CARSON, FOR ACQUISITION OF PARCEL ` NO. 4, AND TO EXECUTE RIGHT OF WAY DEED AND DEDICATION WITH ABED N. BROWN AND WIFE, HELGA B. BROWN, FOR PARCEL NO. 3, AIRLINE ROAD, ALAMEDA TO OCEAN DRIVE PROJECT, NO. 220 -70 -119; APPROPRIATING OUT OF NO. 220 STREET BOND FUND $665, OF WHICH AMOUNT $125 IS APPLICABLE TO PARCEL NO. 4 AND $540 IS APPLICABLE TO PARCEL NO.3; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: `SECTION 1. The City Manager be and he is hereby authorized to execute real estate sales contract with George Fowler Carson, Jr. and wife, Patricia E. Carson, for acquisition of Parcel No. 4, and to execute right of way deed and dedication with Abed N. Brown and wife, Helga B. Brown, for Parcel No. 3, Airline Road, Alameda to Ocean Drive Project, No. 220 -70 -119, said parcels being described as follows, respectively: PARCEL Being an irregularly shaped tract of land out of N0. 4 Lot 43, Camden Place, as shown by map of record in Volume 26, Page 3, Map Records, Nueces County, Texas, said tract of land being more particularly described by metes and bounds as follows: Beginning at a point in the northwest boundary line of said Lot 43, and in the Southeast right of way line of Airline Road, said point being S. 28° 58'30 ", 127.81 feet from the most northerly corner of said Lot 43, for the most northerly and beginning corner of the tract herein described; Thence S. 28° 58' 30" W., with the northwest boundary line of said Lot 43, a distance of 35.0 feet to a point, the most westerly corner of said Lot 43, for the most westerly corner of the tract herein described; Thence S. 2° 26' 05" W., with the west boundary line of said Lot 43, a distance of 10.54 feet to the South- west corner of said Lot 43, and the Northwest corner of Lot 1, Block 4, Brentwood Village as shown by map of record in Volume 16, page 41, Map Records, Nueces County, Texas, for the Southwest corner of the tract herein described; Thence S.610 05' 30" E., with the Southwest boundary line of said Lot 43, and with the northeast boundary line of said Lot 1, a distance of 7.74 feet to a point, for the most Southerly corner of the tract herein described; Thence N. 13° 19' 20" E., a distance of 46.13 feet to the point of beginning. Containing 500.12 square feet of land more or less. 10782 SRR:jkh:4 -4 -72 lst PARCEL Being a triangular tract of land out of Lot 1, Block 4, NO. 3 Brentwood Village, as shown by map of record in Volume 16, page 41, Map Records, Nueces County, Texas, said triangular tract of land being more particularly described by metes and bounds as follows: Beginning at the most northerly corner of said Lot 1, and the Southwest corner of Lot 43, Camden Place as shown by map of record in Volume 26, page 3, Map Records, Nueces County, Texas, said point being in the East right of way line of Airline Road for the most northerly corner of the tract herein described; Thence S. 61' 05' 30" E., with the Northeast boundary line of said Lot 1, and with the Southwest boundary line of said Lot 43, a distance of 7.74 feet to a point for the most easterly corner of the tract herein described; Thence, S.- 13o- 3,9L_20 ",W.,,..a distance - .of.36..67,.feet to a point in the west boundary line of said Lot 1, and the east right of way line of said Airline Road for the most southerly corner of the tract herein described; Thence N. 2° 26' 05" E., with the west boundary line of said Lot 1, and with the east right of way line of said Airline Road, a distance of 39.46 feet to the point of beginning. Containing 136.6 square feet of land more or less. SECTION 2. There is hereby appropriated out of No. 220 Street Bond Fund the sum of $665, of which amount $125 is for Parcel 4, and $540 is applicable to Parcel No. 3, all in connection with Project No. 220 -70 -119, Airline Road, Alameda to Ocean Drive Project. SECTION 3. The necessity to authorize the execution of the necessary documents and to authorize the payment of funds for the acquisition of the aforesaid parcels of land as soon as possible creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 6jZ -day d April, 1972.
