING IMMEDIATELY NORTH OF AND ADJOINING BLOCK 6, ALL IN PATRICK WEBB ADDITION; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing con- cerning the closing of that area shown on the City map as being a portion of Railroad Avenue lying immediately north of and adjoining Lots 9, 10, 11 and 12, and the east one -half of the closed portion of 20th street adjoining Lot 12, Block 5; and a portion of Railroad Avenue lying immediately north of and adjoining Block 6, all in Patrick Webb Addition, in the City of Corpus Christi, Nueces County, Texas, was given by publication and registered mail to the last known addresses of the owners of property abutting said portions of streets and within 450 feet of the area to be closed and there- after, pursuant to said notice, public hearing was held at Regular Meeting of the City Council of the City of Corpus Christi on Wednesday, February 9,• 1972, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing 72— that that it would best serve the public convenience and necessity to close the S,t,Z 5'1'Ne�� !) 1.1- rlGCE 7..4 / Ny F-ou aforesaid streets in the Patrick Webb Addition for use of the public; and WHEREAS, it has been determined that it is to the advantage of v the City to close all of the aforesaid streets within the Patrick Webb Addition so that the same may be used by the abutting property owners for other purposes, said closing to provide that Texas - Mexican Railway Company may continue to use its existing tracks, without requiring any compensation to be paid by the owners: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That all that area shown on the City Map as being a portion of Railroad Avenue lying immediately north'of and adjoining Lots 9, 10, 11 and 12, and the east one -half of the closed portion of 20th Street adjoining Lot 129 Block 5; and a portion of Railroad Avenue lying immediately north of and adjoining Block 6, all in Patrick Webb Addition, be officially closed, with the provision that Texas - Mexican Railway Company may continue use of its existing tracks, without requiring any compensation to be paid 10715 J, by the owners, and the aforesaid portions of City streets are hereby closed for public use and abandoned to the owners of the abutting property. SECTION 2. The fact that the public convenience and necessity would be better served by the closing of the aforesaid streets creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested <the..suspension . of the Charter -rule and that this < ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the Ap YZ day of February, 1972.
