HomeMy WebLinkAbout10819 ORD - 04/19/1972JRR:ml:4- 19- 72;1st r i TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A REAL ESTATE SALES CONTRACT WITH PHIL MASSAD AND WIFE_, MILDRED MASSAD, FOR THE ACQUISITION PARCEL NO. 1, AIRLINE ROAD IMPROVEMENTS, SOUTH ALAMEDA TO OCEAN DRIVE, APPROPRIATING OUT OF THE NO. 220 STREET BOND FUND $3,004, OF WHICH $2,904 IS FOR THE ACQUISITION AND $100 IS FOR CLOSING COST AND INCIDENTAL EXPENSES ALL APPLICABLE TO PROJECT NO. 220 -70 -119; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be, and he is hereby authorized, for and on behalf of the City of Corpus Christi, to execute a real estate sales contract for the acquisition of Parcel No. 1, Airline Road Improvements, South Alameda to Ocean Drive, Project No. 220 -70 -119, from the owners Phil Massad and wife, Mildred Massad, said parcel of land being described as follows: Being a 0.033 acre tract of land out of Lot 1, Ocean Village Estates Unit 1, as shown by map of record in Volume 12, Page 57, Map Records, Nueces County, Texas, said 0.033 acre tract of land being more particularly described by metes and bounds as follows: Beginning at a phint in the existing northwest right of way line of original 60 foot wide Airline Road, said point being S. 280 06' 15" W., 113.47 feet from the original east corner of said Lot 1, for the most easterly and beginning corner of the tract herein described; Thence S. 280 06, 15" W., with the existing southeast right of way line of said Airline Road, a distance of 290.36 feet to a point for the most southerly corner of the tract herein described; Thence in a northeasterly direction with the are of a curve to the left whose central angle is 30 56, 43 ", and whose radius is 2110.03 feet, a distance of 145.29 feet to a point the P.C.C. of curves; Thence in a northeasterly direction with the arc of a curve to the right whose central angle is 30 56' 43 ", and whose radius is 2110.03 feet, a distance of 145.29 feet to a point in the Southwest corner of that certain 0.105 acre tract conveyed to the City of Corpus Christi by Pail Massad.and recorded in Volume 1315, Page 57, Deed Records, Nueces County, Texas for the northwest corner of the tract herein described; Thence S. 610 53, 45" E., with the most southerly southwest bouni ary line of said 0.105 acre tract of land, a distance of 10.0 feet to the point of beginning. 10819 SECTION 2. There is hereby appropriated $3,004 out of No. 220 Street Bond Fund, of which amount $2,904 is for the acquisition and $100 is for incidental expenses related to the closing costs, all in connection with Project No. 220 -70 -119. SECTION 3. The necessity to authorize the execution of the neces- sary documents and to authorize the payment of funds for the acquisition of the aforesaid parcel of land as soon as possible creates a public emergency # and im erative p� public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of April, 1972.
