HomeMy WebLinkAbout10825 ORD - 04/26/1972JRR:jkh:4 -7 -72; 1st' a AN ORDINANCE REPEALING ORDINANCE NO. 10757, PASSED AND APPROVED ON MARCH 22, 1972, AND IN LIEU THEREOF, CLOSING AND ABANDONING A 10 -FOOT UTILITY EASEMENT BETWEEN LOTS 5 AND 6, BLOCK 1, COUNTRY ESTATES UNIT NO. 3 -B, SUBJECT TO DEDICATION OF AN ALTERNATE EASEMENT BETWEEN LOTS 6 AND 7, BLOCK 1; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot utility easement between Lots 5 and 6, Block 1, Country Estates Unit No. 3 -B, in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, the aforesaid easement is not now needed by the City of Corpus Christi; and WHEREAS, it has been determined that it is to the advantage of the City to abandon the easement hereinabove described so that the same may be used by the owners of the aforesaid lots for other purposes, subject, however, to the dedication by said owners of an alternate easement between Lots 6 and 7, Block 1, Country,Estates Unit No. 3 -B: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 10757, passed and approved by the City Council on March 22, 1972, be and the same is hereby repealed in its entirety. SECTION 2. That the 10 -foot utility easement between Lots 5 and 6, Block 1, Country Estates Unit No. 3 -B, in the City of Corpus Christi, Nueces County, Texas, be and the same is closed and abandoned for public use and abandoned to the owners of said Lots 5 and 6, Block 1, Country Estates Unit No. 3 -B. Said abandonment, however, is to be subject to dedication by the abutting owners of an alternate easement between Lots 6 and 7, Block 1, Country Estates Unit No. 3 -B, as shown on the plat attached hereto and made a part hereof by reference. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall r be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the 10825 suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the e26$0 -) day of April, 1972.
