HomeMy WebLinkAbout10754 ORD - 03/22/1972HG:jkh:3 -14 -72 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH PROJECT SET, SUMMER COLLEGE WORK -STUDY PROGRAM FOR HIRING STUDENT SUMMER EMPLOYEES, WHICH CONTRACT IS ATTACHED.HERETO AS EXHIBIT "A" AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager, R. Marvin Townsend, be, and he is hereby, authorized and directed to enter into a contract with Project SET, Summer College Work -Study Program for hiring student summer employees, which contract is attached hereto as Exhibit "A" and made a part hereof. SECTION 2. The importance of providing the aforesaid summer college work -study program creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed fLnally on the date of its.intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full, force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this theo(dLday of March, 1972. ATTEST: /x,--�, Z,� , - 1 City Secr tar MAYOR THE CITY OF CORPUS CHRISTI, TEXAS APPROVED: DAY OF MARCH, 1972: 04"w -City Attorney" ' 1C'i5-J r Project SET CERTIFICATE OF AGREEMENT WHEREAS, the City of Corpus Christi is a public organization supported by tax money being a local city; and WHEREAS, the employees contemplated in this agreement will be covered under F.I.C.A: NOW, THEREFORE, do the parties hereto agree, covenant and contract as follows: 1. This AGREEMENT is entered into by the City of Corpus Christi, hereinafter known as the Employing Agency, and Project SET, Summer College Work -Study Program, hereinafter known as Project SET entered into on the day of , 1972. 2. Project SET agrees to pay eighty percent (80 %) of student salary(ies) as required by the Higher Education Act of 1965, as amended. The rate of pay will be one dollar and eighty -five cents ($1.85) per hour, not to exceed forty (40) hours per week for twelve (12) weeks. No student may work more than forty (40) hours per week under Project SET; if they work more hours than this, the Employing Agency is responsible for the full pay above the forty (40) hours. 3. The above named Employing Agency agrees to pay the remaining twenty percent (20%) of said salary(ies) plus: Other employer costs incurred by the employment including 5.2% employer's share of F.I.C.A., and 5.2% for administrative costs, or a TOTAL AGENCY SHARE of 30.4% of said salary(ies).' No student shall be allowed to work more than twelve (12) weeks or 480 hours, whichever comes first. Any student who reaches this limit shall cease to be an employee of the Agency. If an employer allows a student to exceed 480 hours, the Agency is responsible for 100% of salary, administrative costs, and other employer expenses. Any of the above funds unexpended at the conclusion of the program, except for the 5.2% administrative cost contributed by the Employing Agency, will be refunded to the Employing Agency twenty days after the last scheduled pay period. J 4. The Employing Agency further agrees that the student(s) will be supervised by Department Supervisor where assigned who will give proper guidance and counseling to insure proper performance of services. The supervisor will keep appropriate time records on all students employed by this Agency under Project SET. These Time Record Sheets are to be sent to Project SET at the end of each pay period for payroll processing. 5. Work to be performed under this Agreement: a. Should be related to the student's educational objectives, OR be work in the public interest which would not other- wise be provided; b. Will not result in displacement of employed workers or impair existing contracts for services; c. Will not involve political activity or work for any political party; d. Will not involve the construction, operation, or maintenance of any part of any facility used, or to be used, for sectarian instruction or as a place of worship. 6. No student will be denied work or be subject to different treat- ment on the grounds of race, color, or national origin, and this Agency will comply with the provisions of the Civil Right Acts of 1964 (PL880352) and the Regulations of the Department of Health, Education and Welfare which appertain thereto. 7. The Employing Agency assumes full-responsibility for providing Workmen's Compensation Insurance or Liability Insurance for students accepted under Project SET, as required by and in compliance with Texas statutes. B. The Agency shall be deemed the employer for the purpose of this Agreement, as outlined above, and has the right to ultimate direction and control of the individual in the performance of his gervices. The Employing Agent knows and understands the provision of Project SET, Summer College Work -Study Program, and agrees to abide by these regulations. ATTEST: CITY OF CORPUS CHRISTI EY T.
