HomeMy WebLinkAbout10781 ORD - 04/05/1972JRR:ml 4/3/72; 1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A REAL ESTATE SALES CONTRACT FOR THE ACQUISITION OF PARCEL NO. 1 OF THE GOLLIHAR ROAD PROJECT, FROM CADDO TO AIRLINE ROAD, FROM THE OWNERS, HERBERT A. DETTERMAN AND WIFE, HELEN FAYE DETTERMAN, APPROPRIATING OUT OF THE 220 STREET BOND FUND $100 TO SUPPLEMENT FUNDS PREVIOUSLY APPRO- PRIATED BY ORDINANCE NO. 10720 AS APPLIED TO THIS PARCEL, ALL APPLICABLE TO PROJECT 220 -70 -110; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be, and he is hereby, authorized and directed to execute, for and on behalf of the City of Corpus Christi, a real estate sales contract for the acquisition of Parcel No. 1 of the Gollihar Road project, from Caddo to Airline Road, and more fully described hereinafter, from the owners, Herbert A. Detterman and wife, Helen Faye Detterman. Being a 6.5 foot wide strip of land out of Lot 1, Block 9, Koolside Addition as shown by Map of Record in Volume 13, Page 32 and 33, Map Records, Nueces County, Texas, said strip of land being more particularly described by metes and bounds as follows: Beginning at the most westerly corner of said Lot 1, for the most westerly and beginning corner of the tract herein described; Thence N. 290 20' E., with the northwest boundary line of said Lot 1, a distance of 6.50 feet to a point for the most northerly corner of the tract herein described; Thence S. 600 40' E., with a line that is 6.5 feet northeast of and parallel to the southwest boundary line of said Lot 1, a distance of 128.65 feet to a point in the arc of a curve at the right -of -way intersection of Gollihar Road and Lum Avenue for the most easterly corner of the tract herein described; Thence in a westerly direction with the arc of said curve to the right whose central angle is 380 36', and whose radius is 30.0 feet, a distance of 20.12 feet to a point in the southwest boundary line of said Lot 1, and in the existing northeast right -of -way line of Gollihar Road for a corner of this tract; Thence N. 600 40' W., with the southwest boundary line of said Lot 1, and with the existing northeast right -of -way line of said Gollihar Road, a distance of 110.0 feet to the point of beginning. Containing 797.9 square feet of land more or less. SECTION 2. There is hereby appropriated out of the No.*220 Street Bond Fund $100 to supplement funds previously appropriated by Ordinance 10 78l No. 10720 as applied to this parcel, all applicable to Project 220 -70 -100. SECTION 3. The necessity ro authorize the acquisition of the aforesaid parcel or tract of land in order that the project may be completed without delay creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect // from and after its passage, IT IS 6?& ACCORDINCLSY SO ORDAINED, this the day April, 1972.
