HomeMy WebLinkAbout10783 ORD - 04/05/1972JRR:jkh:4 =4 =72; 1st ' AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH FLOYD COOPER CONSTRUCTION COMPANY FOR THE RECON- STRUCTION OF BEN GARZA PARK GYMNASIUM; APPROPRIATING $255,000, OF WHICH $107,055 IS OUT OF THE NO. 102 GENERAL FUND UNAPPROPRIATED BALANCE FOR THE CONSTRUC- TION CONTRACT; $68,706 IS OUT OF THE NO. 102 GENERAL FUND FOR THE CONSTRUCTION CONTRACT; AND $79,239 IS OUT OF THE NO. 291 PARK BOND FUND, OF WHICH $73,489 IS FOR THE CONSTRUCTION CONTRACT AND $5,750 IS FOR CONTINGENCIES, ALL APPLICABLE TO PROJECT NO. 291- 70 -15; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Manager be and he is hereby authorized to execute a contract with Floyd Cooper Construction Company for the reconstruction of Ben Garza Park Gymnasium, Project No. 291- 70 -15, all as is more fully described in the plans and specifications and contract documents on file in the office of the City Secretary, all of which we made a part hereof by reference and according to the bid of Floyd Cooper Construction Company opened on the 22nd day of March, 1972, the said bid of Floyd Cooper Construction Company being the lowest and most advantageous to the City of Corpus Christi. SECTION 2. There is hereby appropriated the sum of $255,000, of which $107,055 is out of the No. 102 General Fund Unappropriated Balance for the construction contract; $68,706 is out of the No. 102 General Fund for the construction contract; and $79,239 is out of the 291 Park Bond Fund, of which 73,489 is for the construction contract and $5,7503s for contingencies, all applicable to Project No. 291- 70 -15. SECTION 3. The necessity to execute the aforesaid contract and to appropriate the sums hereinabove set out at the earliest possible date, so that construction may commence, creates a public emergency and an impera- tive public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduc- tion and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this theme � day of April, 1972.
