HomeMy WebLinkAbout10795 ORD - 04/12/1972R' TV JRR:vmp:4 /11/72 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF THE CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON (1) ALL OF LOT F, MT. VERNON SUBDIVISION FROM "B -1" NEIGHBORHOOD BUSINESS DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT; (2) A PORTION OF LOT 16, SECTION 3, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS FROM "B -1" NEIGHBORHOOD BUSI- NESS DISTRICT'AND "R -1B" ONE - FAMILY DWELLING DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT; (3) A PORTION OF LOT 16, SECTION 3, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS FROM "R -1B" ONE- FAMILY DWELLING DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT; AND (4) "R -1B" ONE - FAMILY DWELLING DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT ON A PORTION OF LOT 3, OSO FARM TRACTS; SAID TRACTS OR PARCELS OF LAND BEING SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of The City of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on April 5, 1972, at Special Council Meeting of the City of Corpus Christi; and - - WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 1.0'795 SECTION 2. That the zoning on (1) all of Lot F, Mt. Vernon Subdivision be changed from "B -1" Neighborhood Business District to "B -4" General Business District; (2) that the zoning on a portion of Lot 16, Section 3, Flour Bluff & Encinal Farm & Garden Tracts, hereinafter described more fully as follows: BEGINNING at a point in the northwest corner of Lot 16, Section 3, Flour Bluff & Encinal Farm & Garden Tracts, such point also being the southeast corner of the inter- section of South Padre Island Drive and Everhart Road; THENCE south 29° 15 Minutes west for a distance of 675 feet to a point for a corner; THENCE south 611 00 Minutes 40 Seconds east for a dis- tance of 630 feet to a point for a corner; THENCE north 29° 15 Minutes east for a distance of 700 feet to a point for a corner, such point also being on the south right -of -way line of South Padre Island Drive; THENCE south 64° 45 Minutes 3C Seconds west for a distance of 501.7 feet to a point for a corner; THENCE north 61° 24 Minutes west to the place of beginning; be, and the same is hereby, changed from "B -1" Neighborhood Business District and "R -1B" One - Family Dwelling District to "B -4" General Business District; (3) that the zoning on a portion of Lot 16, Section 3, Flour Bluff & Encinal Farm & Garden Tracts, hereinafter more fully described as follows: BEGINNING at a point in the northwest corner of Lot 1, Block 14, Gardendale Addition, Unit #3, such point also being on the east right -of -way line of Everhart Road; THENCE north 29° 15 Minutes east for a distance of 230 feet to a point for a corner; THENCE south 61° 00 Minutes 40 Seconds east for a dis- tance of 630 feet to a point for a corner; THENCE south 29° 15 Minutes west for a distance of 230 feet to a point for a corner, such point also being on the north boundary line of Block 14, Gardendale Addition, Unit #3; THENCE along the north boundary line of Gardendale Addi- tion, Unit 3, north 61° 00 Minutes, 40 Seconds west to the place of beginning; be, and the same is hereby, changed from "R -1B" One - Family Dwelling District to "AB" Professional Office District; and (4) that the zoning on a portion of, Lot 3, Oso Farm Tracts, hereinafter described more fully as follows: BEGINNING at a point in the southeast corner of Block C, Levek Addition; ' -2- c THENCE north 29° 01 Minutes 50 Seconds east for a distance of 327.39 feet to a 3/4" iron pipe; THENCE south 60° 58 Minutes 10 Seconds east for a distance of 150 feet to a 3/4" iron pipe, such point also being on the west right -of -way line of Everhart Road; THENCE south 29° 15 Minutes west for a distance of 327.39 feet to a point for a corner; THENCE north 601 58 Minutes 10 Seconds west to the place of beginning; be, and the same is hereby, changed from "R -1B" One - Family Dwelling District to "B -4" General Business District; said tracts or parcels of land being situated in the City of Corpus Christi, Nueces County, Texas. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in con- flict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of April, 1972.
