HomeMy WebLinkAbout10755 ORD - 03/22/1972jkh:3 -17 -72 AN ORDINANCE AUTHORIZING TERMINATION OF THE EXISTING CONTRACT FOR ARCHITECTURAL SERVICES WITH ORBY G. ROOTS AND CHARLIE L. BELLAH, ASSOCIATED ARCHITECTS, FOR THE DESIGN OF A MUNICIPAL SWIMMING POOL IN GREENWOOD PARK, ACCORDING TO THE TERMS OF SAID CONTRACT AUTHORIZED BY ORDINANCE NO. 9847; AUTHORIZING TOTAL PAYMENT TO THE SAID ARCHITECTS OF $6,754.10; REVERTING THE REMAINING APPROPRIATION FOR THE AFORESAID CONTRACT; AND DECLARING AN EMERGENCY. WHEREAS, Ordinance No. 9847, dated July 22, 1970, authorized the execution of a contract between the City of Corpus Christi and Orby G. Roots and Charlie L. Bellah, Associated Architects, for the design of a municipal swimming pool in Greenwood Park, and appropriation of funds for payment of architectural fees was likewise authorized; and WHEREAS, by the terms of the contract, Section 3, Article III thereof, upon mutual agreement between the parties, said contract could be terminated upon completion of sixty -six percent (66 %) of the Design Phase or payment of fifty -eight percent (58 %) of the total Basic Fee; and WHEREAS, it has been mutually agreed that it would be advantageous to terminate the contract heretofore existing and to make payment of the fees set forth: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The contract for architectural services with Orby G. Roots and Charlie L. Bellah, Associated Architects, heretofore authorized by Ordinance No. 9847, is hereby terminated in accordance with the provi- sions of Section 3, Article III of the said contract, and authorization is hereby given for payment to the architects of $6,754.10, representing completion of sixty -five percent (65 %) of the Design Phase or fifty -eight percent (58 %) of the total Basic Fee of $11,645. SECTION 2. The sums heretofore appropriated by Ordinance No. 9847 and not expended are to revert to the No. 291 Park Bond Fund. SECTION 3. The necessity to terminate the contract heretofore existing between the City of Corpus Christi and Orby G. Roots and Charlie L. Bellah for design of a municipal swimming pool in Greenwood Park creates a 10755 ,L w public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the o< `,t ay of March, 1972.
