AN ORDINANCE
CLOSING AND ABANDONING A 10 -FOOT UTILITY EASEMENT
IN LOT 3, BLOCK 1, EBONY ACRES ANNEX; AND DECLARING
AN EMERGENCY.
WHEREAS, there exists a 10 -foot utility easement in Lot 3,
Block 1, Ebony Acres Annex, in the City of Corpus Christi, Nueces County,
Texas; and
WHEREAS, it has been determined that the said easement is not
now needed by the City, nor will it within the foreseeable future be
needed by the City of Corpus Christi; and
WHEREAS, it has been determined that it is to the advantage of
the City to abandon the said 10 -foot easement so that the same may be
used by the owners of the aforesaid property for other purposes:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI,TEXAS:
SECTION 1. That the 10 -foot utility easement existing in
Lot 3, Block 1, Ebony Acres Annex, in the City of Corpus Christi, Nueces
County, Texas, be and the same is closed and abandoned for public use and
abandoned to • the owners of the said Lot 3, Block 1, Ebony Acres Annex.
SECTION 2. The fact that the public convenience and necessity
would be better served by the closing of the aforesaid utility easement
creates a public emergency and an imperative public necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall
passed finally on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council, aid
the Mayor having declared such emergency and necessity to exist, and having
requested the suspension of the Charter rule and that this ordinance
be passed finally on the date of its introduciton and take effect and
be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the /6%ay of ch, 1972

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCEDi AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
